Sunnah is the second sources of law after the Qur’an. The understanding of Sunnah according to muhadditsin has wider scope than that of ushuliyyin. This is understandable due the concern of ushuliyyin is sunnah in its role as a source of Islamic law, while muhadditsin classifies everything that comes from the Prophet PBUH as sunnah, whether or not they have legal consequences. This paper captures the discourse on Sunnah according to ushuliyyin and muhadditsin perspective; starting from the definition of Sunnah, its function and classification, including the dichotomy of tasyri’iyyah and ghayr tasyri’iyyah, as well as the meaning and patterns of interaction with the Sunnah in order to obtain a proper understanding of the Sunnah and draw a law from it.

Life of the nation can not be separated from political events in which people participation are required. In determining political attitudes, people need information such as those obtained from political news. But in reform era, freedom of political news is highlighted in its ethical practices. As a Muslim majority country, Islamic ethics becomes an important source for political news in Indonesia. This study is conducted in philosophical method, by way of inventive and heuristic. This article expresses the ethics of political news in a review of Islamic ethics. In the level of text, ethics of reporting politics lays on mass media which should represent politics in its truth, at the level of discourse practice, responsibility and professional ethics are imperative categorical for the actors, at the level of sociocultural practice, the vision of media should be on a just and prosperous society.

This article focuses on legal reasoning proposed by female litigants in divorce cases in Religious Court of Kudus (PA Kudus), Cetral Java during 2014. There are 12 (twelve) cases chosen randomly from institutional website www.badilag.net. Those cases were analyzed to understand the reasons behind the divorce cases. Hermeneutic is a usefull theory in this article.

There are several methods to determine the direction of Qibla. Theories commonly taught to the stu dents of College of Islamic Studies are (1) the theory of qibla direction, (2) the theory of qibla shadows or commonly referred to roshdul qibla, and (3) the theory of anytime qibla. The application of each theory depends on the time. For example, using istiwa’ stick, people need to look at the shadow of the sun in the morning and the evening to draw a line from east to west to determine the direction of qibla. Using rashdul qibla, people have to wait for annual sun shadow, on 27/28 May and 15/16 July each year. On that day, the sun is right above Kaaba. There is also daily rashdul qibla when the sun or its shadow is in the same direction with Kaaba. The third method is anytime qibla by calculating the azimuth of the sun, the direction or its shadow to determine the qibla. Compare to the first two methods, the third one is more applicable.

Women and child trafficking may occur in any countries. In practice, human trafficking is done in an organized way. The Law No. 12 of 2007 on the Eradication of Human Trafficking (PTPPO) regulate not only individual criminals, but also those carried out by corporations, state officials who abuse their powers, as well as organized groups. Legal breakthrough in this law is the right of victims to not be charged penalties when committing a crime because it is forced by criminal trafficking.

Reflection of philosophy of law for legal development by reflecting back to the central questions in the philosophy of law which are based on the aspects epistimologi, ontology, and axiology. The epistemological aspect inquire/study the origin, nature, operational limits of the law. The ontology aspect inquire / learn where the law. The axiology aspect learn the purpose of the law. The relevance of philosophy of law for the development of law by finding links between schools or schools of law with legal developments. Which schools/school of law it plays an important role and influence on legal developments since centuries ago to the present.

As the biggest Muslim country and a state law, it is only natural if Islamic law is used as a source of reference in the formation of national laws. In the history of the development of Islamic law in Indonesia, Islamic law was merely based on fatwa of Islamic scholars and their interpretation. Major breakthrough occurred in the New Order Era with the issuance of Presidential Degree No 1/1991 on the Compilation of Islamic Law (KHI) on Jun 10, 1991. The Decree was then followed by the Decision of Minister of Religious Affairs No 154/1991 on the implementation of Presidential Decree No 1/1991 regarding the dissemination of KHI as a suplement for the Law No 7/1989 on Religious Court. KHI has filled the empy seat of material law in Religious Court. It provides judges of Religious Court with materials to observe and decide on cases. It may also eliminate debates among judges on the problem of inheritance marriage and endowment (waqf). Although KHI is far from perfection, it may be used as material sources for religious court and there is no religious court decision which left KHI out.

The article discusses mantuq and mafhum in drawing the laws from Qur’an and Sunnah. The author begins with the understanding of manthuq and mafhum. According to Al-Qatthan (2002: 358) manthuq is a meaning that is indicated by lafadh according to its words, the meaning is based on the spoken letters. On the other hand, mafhum is meaning indicated by lafadh based on other than its sound. The ushuliyyin differentiates mafhum into two kinds, namely: a) mafhum muwafaqah or dilalah nash, meaning the law in accordance with manthuq, and b) mafhum mukhalafah means unspoken meaning which is drawn from manthuq but the opposite. There are dispute among scholars over manthuq and mafhum. Scholars agree on using manthuq as hujjah (proof), but most of them have different opinions about using mafhum as hujjah. They agree on the validity of mafhum muwafaqah as proof (hujjah) except Zahiri schools. However, mafhum mukhalafah is allowed and recognized only by Maliki, Shafi’i and Hanbali. NU and its followers is a national asset that needs to be affirmed by the state. Since its establishment, NU has colored the journey of the nation. This is confirmed by the number of NU figures who became national heroes, public officials and others. However, as mass organization, NU finds difficulties to contribute in politics, so they look back to the 1926 khittah. As one of Muslim organization, NU is expected to respect and care for others including their opponents. NU Muktamar in Jombang, East Java August 2015 showed the political dynamics within NU, between two groups: proponents of Ahlul halli wal aqdi (AHWA) and its opponents.

The rapid and siqnificant growth of Islamic banking must supported by qualified human resources. People need legal certainty to maintain social order. Sometimes, people make rules to legitimize their acts or to create a new interpretation of the law. Therefore, a strict law is required to control people from jumping to an apologetic conclusion. Islam provides human beings with God’s law as guidance in the world and the life here after. Islamic banking is a national banking system based on Islamic law. Islamic banking is founded based on Islamic economic system. It aims not only for profit but for people welfare.
