Abstract

The local elections is a form of political participation of the people in a democracy, the cleanliness , honesty and fairness implementation of the local elections will reflect the quality of democracy in the countries concerned . In order to preserve the purity of prospective head region that is essential for democracy .The problem in this thesis is the completion of the crime of destruction of props during the provincial election campaign Dumai city in 2015 by Law No. 8 of 2015 on the election of governors, regents and mayors? Barriers to what was found by law enforcement agencies in solving the crime of destruction of props during the provincial election campaign Dumai city in 2015 by Law No. 8 of 2015 on the election of governors, regents and mayors? as for the purpose of this study was to determine how to resolve the crime of destruction of props campaign in local elections Dumai 2015 by Law No. 8 of 2015 on the election of governors, regents and mayors, to know what barriers found by law enforcement officers in completing the crime of destruction of props during the provincial election campaign Dumai city in 2015 by Law No. 8 of 2015 on the election of governors, regents and mayors.This type of research can be classified as socio-juridical , because in this study the authors directly conduct research on the locations or places studied in order to give a complete and clear picture of the problems studied . The research location KPU Kota Dumai and Dumai City Police Resort . This data collection techniques with interviews and a literature review .Based on the results of research show that in the completion of the crime of destruction of props during the provincial election campaign Dumai 2015 , did not run in accordance with the applicable rules because there are no obstacles in its implementation . Barriers is: their limitations very short time that is later than 7 days after the destruction of props campaign , and limited personnel owned by Panwaslu , the ability to conduct an investigation at all that is not owned by a member of the Election Supervisory Committee , as well as the Commission does not have the authority to do search and seizure .Keywords : Settlement - Crime - Campaign Viewer Tool - Regional Head

Abstract

National Constitution Number 23 on 2014 about Regional Government mandated that the implementation of government affairs in energy and mineral resources are divided between the central government and the provinces. Including the authority to issu the permits for mineral and coal. Before the enactment of National Constitution Number 23 on 2014 about Regional Government, the mining permit issuing authority is divided between the government, the provincial government, and local government of district/city. Now all authority to issue the permits that were previously owned by the district/city, is now owned by the provinces.This raises the pros and cons in the community. Some of them agree that the authority to issue the mining permits that were previously owned by the distric/city is now transferred to the provinces, and there are others that doesn’t agree, and there are also some of them asking that such authority to be returned to the district/city.Key Words: Authority – Autonomy – Mining Permit

Abstract

Corruption comes from the Latin "coruptio" or "corrutus", further stated that coruptio it comes from a Latin word corrumpere older. According to European languages such as English, the term corruption is: corruption, corrup. France: corruption. And in Dutch: corruptie. Indonesian in the meaning of the word corruption is decay, depravity, dishonesty, incorruptible, immoral, and deviations from purity. Corruption is a major impact on State finances and the morale of the nation Indonesia in handling must be in accordance with the provisions applicable, which law enforcement must provide a deterrent effect against perpetrators of corruption, so that corruption in Indonesia can be prevented in the sentencing judges should not view feathers, class or race, whoever does corruption laws must be enforced according to the rules and fairness.In Act No. 30 of 2002 said that the Corruption Eradication Commission is to act as a Trigger Mechanism. As the trigger and empowering existing institutions in combating corruption. For effective implementation of this role, the KPK also given the task of enforcement with no need to unplug isntitusi law enforcement agencies such as the police and prosecution. But unlike the Corruption Eradication Commission, the performance of eradication of corruption committed by the Police and the Attorney General can not because it has the maximum number of obstacles.Specifications KPK task is to coordinate and supervise. Especially for the coordination task in fighting corruption can be interpreted that the KPK is the coordinator in the fight against corruption.The weakness of the Commission for this is a limitation of the Human Resources (HR) in preventing and combating corruption, because given the vast territory of Indonesia. The negative impact is going to shrink and eliminate the existence of the role of Police and Prosecutors in combating corruption carried out by the three institutions, including the Corruption Eradication Commission, the Police and the Prosecutor. These three agencies should ideally mutual support and synergy in combating corruption. When this happens, the role of the KPK as an institution triggers and empowering existing institutions in combating corruption (trigger mechanism), is considered not working as it should, because the KPK as an institution coordinator should not be memmonopoli handling of corruption, it is described in Act No. 30 of 2002 on the Corruption Eradication Commission.Key Word : Corruption – Trigger Mechanism – KPK – Human Resources

Abstract

Financial institutions have a role as a financial intermediary (financial intermeditary) which as an institution conducting fund raising from the public in the form of savings and channel them to the public in the form of credit or financing. The continued development of financial institutions increasingly widespread criminal offenses against the financial institutions. Including in Riau, a growing number of criminal acts is also banking on Riau. Investigation process of banking criminal acts in Riau region still faces many obstacles, it is seen from the cases that terminated or are still in the process of investigation. This is certainly an obstacle in the process of investigation of cases that occurred around the time that will come. Crime in banking criminal acts are often exposed for their reports information provided by the parties. Therefore it is necessary the interrogation of criminal offenses banking efisisen by Riau Police. Abstract

Among the law enforcement officers who also have an important role in the existence of cases of narcotics are Investigators, where investigators are expected to assist the settlement of cases of violations of narcotics crime. The purpose of this thesis writing are: First, the arrangement of the investigation of criminal narcotics in the book of criminal procedural law and narcotics laws, Second, the interest of the national narcotics agency in conducting investigations in the narcotics crime seen from the Criminal Procedure Code and Narcotics laws, Third, the ideal arrangement of the investigation of narcotic criminal acts in the criminal procedure code and narcotic laws.This research is done by using normative approach that is law principles. The type of data used in this study is to use secondary data that is the primary legal material (the 1945 Constitution, the Book of Criminal Procedure), secondary law materials (books related to the research result of the arrangement of the investigation of narcotic criminal acts Based on criminal procedural law and narcotic law), and tertiary law materials (Dictionary of Bahasa Indonesia), data collection techniques using the deductive method is a way of drawing conclusions from general to specific theorems.From the results of research there are three main issues that can be concluded. First, the arrangement of the investigation is done in accordance with the rules (Criminal Procedure Code and Narcotics Act); Secondly, the interest of the national narcotics body in conducting the investigation is: indeed indispensable in conducting narcotics investigation, coupled with the input to make troops Strike force for the prevention and control of narcotics crime, Third, the ideal arrangement of narcotics criminal investigation is: that there is no need for any police investigator who sits as an investigator in the National Narcotics Board because the police investigator has been a sole investigator for all crimes whose authority Not provided by the Narcotics Act. The writer's suggestion, Firstly, there needs to be a bigger budget increase for the process of investigation of narcotics crime, Secondly, for the investigators themselves, to get information about this crime is often done communication and socialization with the community, Third, And provide security guarantees to the public that inform the officer.Keywords: Arrangement-Narcotics-Investigation

Abstract

State shall recognize and respect the customary law community unit along with the rights traditional all still alive and in accordance with the development and principles of the Unitary Republic of Indonesia, as mandated in the Constitution of 1945. However, its implementation in the field lead to conflicts in the determination of forest areas by the central government unilaterally without the involvement of regional governments and local Indigenous stakeholders. Customary land rights of indigenous people's been inhabited for generations before the formation of the Unitary Republic of Indonesia, not necessarily become a forest area designated the Central Government through the Ministry of Environment and Forestry.On the basis of these problems the author interested in conducting research in the village of Kampar Regency Balung research objectives: a) To know the process of establishing a forest area by Central Government: b) To determine the existence of customary rights and traditional values Balung Village Community; c) To know the efforts Kampar District Government and Stakeholder Desa Adat Balung in freeing the traditional communal land from forest areas. This study is sociological, with descriptive qualitative approach, using methods of data collection: documentation, interviews, observation. Determination of respondents using probability sampling methods with interactive data analysis techniques (Huberman and Miles).The conclusion of the study: a) Determination of forest areas in Riau Province including the forest area in the village of Balung without reviewing directly to the site without involving regional and local government and community Kampar customary law; b) The existence of indigenous peoples and indigenous land rights Balung village is alive, growing and is still revered by members of indigenous communities Balung village; c)There are no Government's efforts Kampar and Nenek Mamak Stakeholder Indigenous Village Balung,and LAK(Lembaga Adat Kampar),NGOs (nongovernmental organizations) to propose changes in the forest area of the rights of indigenous land Desa Balung who entered the forest area defined by Central government. Suggestions results of research: a) required a serious effort on the government Kampar revise regional regulations exist which provide reinforcement where the rights of customary rights of indigenous peoples; b) the Central Government in setting forest area demanded from the field see the real conditions of existence of society and society customary law and Nenek Mamak involving Indigenous Stakeholders; c) Indigenous and Tribal Peoples have the right to sue the government to defend the rights of indigenous land.Keywords: Forest Zone, Indigenous Peoples, Land Rights

Abstract

Among the complaints of the customers are the taps until the water quality is very bad home-home even unfit for consumption as drinking water or for cooking. We each month to pay the bills that do not fit with the water that we use. We hold water and be spilled and dumped because the water is dirty, smelly and sometimes the smell of garbage. From the first, as this issue continues to be present when talking about PDAM Pekanbaru. Customers upset because they feel disadvantaged by poor water quality especially when it rains. But, until now there is no fix for this problem. Even changing penguasapun in Pekanbaru not bring good changes to the quality of service to consumers.This study using sociological juridical approach. Sociological juridical research or empirical research approach is to look at in terms of the fact that occur in the field. While the descriptive nature of the research is aimed at providing a clear picture of the issues examined. Population and sample in this study is a population study in PDAM Tirta Siak Pekanbaru City and sample the Director of PDAM Tirta Siak Pekanbaru and Consumer Services Drinking Water Using Tirta Siak Pekanbaru in Pekanbaru District of the City.The results of this study are: First, the law for the protection of drinking water consumers for services PDAM Tirta Siak Pekanbaru city on water quality is very bad, resulting in non-fulfillment of the rights of consumers, resulting in harm to consumers both Financial and nonfinancial. Second, the recognition of the people who use the water utility PDAM TirtaSiak Pekanbaru, the absence of realized what strived by PDAM TirtaSiak Pekanbaru City until recently, even the water quality is getting worse. If rainy days, the water supplied by PDAM Tirta Siak Pekanbaru City unfit for dikosumsi. Legal efforts are made to consumers who are disadvantaged on layanana drinking water by PDAM Tirta Siak Pekanbaru City may file a lawsuit to the Consumer Dispute Settlement Board (BPSK) which is based on Law No. 8 of 1999 on Consumer Protection.Keywords: Implementation - Legal - Drinking Water For Consumer - consumer protection

Abstract

In law number 11 of 2012 about the Child Criminal Justice System gives a role to the community officer. Community Officer is a Community Care Counselor who works at the Correctional Office. The purpose of this thesis is to know the role of Correctional Office in the child criminal justice system at the level of prosecution and verdict in Bangkinang District Court.This type of research can be classified with the type of sociological juridical research, because in this study the authors conducted directly the research on the location or place which studied in order to provide a complete and clear picture of the problem under study. This research was conducted in the jurisdiction of the Bangkinang District Court, while the population and the sample were the whole parties which related to the problem studied in this study. Sources of data used, primary data, secondary data and tertiary data, data collection techniques in this study by interview and literature study.From the results of research that has been done by the authors can be concluded. First, The Child Prosecutor is not necessarily guided completely by the Community Research Report that created by the Post of Correctional Office Correctional Institution Class IIB Bangkinang. Second, The Judge of Child is not necessarily guided completely to the Community Research Report that created by by the Post of Correctional Office Correctional Institution Class IIB Bangkinang.Keywords: Prosecution-Decision-Child Criminal Justice System.

Abstract

Subjek hukum adalah badan ataupun entitas yang memiliki kemampuan untuk memegang hak dan kewajiban terhadap hukum internasional. Dari sekian banyak subjek hukum internasional yang bermunculan seiring berjalannya waktu, negara tetaplah merupakan subjek hukum internasional yang utama. Negara tidak belum memiliki definisi yang seragam akan tetapi menurut Konvensi Montevideo 1933 tentang Hak dan Kewajiban Negara terdapat empat kriteria negara yaitu, penduduk tetap; wilayah; pemerintahan; dan kemampuan menajlin hubungan dengan negara lain. Taiwan sebagai negara dengan status yang dipertentangkan secara faktual telah memenuhi keempat kriteria tersebut akan tetapi terkendala hubungan diplomatiknya karena secara de jure masih merupakan bagian dari Republik Rakyat Tiongkok.Tujuan dari penelitian ini adalah agar mengetahui bagaimana hubungan diplomatik Taiwan dengan negara lain dikaitkan dengan posisi Republik Rakyat Tiongkok sebagai subjek hukum internasional. Selanjutnya, agar mengetahui bagaimana kedudukan Taiwan dalam menjalin hubungan diplomatik dengan negara lain berdasarkan Konvensi Montevideo 1933.Dari empat kriteria negara sebagai subjek hukum internasional yang disebutkan dalam Konvensi Montevideo 1933, Taiwan telah memenuhi semuanya meskipun masih kurang pengakuan dan dukungan diplomatik jika dikaitkan dengan kriteria keempat. Akan tetapi, tidak ada batas minimum pengakuan dari negara lain agar Taiwan dapat disebut sebuah negara. Oleh karena itu, Taiwan seharusnya dapat menjalankan hubungan diplomatic sebagaimana mestinya tanpa terkendala kebijakan Asas Satu China yang dijunjung tinggi oleh Republik Rakyat Tiongkok.Kata Kunci: Subjek Hukum, – Negara, – Pengakuan.

Abstract

Pandai Sikek woven songket is the intellectual property generated by indigenous or traditional communities. So clever sikek woven songket can be said of a copyright that must or should be protected, especially in art motif. But this still is not optimal to do because not all motifs woven clever sikek who have finished or there has been protected by the government, especially in Kanagarian Pandai Sikek Tanah Datar this is evidenced from all art motifs on Kanagarian Pandai Sikek Tanah Datar amounted to approximately 100 pieces motif but new ones have copyright certificates amounted to only 23 pieces. From this it appears that the legal protection for Tenun Songket Pandai Sikek not gone wellThe purpose of this thesis are: First, to determine the Legal Protection. Secondly, To know Barriers in Providing Legal Protection Against Copyright Weaving Art Motif Tenun Songket Pandai Sikek. Third, to know the Government's efforts to overcome barriers in Providing Legal Protection AgainstFrom the research problem there are three main things that concluded, first, legal protection against copyright art motif Tenun Songket Pandai Sikek is not running with the maximum because most motif Tenun Songket Pandai Sikek who have been there already widely known by the public crowded, so the resulting motif Tenun Pandai sikek can not be registered. Second, barriers in Providing Legal Protection Against Copyright Art Motif Tenun Songket Pandai Sikek is limited information, and the government Kanagarian could not supervise thoroughly, and in principle it is difficult to carry out protection because the motive is already widely known by the public as well as the lack of socialization of the registration rights create. Third, the Government's efforts to overcome obstacles in Providing Legal Protection Against Copyright Art Motif Tenun Songket Pandai Sikek is socializing in Kanagarian Pandai Sikek, develop the creation of craftsmen Tenun Songket Pandai Sikek, and still be preserved and developed as well as for the motive newly sought government Kanagarian to registration. The suggestion of the results of this study are. First, a need for special protection. Second, the Government should be more and more creative in doing socialization. Third, We recommend Wali Nagari more active in monitoring the results of a new creation and to develop the creation of craftsmen Tenun Songket Pandai Sikek.Keywords: Legal Protection, Copyright, Art Motif Tenun Songket Pandai Sikek.
