Abstract

AbstrackAriza Irnanda, The issues of education in Indonesia at this present is very complex exactly, which is from fund of education that is not proportional, to every deliquency as a criminal act juridically. In a simple sense, educational offense refers to every offense that is happened in educational field. Absolutely, it shows that educational field is not free of guilty, as people think it up till now.An educational offense which is being main focus of this research is a offense that is done by teachers in carrying out their task/proffesion. As we know, sometimes, teachers in carrying out their proffesion making acts that is juridically break the law and inflict their student, for example: Give them punishment like hitting, isolating, or suspending, etc as one of disciplinary action to reach out any certainly educational aims. This research used juridical – normative approach. The data which are relevance to this research have been focused to a secondary data mostly through literate study. Then, those are analyzed as descriptive – analysis.There are three results have been concluded from this research. The first, generally, a kind of educational offense and classification of a criminal act that is done by teacher in carrying out their task. The second, what is  the pupose of government in drafting UU Nomor 23 Tahun 2002 about A Children Protection. Both is used to control 2 (two) kind of criminal act that teachers do in carrying out their task, it called: a pure criminal act and criminal act as reflection of disciplinary action. The third, what the role of government in dealing with criminal offenses. In criminal act, those acts have been focused to “Tuchtrech” as a justified reason. In the case of criminal responsibility, for humanity and justice, is reccomended Judge’s effort to forgive teacher’s fault which is called “rechterlijkpardon”. A criminal sanction. Based on flexibility and modification idea, a type of sanction is pointed to double track system, that is : treatment and sentence. Beside that, it’s reccommeded a possibility to lighten or make heavier sanction for a specially and rationally reasons.

ABSTRACTIONThe Significance of Witness Statement for Traffic Accident Investigation in Kutai Timur Police DepartmentWitness is a person who can give testimony which may be useful in an investigation or a case being heard in a Court about their firsthand account of something seen, heard, or experienced. However, a witness has a right to remain silent or their testimony would not to be considered based on KUHAP article 168.Investigation process plays a focal point to help determining the sequence and conclusion of traffic accident in Kutai Timur police department. The witness testimony or statement is a crucial part of the case, effectively helping investigator to close the case.Key Word: Witness, Witness Statement, Investigation, Traffic Accident

Abstract

ABSTRACTMarriages use administrative requirements counterfeit can be ratified by the court or in the term renewal of marriage, if the marriage has been performed according to religious requirements (valid according to religion) and that marriage has lasted a long time or they have to live like husband and wife, and they can show a deed registration of marriage made by an employee who is not authorized. Applicability of Marriage Law No. 1 of 1974 and its implementing regulations effectively in the community has been able to be accepted and implemented from October 1, 1975. Technically it is not a lot of obstacles, but if we look at their marriage cases that use a fake marriage certificate or requirements administrative false it is clear that the public has not implement government regulation of marriage and responsibility.

Abstract

  ABSTRAK Penelitian ini bertujuan untuk mengetahui faktor yang menyebabkan anak melakukan tindak pidana pencurian di Kota Samarinda dan untuk mengetahui sejauhmana implementasi Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak dalam memberikan perlindungan hukum terhadap anak sebagai pelaku tindak pidana guna menyelesaikan perkara pencurian yang dilakukan oleh anak. Penelitian ini dilakukan dengan pendekatan yuridis sosiologis yang mengkaji peraturan perundang-undangan dan melihat kenyataan yang ada dilihat dari prespektif penerapan hukum.Berdasarkan hasil penelitian yang telah dilakukan, ditemukan faktor-faktor yang menjadi alasan anak melakukan tindak pidana pencurian khususnya di Kota Samarinda, diantaranya ; 1) Faktor Ekonomi, dimana masyarakat yang memiliki keadaan ekonomi yang rendah tidak dapat memenuhi kebutuhan dan keinginan anak, sehingga anak berusaha untuk memenuhi kebutuhan dan keinginannya dengan cara melawan hukum. 2) Faktor Lingungan, keadaan lingkungan tempat tinggal, lingkungan pergaulan anak yang kurang baik menentukan bagaimana mental dan karakter anak, juga perilaku anak. 3) Faktor pendidikan, kurangnya pendidikan yang diperoleh anak juga mempengaruhi terbentuknya mental dan karakter anak, baik itu pendidikan yang diperoleh dari keluarga maupun yang didapat dari sekolah. Ketiga faktor tersebut menjadikan anak berani bertindak sesuatu tanpa memikirkan resiko dari perbuatannya. Implementasi perlindungan hukum terhadap anak yang melakukan tindak pidana dalam Undang-Undang Nomor 11 Tahun 2012, memberikan jaminan perlindungan hak-hak anak dilihat dari aturan-aturan yang terkandung didalamnya sehingga dalam menyelesaikan perkara anak, anak tetap dapat bertumbuh dan berkembang secara optimal tanpa harus kehilangan hak-haknya. Khususnya penerapan diversi yang merupakan bagian dalam mencapai keadilan restoratif menjadi upaya yang diutamakan dalam menyelesaikan perkara pidana yang dilakukan oleh anak. Kata Kunci : Hukum Perlindungan Anak, Undang- Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak, Diversi.

Abstract

Abstract Land has a very important role, that is to say in the Indonesian life or in the implementation of national development which was held as a continuing effort to realize a just and prosperous society based on Pancasila and the Constitution of 1945. Therefore, the setting of control, ownership and use of land needs to be more directed for further ensuring the orderly in the field of land law, land administration, land use, or maintenance of the land and the environment, so the lack of legal certainty in the land sector.Broking implementation of changes on land for residential becoming Property at the Land Office Samarinda by Minister of State for Agrarian Affairs / Head of National Land Agency Number 5 of 1998, concerning changes Broking or right to use of land for housing.Samarinda Land Office should conduct dissemination and outreach to the community in the district as well as in the interior of the change Broking into Rights Owned because besides giving legal certainty to holding the titles concerned also for the interests of the Land Office, which is an implementation Government policies in giving certainty of continuity the right to land for individual houses for Residents Indonesian country.

ABSTRACTSet of problem protection of women energy is one of problem which faced oftentimes if we talk about women energy in indonesian in habitual action much of women which have to work fulfill their life necessity. The action of program safety and health job for importance worker include all of aspect such as include the action right fondation worker, the action of health and safety this case arranged in law number 13 at 2003 about matters pertaining section 86 which the contents arrange about rights worker of law in knowledge section 76 verse 4 of law number 13 at 2003, cabinet of work energy and transmigrant number KEP.224/MEN/2003 about transportation take up and pick up for women worker which have job on night.Transportation which much given by industrialist to women energy which have job on night should to have collateral safety women which have job at enterprise when they have to have shift night and there is transportation facility which take up them to go home until their at home. Institute goverment which handle matters pertaining need to do applicate of law related with health and safety work especially about take up and pick up to women worker which have job on night need to enhance enymore.

Abstract

ABTSRAK Apoteker sebagai pemilik sarana apotek merupakan pelaku usaha bisnis, berdasarkan kode etik bisnis dimana pelaku usaha bertanggung jawab atas berjalannya usaha tersebut. Maka keuntungan menjadi tolak ukur bagi pelaku usaha. Hal tersebut bertentangan dengan kode etik profesinya, sebagaimana diatur dalam pasal 4 dimana dalam melakukan pekerjaan kefarmasian seorang farmasis hendaknya tidak dipengaruhi oleh pertimbangan keuntungan pribadi yang mengakibatkan hilangnya kebebasan profesi. Jadi hal keuntungan sebagai suatu hal dalam berbisnis tidak ada dalam kode etik profesi apoteker, ketentuan tersebut berdasarkan sumpah atau janji apoteker, yaitu saya akan menjalankan tugas saya dengan sebaik-baiknya sesuai dengan martabat dan tradisi luhur jabatan kefarmasian.Segala pengoperasian sebuah apotek harus berdasarkan peraturan perundang-undangan yang berlaku. Perundang-undangan yang penting mengenai apotek adalah PP No. 26 Tahun 1965 yang kemudian diubah dengan PP No. 25 Tahun 1980. Kedua PP tersebut melaksanakan UU No. 7 Tahun 1963 tentang Farmasi. Apabila PP  No. 25 Tahun 1980 ditelaah secara seksama, maka apotek merupakan tempat dilakukan pekerjaan kefarmasian dan penyaluran obat kepada masyarakat yang dapat diusahakan oleh apoteker itu sendiri. Dan dalam Peraturan Menteri Kesehatan No. 922/MENKES/PER/X/1993 tentang Ketentuan dan Tata Cara Pemberian Izin Apotek pada pasal 2 yang menerangkan bahwa seorang apoteker sebelum melaksanakan kegiatan pengelolaan apotek, hanya diberikan kepada seorang apoteker yang nantinya harus bertanggung jawab secara teknis farmasis. Berdasarkan peraturan yang berlaku izin apotek diberikan oleh Menteri kepada seorang yang memiliki keahlian dalam bidang farmasi yaitu apoteker. Dengan adanya pelaksanaan dan penerapan UU Perlindungan Konsumen dalam bidang ini menimbulkan beberapa aspek pelanggaran yang terjadi dalam beberapa kasus. Kasus tersebut ditinjau dari aspek seperti : Aspek fungsional, hal-hal yang dapat menimbulkan keluhan sampai protes konsumen dapat terjadi mulai dari pengadaan, penyimpanan, peracikan maupun penyerahan; Aspek Penyalahgunaan, sering kali terjadi penyalahgunaan ini dilakukan sengaja oleh konsumen.

Abstract

AbstrakUntuk mendapatkan akta kelahiran bagi golongan pribumi, dimana untuk memperoleh akta kelahiran umum masa pelaporan 60 hari  (2 bulan) harus disampaikan pada kantor catatan sipil manakala dalam pelaporan tersebut, sehingga yang tadinya terlambat dalam pelaporannya dilaksanakan melalui sidang Pengadilan Negeri. Setelah adanya SK Menteri Dalam Negeri tanggal 14 Oktober 2012 Nomor. 474 – 785, terdapat lagi suatu cara untuk mendapatkan akta kelahiran dengan istilah akta kelahiran istimewa yaitu akta kelahiran yang diperoleh setelah lewat batas waktu pelaporannya peristiwa kelahiran tersebut.Kegunaan dari pada akta kelahiran sangat besar sekali baik bagi masyarakat maupun bagi penyelenggaraan pemerintahan. Berguna bagi masyarakat karena akta kelahiran akan mempermudah dalam menyelesaikan masalah yang ada hubungannya dengan akta kelahiran. Berguna bagi penyelenggaraan pemerintahan karena secara tidak langsung pihak yang memiliki akta kelahiran telah melaksanakan sebagian dari ketentuan hukum yang ada dinegara kita.

Abstract

ABSTRACTGranting parole to prisoners is the last link of the effort to foster inmte in the correctional system. By means of parole, inmates can improve communication with the public at large, to rediscover her dignity as a human being and existence as a member of society. In the implementation of this should be considered conditional or based on the principles of correctional, one of which stated that during the loss of freedom of movement, inmates must be introduced to the public and may not be exiled from it. By paying attention to one of these principles, it is expected that the implementation of parole as one means to foster inmate in the correctional system is based on achieving goals and objectives. Factors that are inhibitors or hindrance to the implementation of conditional release are as follows: inmates in question still has another case that has not been decided by the courts; inmates concerned has not received a remission or reduction law, inmates are recidivists; inmates concerned during fostered in institutions correctional offenses; criminal inmates who underwent less than one year. Prison officials did want that parole should be increased, but inmates often commit violations while in prison, so that the administrative requirements do not support the proposed inmate to obtain parole. Sometimes the decline in letter parole decision is too late and in case of this sort, the inmates themselves will be confused, while the officer has been tried as much as possible, it could be officers penitentiary inmates feel that complicates the degree. From society’s parole also sometimes get obstacles that make inmates often feel less acceptable, for example, the victim’s family is still resentment against inmates is concerned and there is a presumption of society that these prisoners after coming out and getting parole may disrupt order and security in neighborhood.

Abstract

ABSTRACTViolence in the home (KDRT) is a problem for all time, especially in today hampis any print media or electronic media mencerikatan violence in the household, such as beatings husband against wife, obscene acts / rape father or uncle or another relative of the child or nephew or other family relatives. Violence in the home (domestic violence) against the wife by her husband himself not only in the form of violence in the form of physical violence alone, but also an act which resulted in misery or suffering economic, sexual, psychological, and also includes acts do pemaksan or deprivation of liberty against law within the domestic sphere.The method used is the method of normative legal research and sociological research methods. In terms of normative legal research, the author conducted with environmental legislation and legal materials related to the title of the thesis, whereas in the case of legal research sociological writer doing research on how the effectiveness of the legal instruments in force and give legal protection against domestic violence childWith the enactment of Law No. 23 of 2004, it is expected that law enforcement against violence by husbands against wives can walk up. By doing penaggulangan in penal and non-penal. So that obstacles to the completion of the violence perpetrated by husbands against wives can be tackled.Expected legal protection for victims of domestic violence is the responsibility of all components of the nation. The legal protection is not just setting the criminal sanctions to the perpetrators, but also set about the process of the lawsuit (legal formal / event), compensation, recovery and security of the victims who had been set out in Regulation Indonesian legislation such as the Criminal Code, Act No. 35 of 2014 on the Amendment of Act No. 22 of 2002 on protection of Children and the Law No. 23 on the Elimination of violence housekeeping aiming to prevent all forms of domestic violence and provide legal protection for victims of domestic violence.Said Kuci: Domestic violence
