Abstract

The research is designed qualitatively, focusing on the aspects that become the background (motives) tothe decision of choosing misyarmarriage among career women in Surabaya. Reseach results show: First,the model of misyar marriage is to give a solution to busy women who have no time to think aboutmarriage. In the midst of their busy life, these women can enjoy marriage, because in this marriagehusband and wife do not have to live in the same house. Therefore, the wife can do her normal activitieslike before she is married, so can the husband. Secondly, it can be inferred from the practice of misyarmarrigein Surabaya in the perpective of Dramaturgy theory that the average actors of misyarmarriage are middleto-upper class women, both n terms of education economy. They are smart and active in simultaneouslyplaying two roles. On the one hand, ther are just single women at home, but married womenwhen staying in a hotel or motel. However on the other hand, in a quiet place or in bed, they are marriedwomen, but when they do their activities or even mingle with single women, they will admit to be singleas well.

Abstract

Delaying obligation payment by the customer to the syariah financial institution in some countrieswhose moslem as the majority, need solutions. One of them is determining Islamic organization fatwa.International Islamic Fiqh Academy has declared fatwa of retributive condition of prohibition based onthe agreement between the bank and the customer, while Sharia Directory of Indonesia permits this.Problem of this research is how the concept of retributive condition in those two organizations is andwhat method used in determining fatwa of the retributive condition is. This research used qualitativeapproach based on library research, while type of this research is comparative descriptive by usingistislahi approach. The result shows that there is significant difference between fatwa from InternationalIslamic Fiqh Academy and Sharia Directory of Indonesia in determining the kind of contrac, that canaccept retributive condition based on International Islamic Fiqh Academy, fine can not be applied in ancontrac which causes obligation, such as salam, transaction of installments and qard. Sharia Directory ofIndonesia decides that fine clause can be applied to any contrac which causes obligation. Determiningfatwa from majma fiqh uses saddu dzariah approach by giving attention to the carefulness norms inconsideration of maslahat and mafsadat. On the other side, Sharia Directory of Indonesia uses istislahimethod which puts maslahat as the priority, especially for syariah financial organizations.

Abstract

The law of Muamalat gives the freedom to bind themselves to contracts and conduct transactions for mutual benefits and benefits. Islamic banking prepares various types of contracts in accordance with sharia provisions, one of the murabahah contracts. The formulation of the problem in this study is how is the application of fiqh maslahah in Islamic banking murabahah financing contracts? The method used in this study is a normative juridical method, which refers to the concept of law as a rule. In this research the author of the legal approach, analytical approach. The specification of this study is descriptive analytical research. The type of data used in this study are secondary data and primary data. Data collection begins with activities to identify and inventory data sources. Drawing conclusions is done using inductive methods. Murabahah is a sale and purchase agreement between a bank and a customer where the bank buys the goods needed and resells the customer with a basic cost plus profits agreed by both parties, there is no coercion from the parties in making murabahah agreements. In making and implementing murabahah financing contracts must pay attention to public interests not just the interests of the parties. According to Islamic law in making contracts based on sharia principles, must prioritize the benefit and refuse harm to achieve the goal of shara, namely to increase the benefit of the people by guaranteeing basic needs (dharuriyah) and fulfilling secondary needs, needs (hajjiiyah) and their complementary needs.

Abstract

Islamic family law or ahwal al-shakhsiyyah has prevailed in Indonesia since the inception of the law no. 1year 1974 concerning with marriage and the compilation of Islamic law in Indonesia (KHI) in 1991.Islamic family law run in Indonesia is not exactly the same as those contained in the books of classicaljurisprudence (fiqh). From its materials has been found in the legislation, there are a number of newprovisions that was different from those classical Islamic jurisprudence such as in marriage record, agerestrictions of marriage, polygamy, inheritance and wasiah wajibah etc.  These new provisions were issuedby scholars and contemporary Islamic jurists in the context of law reform.

Abstract

This paper explores the studies of the thin line between discretion (freis ermessen) with a criminal act of corruption, using Islamic law’s perspective as one of the law material in Indonesia. Aim of this paper is to make boundaries between discretion which made based on State Administration Product and regulation and help an officer who does discretion will not be trap in a criminal act of corruption through Islamic law’s perspective. This paper purpose four boundaries. First, the boundaries can be seen through understanding the qawāidul fiqhiyyah especially related to governance. Second, act of detournement de povouir (abuse of authority) and abus de droit (arbitrariness) are contradictive with prophetic’s characteristic such as ṣiddiq (honesty), amanah (accountability), tablig (effective communication), faṭonah (smart and heedful). Third, detournement de povouir or abus de droit can categorized as jarimah takzir which can be punish by the authority above them. Fourth, effort to prevent the criminal act of corruption are with uswah leadership, muraqobah, qanaah, and commitment to take care themselves and their family with halal income. For that, public administration can consider using universal values in Islamic Law to help doing discretion without trapped in criminal act of corruption.

Abstract

This paper raises the issue of the opinion of Garut Islamic scholars (ulama) about cash waqf and limited time (mu‘aqqat) of waqf, two issues of waqf are considered as the new problems of waqf for the Indonesian muslims as opposed to their view before. The findings of this study are as follows: 1) Garut Islamic scholars agree that the law of cash waqf is permitted becouse that cash waqf does not conlict with essence of waqf; 2) There are differences of opinion among Garut scholars relating the law of limited time of waqf. Some of them said that this waqf allowed becouse it does not conflict with the meaning and the esssence of waqf, even charitable opportunites for the community will be greater in the presence of limited waqf. Some other scholars consider that limited time of waqf have violated the essence of waqf to be timeless, forever. However, they still consider that there is virtue of this type of waqf, and still allowed conducted with a note its name is not waqf.

Abstract

The basis of calendar unification or matla constitutes one of the most significant issues relating to the unification effort of Hijra calendar. The popular basis of unification, so far, is based on the union of regional and global matla‘. The division of matla‘ to regional and global mat}la‘ is now no longer accurate because it can not accommodate the Hijra calendar pooling ideas in the Islamic world. This paper discusses one of the leading International astronomy thought, Mohammad Shawkat Odeh on varieties of mat}la‘ unification. He divided the principle of matla unification in to five forms: unification of global mat}la‘ (one matla’ for the whole world); the unity of matla‘ in the regions corresponding visibility of hilal; the unity of mat}la‘ in a similar area of visibility of hilal; the unity of zonal/partial matla‘; and the unity of local matla‘. Odeh’s thought on the various divisions of matla constitutes new thinking on the concept mat}la‘ astronomical calculations. He also has presented more detailed thoughts on the division of mat}la‘ rather than the others.

Abstract

Adat (custom) is a polemical topic in Islamic law. The development of Islamic law since the era of Prophet Muhammad has shown the important role of adat. Islamic law was formulated in accordance or in opposition to the custom of Arabs. However, classical Islamic legal theory (usul fiqh) does not consider it in legal argumentation. Its role is recognized in qawa‘id fiqhiyyah (principle of practical law) as one of five main principles. It is included in non-agreed legal argument. The paper is aimed to reveal the place of custom in Islamic law from the era of prophet to the contemporary era, especially in Islamic legal theory, in the principles of Islamic law, and in Islamic court according to manual book. This paper concludes that custom plays crucial role in elaborating Islamic law in practice. Custom has been acknowl- edged by Islamic scholars, especially by those of Hanafite and Malikite schools, as important part of Islamic law. However, they limites the role of custom in term of private law. The custom was never be discussed in term of rites and folklore, as it is popular now. The custom can still plays important role in Islamic private law or even in alternative dispute resolutions as far as traditional authority is needed and acknowledge by Islamic communities. Adat (custom) merupakan polemik dalam hukum Islam. Perkembangan hukum Islam sejak zaman Nabi Muhammad telah menunjukkan peran penting dari adat. Hukum Islam dirumuskan sesuai atau bertentangan dengan kebiasaan orang-orang Arab. Namun, teori hukum Islam klasik kita (usul fiqh) tidak mempertimbangkan dalam argumentasi hukum. Perannya diakui dalam qawa ‘id fiqhiyyah (prinsip hukum praktis) sebagai salah satu dari lima prinsip utama. Hal ini termasuk dalam argumen hokum yang tidak disepakati. Artikel ini bertujuan untuk mengungkapkan tempat adat dalam hukum Islam dari era Nabi ke era kontemporer, khususnya dalam teori hukum Islam, dalam prinsip-prinsip hukum Islam, dan di pengadilan Islam menurut buku manual. Tulisan ini menyimpulkan bahwa Adat memainkan peran penting dalam menguraikan praktek hukum Islam. Adat telah diakui oleh ulama Islam, terutama oleh orang-orang dari Mazhab Hanafi dan Maliki, sebagai bagian penting dari hukum Islam. Namun, mereka membatasi peran adat dalam hal hukum privat. Kebiasaan ini tidak pernah dibahas dalam hal ritual dan cerita rakyat, seperti yang populer sekarang. Kebiasaan masih bisa memainkan peran penting dalam hukum privat Islam atau bahkan dalam resolusi sengketa alternatif sejauh otoritas tradisional dibutuhkan dan diakui oleh masyarakat Islam.

Abstract

This study employs the assymmetric information in the Indonesian shariah banking. Assymmetricinformation in the banking sector contains: moral hazard, adverse selection. Moral hazard is a situationin which one agent decides on how much risk to take, while another agent bears (parts of) the negativeconsequences of risky choices. The uncertainty surrounding any bank decisions. The market does notget information about the riskiness of a bank. Asymmetric information problems exist in the bank loanmarket. Depositors cannot distinguish the risk, they deposit their funds in those banks that offer thehighest rates and make the most risky investments. Our result points towards regulator to enhancingtransparency may be useful to reduce incentives for excessive assymmetric information of sharia banking.
