Abstract

According to Article 24C of the Constitution of 1945, especially the decisionof the Court judgment in the judicial review of Law is final and binding. But howif the rule of law is also unconstitutional by the Constitutional Court decisionrevived in the laws changed but still set the same thing by the legislator as Article12 letter g and Article 51 paragraph (1) letter g of Law Number 8 of 2012.Interestingly, when issuance Court decision number 42/PUU-XIII/2015 testarticle 7 letter g of Law Number 8 of 2015 which sounds identical to the norm ofarticle unconstitutional it, and startling in the verdict of the Constitutional Courtstates grant the petition for partially unconstitutional conditional as the ruling ofthe Constitutional Court ruling Number 4/PUU-VII/2009. Then how about thenorm clause that contained in Law Number 8 of 2012, is constitutional orunconstitutional, ever tested to the Court but the Court rejected it by its DecisionNumber 79/PUU-X/2012.The results of this study is that Article 12 letter g and Article 51 paragraph(1) letter g of Law Number 8 of 2012 is unconstitutional and the legalimplications after the Constitutional Court Decision Number 4/PUU-VII/2009,the Constitutional Court Decision Number 79/PUU-X/2012, and theConstitutional Court Decision Number 42/PUU-XIII/2015 is a legal ambiguitypolitical rights of former prisoners, the loss of mutatis mutandis ConstitutionalCourt ruling, does not contain provisions by ne bis in idem, and invalidates theerga omnes nature of the Constitutional Court. Abstract

Legal aid is the human rights of every person, who is not given by the state as the mercy of the state. The grant of legal aid is expected to be fair legal process for suspects or defendants who are poor and provide an opportunity to defend themselves with legal counsel. Guarantees of legal aid contained in Article 54 of the Criminal Procedure Code, which states, in the interests of defense, the suspect or the accused is entitled to legal assistance of one or more legal counsel during the time and at every level of examination, according to the procedures specified in this law. In addition, article 56 paragraph (1) Criminal Procedure Code that, in the case of a suspect or a defendant suspected of or charged with a criminal offense punishable by the death penalty or a penalty of fifteen years or more or for those who can not afford is punishable by five years or more who do not have their own legal counsel, the concerned officials at all levels of checks in the proceedings shall appoint counsel for them.The purpose of writing this thesis: First, to determine the legal consequences or effects when a suspect / defendant who deal with the law is not accompanied by legal counsel under the provisions of article 56 of the Criminal Procedure Code. Second, to determine the responsibility of the relevant authorities at every level of examination in providing legal assistance to the suspect / defendant against the law. normative research or the research literature, the type of research conducted by examining secondary law or research based on the standard rules that have been reflected and focused to study the principles of law, by searching various regulations in connection with the provision of legal assistance to suspects /defendant.From this study we can conclude: First, help law are rights of suspects or defendants in the interests of defense, guarantees protection and legal certainty and justice and equal treatment before the law that must be obtained from the level of inquiry, investigation, prosecution, trial and enforcement of the award. The legal consequences disregard for the rights of suspects / defendants get legal aid is null and void. Second, granting legal aid to the suspect / defendant an obligation concerned officials at every level of examination. Third, Indonesia adheres to regulations written law (Legal Positivism), where jurisprudence is not a necessity for the judge to obey. Suggestions Writer, implementation of legal assistance to the suspect / accused should be given at every level of examination is requested or not in order to attain justice and equality before the law.Keywords: Provision - Legal Aid - suspect - defendant

Abstract

Treatment of prisoners is one of a series of process development and implementation of the penal system will be done in the crease / Branch detention houses, prisons / Branch prisons carried out by prison officers against detainees or prisoners. Based on this understanding, the authors formulate three formulation of the problem, namely: First, How is the implementation of Government Regulation No. 58 of the prisoners or detainees in Penitentiary Class II A Pekanbaru. Secondly, What are the barriers that occur in the implementation of Government Regulation No. 58 in Penitentiary Class II A Pekanbaru. Third, Are efforts made to overcome barriers to the implementation of Government Regulation No. 58 in Penitentiary Class II A Pekanbaru.This type of research can be classified into types sosilogis juridical research, because this research author directly conduct research on the location or point examined in order to provide a complete and clear picture of the problems to be studied. This research was conducted at the Penitentiary Class II A Pekanbaru, while the sample population is a whole party with regard to the issues examined in this study, the data source used, primary data, secondary data, and the data tertiary, technical data collection in this study by questionnaire, interview and literature study then analyzed qualitatively and process data and generate descriptive data and then infer deductivelyFrom the research there are three main issues which can be summarized as follows: First, the implementation of Government Regulation No. 58 of the prisoners or detainees in Penitentiary Class II A Pekanbaru has not been maximized because there are still many shortcomings of infrastructure. Second, barriers that occur in the implementation of Government Regulation No. 58 in Penitentiary Class II A Pekanbaru disebebkan lack of operational cost factors, lack of personnel or skill factor, Penitentiary Class II A Pekanbaru is over capacity. Third, efforts are being made to overcome the barriers to the implementation of Government Regulation No. 58 in Penitentiary Class II A Pekanbaru first to provide budget funding and operational costs are pretty and well in the implementation of treatment for any prisoners, personnel or officers Penitentiary Class II A Pekanbaru must have the appropriate skills and education to be able to nurture and care for prisoners to achieve the goal of treatment of prisoners, Penitentiary Class II A Pekanbaru to be renovated in order to avoid over-capacity by increasing the number of rooms to accommodate inmates who so much.Keywords: Implementation - maintenance - custody

Abstract

In the protection of human rights, children are also included. A child is a person who is not yet 18 (eighteen) including a child still in the womb. Talking about the child, not apart from the mischief done by the child or in the Child Protection Act is also called Children in Conflict with the Law. In Indonesia there is an independent State institution whose function is to protect and improve the welfare of children, the institution is the Indonesian Child Protection Institution, while for the province of Riau is the Child Protection Agency of Riau Province. Based on data obtained from the Riau LPA on the issue of legal protection of children in conflict with the law in Pekanbaru City, many cases of children in conflict with unlawful laws in the LPA and the case of children who sexually harassed former sexual victim. The purpose of writing this thesis, namely First, To know Implementation of Legal Protection by Child Protection Agency of Riau Province to children in conflict with the Law in Pekanbaru City Region, Second, To know the obstacles encountered from the Implementation of Legal Protection by the Child Protection Agency of Riau Province to children In conflict with the law in Pekanbaru City Area, Third to know the efforts made to overcome obstacles from the implementation of legal protection by child protection agencies of Riau Province against children in conflict with the law in Pekanbaru City Area.This type of research can be classified in the type of sociological juridical research, because in this study the authors directly conduct research on the location or place studied to provide a complete and clear picture of the problem under study, while the data collection techniques in this study conducted by interviews, literatureFrom the results of research problems there are two main things that can be concluded. Firstly, the implementation of legal protection conducted by LPA Riau on children in conflict with the law in Pekanbaru City Area is in the form of penal and non penal efforts such as monitoring and accompanying children while taking the court, monitoring and assisting children in the recovery process both psychologically and socially By a psychologist. Second, the obstacles faced by LPA Riau from the implementation of legal protection by LPA Riau against Children in Conflict with the Law there are 2 (two) factors are internal factors and external factors. Suggestion Writer, First, In providing legal protection LPA Province of Riau is expected to continue to maximize preventive effort and effort of repressive that right. Abstract

On the implementation of operations, capital investment companies are required to do a CSR or corporate social responsibility which in Pasal 74 ayat (1) Undang-Undang Perseroan Terbatas, Pasal 15 huruf (b) Undang-Undang Penanaman Modal, dan Pasal 1 angka 20 Peraturan Menteri Pertanian Nomor 98/Permentan/OT.140/9/2013 tentang Pedoman Izin Usaha Pertanian. In realizing the CSR company, PT. Jatim Jaya Perkasa plasma plantations into an agreement with KUD Bagan Siapi-Api. Initially the agreement done well, but the last few years PT. Jatim Jaya Perkasa reneged on the agreement or tort precisely Article 10 of the agreement. Based on these authors are interested in doing research with the title Responsibility PT. With the sample population probalitity sampling techniques to obtain the desired results.The study was conducted at the office of KUD Bagan Siapi-Api in sub Kecamatan Kubu Bagan Siapi-Api Kabupaten Rokan Hilir, Kepenghuluan Teluk Nilap, egghead society Kubu and in the office of PT. Jatim Jaya Perkasa is located at Jalan Arifin Ahmad Pekanbaru 9. The study period from September 2015 until April, 2016.The result of this research is PT. Jatim Jaya Perkasa too many negotiations for the implementation of CSR and liabilities on the contents of the agreement when it was described in detail on the contents of the agreement. Furthermore, PT. Jatim Jaya Perkasa did indemnity payments unpaid plasma during the applicable agreements and prosecution to DRPD Rohil in order to take action against PT. Abstract

The portrait is one of the works protected by copyright legislation, namely Act (UU) No. 28 of 2014 about copyright. However in practice often happens to violations of copyright or portrait photography is the property of a person or the copyright holder, which is called model or artist management taken by the perpetrator of the offence without the written consent of the copyright holder. Problems that arise now is how legal protection over the portrait. This research includes types of sociological research, which is research by examining its legal aspects to look at legislation and comparing with the implementation on the ground gained by way of surveys. Analysis of the research material in this thesis using qualitative methods, in order to draw conclusions by using deductive methods.Then from the results showed that the entire creation works of photography or portrait produced by Act (UU) No. 28 of 2014 about copyright, all concern parties can prove that his work is his creation, which can be proven by way of registering creations or in any way in accordance with the laws and regulations that govern it. And in the completion of the portrait is a file a lawsuit as compensation demands to the Court of Commerce and in the implementation of the rules of criminal law can be made by an authorized investigator, but most of the management model of resolving the problem of infringement of his work with the line of non litigation (other than the Court) or in a family.Key Words: Copyright protection - Portrait - Taking illegally

Abstract

The conception of a State of law adopted by the State of Indonesia implies a written regulation in which the administration is based on the constitutional rule of the 1945 Constitution of the State of the Republic of Indonesia. In Local Regulation No. 10/2000 it is clearly regulated on business licenses and the extension of restaurant permits. Based on the findings that have been obtained by the authors in this study are still many restaurants in the jurisdiction of Pekanbaru city who run his restaurant business without permission and / or permit that has expired. Regional Regulation Number 10 Year 2000 concerning Restaurant Business, business license and extension of restaurant business permit have contained criminal sanction against restaurant without legal permit contained in Article 19 that can be threatened Penitentiary for 6 months or maximum penalty of five Million rupiah. In the area of Pekanbaru City itself there are many restaurants that do not have a valid permit, but still run their restaurant business activities. Based on the above chronology, according to the authors it is important to raise the research with the title of research "Application of Criminal Sanctions Against Unlicensed Restaurant Business Based on Local Regulation of Pekanbaru City Number 10 Year. This type of research is empirical research, another term used is sociological legal research also called field research. This sociological law research is based on primary data. Primary data / basic data is data that can be directly from the community as the first source through through field research. Based on the results of the study authors concluded that the implementation of the criminal provisions are still not well implemented, criminal accountability was not there. Abstract

The regional growth is a process of solving the region, from a region of the province, district or city to more than one region, then in Act No. 23 of 2014 made clear that the regional growth not only be interpreted as the formation of new regions but may include merging some districts / cities different. Expansion of the territory which was then referred to as the formation of new regions is the division of administrative authority that is accompanied by a delegation of the financing, the division of an area along the natural resources contained therein and the number of residents, Post-New Order shows that decentralization should be a means to maintain the Unitary Republic of Indonesia ( NKRI). Abstract

Kabupaten Siak banyak menyerap tenaga kerja dan konsekwensinya juga banyak terjadi permasalahan ketenagakerjaan atau yang sering disebut dengan perselisihan hubungan industrial. Salah satu yang terjadi di Kabupaten Siak adalah kasus perselisihan pemutusan hubungan kerja secara sepihak yang dialami seorang karyawan yaitu Poster Sijintak. Permasalahannya, Poster Sijintak dipecat sebagai pengawas lapangan pengangkutan kayu oleh PT. Jarsindo Karya Utama, karena pekerja dinilai oleh pengusaha tidak mampu menunjukkan kinerja/prestasi yang baik, disamping itu atas pertimbangan perusahaan tidak secara kontinu mendapatkan/order kerja pengangkutan kayu dari pengusaha pemberi/penyedia kerja PT.IKKP Perawang. Penyelesaian kasus tersebut di tempauh melalui jalur konsilidasi. Tujuan penulisan skripsi ini untuk mengetahui penyelesaian perselisihan tenaga kerja melalui konsiliasi Pada PT. Jarsindo Karya Utama di Kabupaten Siak dan untuk mengetahui hambatan yang dihadapi dalam penyelesaian perselisihan tenaga kerja melalui konsiliasi pada PT. Jarsindo Karya Utama di Kabupaten Siak. Jenis penelitian ini adalah yuridis sosiologis karena dalam penelitian ini penulis langsung mengadakan penelitian pada lokasi atau tempat yang diteliti guna memperoleh gambaran secara lengkap tentang masalah yang diteliti. Penelitian ini dilakukan di Kabupaten Siak, tepatnya pada Kantor Dinas Sosial dan Tenaga Kerja Kabupaten Siak. Populasi pada penelitian ini adalah seluruh pihak yang terkait dengan penyelesaian tenaga kerja melalui konsiliasi pada PT. Jarsindo Karya Utama di Kabupaten Siak, yakni konsiliator, serta pekerja dan para pengusaha yang menyelesaikan perselisihan hubungan industrial melalui perantaraan Konsiliator di Kabupaten Siak dengan teknik penarikan sampel secara sensus. Sumber data yang digunakan data primer, data sekunder, dan data tersier teknik pengumpulan data dalam penelitian ini adalah wawancara dan dokumentasi. Dari hasil penelitian dapat disimpulkan, penyelesaian Perselisihan Tenaga Kerja Melalui Konsiliasi Pada PT. Jarsindo Karya Utama di Kabupaten Siak telah dilaksanakan dengan baik sesuai dengan Undang-Undang Nomor 2 Tahun 2004 Tentang Tentang Penyelesaian dan sudah diterapkan secara baik oleh konsiliator. Hambatan yang dihadapi dalam penyelesaian perselisihan tenaga kerja melalui konsiliasi pada PT. Jarsindo Karya Utama di Kabupaten Siak yaitu belum ditetapkannya keputusan menteri mengenai besarnya biaya transportasi dan akomodasi saksi-saksi, belum adanya petugas khusus untuk mengirimkan surat panggilan kepada para pihak, belum ditetapkannya keputusan direktur jenderal mengenai bentuk dan isi risalah, laporan, serta tata cara pelaporan, sarana prasarana tidak memadai dan pihak yang berselisih kurang responsif yaitu tidak menghadiri panggilan sidang konsiliasi.Kata Kunci: Perselisihan Tenaga Kerja, Konsiliasi

Abstract

Legal protection for borrowers against rental rates of capital (interest on payable busines,to high interest that there are restrictions on determining interest based on jurisprudene No. 12 / Pdt-G / 2016 / PN Blk in the jurisprudence provides restrictions on achieving asense of security and Justice so as to avoid the practice of usury, and not to abuse the tate of the debtor when borrowing money. What is meant by the protection of the law is a provision of assurance or certainty that a person will get what has become the rights and obligations, so that the person feels safe Based on the above The objectives of thesis writing are: firstly, to know how the legal protection is like the debtor to the rental rate of capital (interest) on the pawnshop business Secondly, to know the factors that make difficulty of setting the rental rate of capital (interest) on the business of pawn in the city of Pekanbaru.This type of research can be classified as a type of sociological law research. This research is descriptive, a research that describes clearly and detailed about legal protection for debtors to the rental rate of capital (interest) on the business of pawnshop in the city of Pekanbaru. Sources of data used are primary data and secondary data consisting of primary legal materials, secondary law materials and tertiary legal materials, data collection techniques in this study with interviews, questionnaires, observation and literature review, after the data collected and then analyzed to be drawn conclusions .From the results of research and discussion it can be concluded first that, Based on jurisprudence No. 12 / Pdt.G / 2016 / PN Blk states that in Article 1767 The Second Criminal Code allows an agreement to determine interest in excess of the law At that time determined at 6% per year according to the Panel of Judges for the principle of justice, the principle of propriety and public order then the determination of the amount of interest should be a guide even for individuals who run the practice of borrowing money with interest in order not to support the practice of usury in society that can abuse the state of society Which is squeezed in need of money.Keywords: Legal Protection - Debtor - Interest - Pawn
