Abstract

Islamic law and Islamic banking law are two different entities, although both are substantially identical. This paper seeks to answer the question related to the transformation of Islamic law in Islamic banking law in the context of positivization of law. The study focused on the dialectic of Islamic law and national law in the formulation of Islamic banking law. With a history of regulatory approach, this study found that transformed the Islamic banking law is aspects of shariah compliance, is not Islamic law referred to in fikih muamalah. Sharia compliance is dynamic both in terms of substance, structure and culture.   Hukum Islam dan hukum perbankan syariah merupakan dua entitas yang berbeda, meskipun secara substansial keduanya identik. Makalah ini berupaya menjawab persoalan terkait transformasi hukum Islam dalam hukum perbankan syariah dalam konteks positivisasi hukum. Kajian difokuskan pada dialektika hukum Islam dan hukum nasional dalam formulasi hukum perbankan syariah. Dengan pendekatan sejarah perundang-undangan, kajian ini menemukan bahwa yang ditransformasikan dalam hukum perbankan syariah adalah aspek kepatuhan syariah, bukan hukum Islam sebagaimana dimaksud dalam fikih muamalah. Kepatuhan syariah ini bersifat dinamis baik dari sisi substansi, struktur maupun kultur.

Abstract

The purpose of this article is explain about how to find common ground between Islam and humanrights. Islam and human rights have a common ground in the value equation, freedom, justice andanother fundamental values. However, there are also many differences. Such differences spawned avariety of attitudes among Moslems. Attempt to find common ground more productive than searchingfor a point difference. The writer presented data from the experts within the framework of study thisissue. Such data are presented in other to find common ground of Islam and human rights. Results ofthe study mentions that much more common ground than differences. Point difference is not to beavoided, but reconstructed in the framework of searching for common ground. Through this way,Islam has conformance with the dynamics and development of the times.

Abstract

Cases of violence in Indonesia based on data from the National Commission for Child Protection (KPA), In 2012, reports of violence against children rose to 2,637, with the presentation of 62 percent of the sexual violence include the category of sexual harassment as many as 122 cases, regarded as one indicator of the poor quality of child protection , The existence of children who have not been able to live independently, of course, is in desperate need of people as a shelter. The government has sought legal protection for children, so that children can get a guarantee for the  continuity of life and living as part of human rights through the Act No. 23 of 2002 on Child Protection. The low quality of child protection in Indonesia, especially in sexual offenses and the amount of fines lot of criticism from various circles of society. The changes legislation relating relating to the protection of childrenfrom Law No. 23 of 2002 on the Protection of Children to Act No. 35 of 2014 about the amendment of Law No. 23 of 2002 on Child Protection contains a number of new perspectives (new paradigm) on the protection of children. One of the new paradigm it is the approach of preventing violence against children. In Islamic law approaches in child protection can be understood through the concept dhariah are sometimes prohibited form of preventive measures mentioned sadd al-dhariah, sometimes recommended even obliged called Fath al-dhariah. Methods dhariah in regulation Protection of Indonesian children develop in accordance with the development needs of the community through a new paradigm of Law No. 35 of 2014 on the Amendment of Act No. 23 of 2002 on Child Protection, on several things: the involvement of local governments in addition to the state, the government, society , families and the elderly, sexual crimes against children and restitution  compensation).

Abstract

The Rao community on the border of West Sumatra inhabited by ethnic Minangkabau and ethnicMandailing is a plural society that embraces two kinship systems. The patrilineal, the matrilineal, and theparent. But in the process of their interaction for decades there has been interaction through culturaltolerance in the kinship system. Here the birth of a parental kinship and familial system is the mostdominant character in this multi ethnic Rao region as a new kinship system built in their social interactionprocess for hundreds of years. This system also affects the inheritance division system in theirinteractions. As for the inheritance distribution system, indigenous peoples of the border, especially theRao area, have applied several types of inheritance distribution: First, Rao customary people use the newcustomary law of parental system which combines two customs as the first spear in determininginheritance. Second, they use Islamic law, because the Minangkabau and Mandailing are Moslems, so theyuse Islamic law in the inheritance. Third, they use national law, because if customary law and Islamic lawdo not want to be used then they use national law. These three systems are all intercultural toleranceamid differences in their customary system between Minangkabau adat matrineal system and Mandailingcustom patrineal system.

Abstract

Dalam kajian agama-agama, konsep sedekah merupakan bagian inti yang tidak bisa dilepaskan, khususnya berkaitan dengan transformasi agama sebagai perubahan sosial.Konsep demikian bisa dilihat pada gerakan sedekah lima ratus rupiah di kabupaten Sukabumi.  Gerakan ini dimulai pada tahun 2000 melibatkan banyak pihak meliputi lembaga agama, dan masyarakat luas. digunakan untuk melakukan perubahan sosial, bahkan turut menginisiasi lahirnya kebijakan publik mengenai zakat, infak, dan shodaqoh di Kabupaten Sukabumi. Metode yang digunakan untuk melakukan penelitian ini ialah teori pengalaman keagamaan (pemikiran, tindakan, dan persekutuan) dan teori hegemoni. Dari penelitian tersebut, penulis menganalisis gerakan sedekah lima ratus merupakan bentuk ekspresi pengalaman keagamaan yang diinspirasi dari pemikiran keagamaan nahdlatul (fiqrah nahdliyah dan harakah nahdliyah) dan memiliki dampak sosial yang besar pada perubahan masyarakat..Secara politik, gerakan sedekah lima ratus rupiah ini menggunakan strategi hegemoni, yakni kepemimpinan intelektual dan kepemimpinan moral dari Abdul Basith sebagai pendiri kepada relawan dan pemerintah untuk melancarkan kegiatannya hingga lahirnya lahirnya perubahan social di bidang registrasi peraturn daerah tentang pengelolaan zakat, infaq, dan shodaqoh.

Abstract

In study of Islamic law there is an interesting topic to discuss, that is maqasid al-shari‘ah. Recently some Muslim scholars study further the applying of principle of daruriyat al-khamsah in a legal problem. Unfortunately Islamic jurists often apply the principle of daruriyat al-khamsah independently apart from other sciences besides usul al-fiqh. Difficulties and failure in deciding many contemporary legal problems rise to the result. Jasser Audah, a Muslim scholar from Egypt and lives in London proposes new idea to cope with this problem. According to Audah, at first we must separate maqasid al-shari‘ah from usul alfiqh in order to be independent knowledge. Then we combine it with modern sciences in studying legal problem. Only through this method, Auda believes that Islamic law will be more adaptable with the changing situation. In order to do his idea in developing maqasid al-shari‘ah, Auda specifically suggests five steps, that are: validating all cognitios, holism, openness and self-renewal, multi-dimensionality, and purposefulness.

Abstract

Using panel data analysis, this study investigates the relationship among Islamic bonds (Sukuk) and the performance of IB’s of Pakistan for the period of 2008-2017. The study has used two stages approach. At the first stage, the profitability and liquidity of banks have been measured by calculating financial ratios. These ratios were than further used in regression analysis to examine whether a relationship exists between Sukuk and the bank’s profitability and liquidity. Our study found a significant positive relationship among Sukuk and the liquidity of IB’s. While, the results show significant but negative relationship between Sukuk and profitability of IB’s. Based on the findings of the study, we concluded that Sukuk has an important role in enhancing the liquidity of IB’s but it has adverse impact on the profitability of IB’s of Pakistan. Thus, the emergence of Sukuk market may pose threats to the profitability of the IB’s of Pakistan.

Abstract

Buying and selling foreign currencies (as-Sarf) basically arises because of the need for conversion of one currency to another currency in international trade traffic that will encourage the supply and demand for foreign exchange, which in turn will bring up the sale and purchase of foreign currency in the foreignexchange market. The practice of buying and selling foreign currency according to fiqh mu’amalah is permitted if it is done by an agreement between the two sides and in cash (spot) and it could not be included the addition of a similar item like gold with gold or silver with silver.

Abstract

This article discusses an academic discourse on the origin of Islamic Law by describing third school between two schools existing in this controversial field. By descriptive and comparative method, this article tries to describe how Yasin Dutton views on the beginning of Islamic Law’s construction, and then how he digs his hypothesis against two dominant schools involved in the discussion of the date of Islamic Law birth. Dutton finds that if the Qur’an is the first written formulation of Islam in general, al-Muwatta of Malik is arguably the first written formulation of the Islam-in-practice’ that becomes Islamic law. This way is missing in the first and second school attention. He considers the methods used by Malik in the Muwatta‘ to derive the judgements of the law from the Qur’an is thus concerned on one level with the finer details of Qur’anic interpretation. However, since any discussion of the Qur’an in this context must also include considerations of the other main source of Islamic law, namely the sunna, or normative practice of the Prophet, this latter concept, especially its relationship to the terms of hadith and amal (traditions’ and living tradition’), also receives considerable attention. it is impossible, for Dutton, to find that these two main legitimate sources, textual and practical, will be different and in dispute. This third school wanted to fill the gap between these two schools using different object and argument although in someway meet in same conclusion.

Abstract

Fiqh is often perceived as Islam itself. This is becouse the growth of fiqh involves the integration of followers from different backgrounds, languages, cultures and places where human live. Syeikh Abdurrauf Syah Kuala mentioned that language he used in his books was Jawi Pasai language. Aceh pronunciation and writing were conducted in two language, they were Acehnese language and Malay language, because besides Arabic, both languages are official languages in the kingdom of Aceh Darussalam. So, as the product of thought, fiqh does not admit boundaries of space and time. That’s why, the fiqh would be undergoing a process “to become” change according to needs.
