Abstract

This research explores the evolving legal landscape surrounding criminal liability in traffic accidents involving AI-driven vehicles. The study aims to analyze the conceptual and practical challenges posed by assigning criminal responsibility in such cases, particularly focusing on the comparison of legal frameworks at the international level. The research methodology employed is a normative legal study, utilizing a comparative approach to analyze existing laws and regulations related to AI-driven vehicles in the United States, the European Union, and Japan. The study examines the theoretical foundations of criminal liability, including mens rea and actus reus, in the context of AI technology. The findings of this research highlight the need for innovative legal adaptations to address the unique challenges posed by AI-driven vehicles. Concepts such as vicarious liability and ethical decision-making algorithms emerge as potential solutions to ensure accountability and safety in autonomous transportation. The study also underscores the importance of international cooperation in harmonizing legal standards to facilitate the global deployment of AI-driven vehicles.

Abstract

This study aims to analyze and compare the regulatory frameworks of Indonesia and Germany concerning the use of Artificial Intelligence (AI) in elections, focusing on preventing the potential misuse of AI technologies. The research employs a normative legal methodology, utilizing a statutory approach, a comparative approach, and a conceptual approach. Through a systematic analysis of legal texts and relevant literature, the study examines the strengths and weaknesses of each country's regulatory framework. The findings reveal significant differences between Indonesia and Germany, particularly in terms of data protection, transparency, and oversight mechanisms. Germany's framework, exemplified by the General Data Protection Regulation (GDPR), provides robust safeguards against AI misuse in electoral contexts, emphasizing transparency and accountability. In contrast, Indonesia's regulatory framework is still developing, with significant gaps that leave it vulnerable to AI-driven electoral manipulation. The study concludes with recommendations for Indonesia to strengthen its legal provisions, enhance transparency requirements, and establish independent oversight bodies to safeguard the integrity of its electoral processes. These findings contribute to the broader discourse on AI regulation in democratic contexts, highlighting the importance of adapting legal frameworks to keep pace with technological advancements.

Abstract

This research provides a comprehensive comparative analysis of the regulatory frameworks for e-commerce in Indonesia and South Korea, focusing on how each country manages unfair business practices within their digital markets. The study employs a normative legal research method, incorporating systematic literature reviews and a comparative approach to explore the intricacies of each country's legal frameworks and their enforcement mechanisms. The findings reveal significant differences in the level of technological integration and the specificity of legal frameworks between the two countries. South Korea exhibits a more advanced regulatory framework with specific e-commerce laws and robust technological enforcement mechanisms that enhance compliance and market monitoring. Conversely, Indonesia's broader and less specific regulations result in ambiguities that hinder effective enforcement and compliance. The study suggests that Indonesia could benefit from refining its legal framework to include more precise regulations tailored to digital transactions and enhancing its technological capabilities for enforcement. This comparative analysis underscores the importance of adaptive and technology-driven regulations in maintaining fair competition and safeguarding consumer interests in the rapidly evolving digital marketplace.

Abstract

his study aims to explore the development of regulations governing artificial intelligence (AI) and their implications for intellectual property (IP) protection. The research employs a normative legal approach, utilizing legislative, conceptual, and comparative methodologies to examine current regulatory frameworks and identify gaps in the protection of AI-generated works. By analyzing the legal landscapes of the United States, European Union, Japan, and China, the study provides a comprehensive overview of how different jurisdictions are addressing the challenges posed by AI in the context of IP law. The findings indicate significant discrepancies in how AI-generated content is treated across these regions, with most existing IP laws requiring human authorship and inventorship, thereby excluding AI-generated works from protection. This gap poses challenges for innovation and raises ethical and social concerns about the future of creativity and employment. The study suggests the need for new legal categories or a sui generis system that offers specific protections for AI-generated content. Additionally, it underscores the importance of stakeholder engagement and international cooperation in developing balanced and effective regulatory frameworks. The research concludes that continuous adaptation of IP laws is essential to keep pace with the rapid advancements in AI technology. Theoretical implications highlight the necessity of rethinking traditional IP concepts, while practical implications emphasize the importance of clear, consistent regulations to foster innovation and provide legal certainty. The study's comparative approach offers valuable insights into best practices and potential areas for harmonization, contributing to the development of global standards for AI and IP protection.

Abstract

This paper aims to explore the impact of artificial intelligence on business competition and the corresponding legal and regulatory framework in Indonesia. The research employs a comprehensive literature review and policy analysis to examine the current state of AI adoption in the business sector, the associated challenges and opportunities, and the existing legal and regulatory landscape. The findings indicate that the use of AI-powered technologies can significantly affect business competitiveness, leading to both disruptions and advancements. However, the legal and regulatory framework in Indonesia has not kept pace with the rapid technological changes, posing challenges for businesses in navigating the complex and evolving landscape. To address these issues, the study recommends the establishment of collaborative platforms for ongoing dialogue and knowledge-sharing among government, industry, and academia. These platforms would facilitate the exchange of information, insights, and best practices, enabling the development of a more responsive and adaptable legal and regulatory framework. Additionally, the research highlights the importance of implementing robust workforce development initiatives to address skills gaps and ensure the effective and sustainable adoption of AI technologies within businesses. Overall, this study provides valuable insights for policymakers, business leaders, and industry stakeholders in understanding the impact of AI on business competition and the critical need for a comprehensive and collaborative approach to legal and regulatory frameworks in Indonesia.
