Abstract

The article covers Al-Ghazali's view on the use of maslahah mursalah as the basis for establishing law in the field of sharia economics. The concept of maslahah mursalah is debated among ulama to be used as the basis for establishing law. The maslahah provides opportunities for the adoption of new innovations that were not previously discussed among ulama and were not rejected by religion. On the other hand, the economy needs sharia support to continue to run in accordance to religious guidance and adapt to the times. By comparing economic principles and maslahah theory, al-Ghazali's view that accepts the implementation of maslahah is found as a solutional view. Nevertheless, al-Ghazali provided conditions and restrictions on the use of maslahah in the economic field so that they will not be chaotic and uncontrolled.Keywords: maslahah mursalah; al-Ghazali; Islamic economics; religious purpose Abstrak: Artikel ini mengulas pandangan Al-Ghazali tentang penggunaan maslahat mursalah sebagai dasar penetapan hukum di bidang ekonomi syariah. Konsep maslahat mursalah diperdebatkan di kalangan ulama untuk dijadikan dasar penetapan hukum. Maslahat ini memberi peluang adopsi inovasi-inovasi baru yang sebelumnya tidak dibahas di kalangan ulama dan tidak ditolak pula oleh agama. Di sisi lain, ekonomi membutuhkan dukungan syariah agar tetap berjalan sesuai tuntunan agama dan beradaptasi dengan perkembangan zaman. Dengan membandingkan prinsip ekonomi dan teori maslahat, ditemukan pandangan al-Ghazali yang menerima penerapan maslahat tersebut sebagai pandangan solutif. Meskipun begitu, al-Ghazali memberikan persyaratan dan pembatasan penggunaan maslahat tersebut dalam bidang ekonomi agar tidak liar dan tidak terkendali.Kata kunci: Maslahah Mursalah; Al-Ghazali; Ekonomi Islam; Tujuan Keagamaan

Abstract

After the adjustment of the degree of Islamic higher education graduates in the PTKIN environment based on PMA No. 33 of 2016 requires the competence of alumni of the Faculty of Sharia and Law as legal experts to be equal to alumni of Bachelor of Laws at public universities. However, as a Faculty under an Islamic Institution, Bachelor of the Faculty of Sharia and Law not only has the burden of the impact of equalizing the title but also has to maintain the mission of tafaqquh fi al Din as the character of students in the PTKIN environment. Professional Law, a science integration approach, offers a scientific integration model in finding the competitive advantage value for Sharia and Law faculty students, without having to leave Tafaqquh Fi al Din as the mission and character of Sharia and Law Faculty students in PTKIN. Profession of Law as an approach to the integration of knowledge is very interesting to study with the following formulas: (1) How do law graduates in the PTKIN FSH environment have a competitive advantage? (2) How can the formulation of Prophetic Law (IHP) be a competitive advantage for FSH graduates in PTKIN? The aims of this research are: (1) by identifying the competitive advantage possessed by FSH law graduates in the PTKIN environment, the value of the students' strengths in the Faculty of Sharia and Law will be known as the main value. (2) Finding the construction of the formulation of the Prophetic Law (IHP) will be a competitive advantage for FSH graduates in the PTKIN environment. This research is a qualitative research with a philosophical, phenomenological, and pedagogical approach. Sources of data are carried out by conducting interviews with experts to find out the prophetic concept which is then developed into prophetic law.Keywords: Prophetic Law; Prophetic Law; Prophetic Law Integration Abstrak:Setelah terjadi penyesuaian gelar lulusan perguruan tinggi Islam di lingkungan PTKIN berdasarkan PMA No. 33 tahun 2016 menuntut kompetensi alumni Fakultas Syariah dan Hukum sebagai seorang ahli hukum sejajar dengan alumni Sarjana Hukum pada Perguruan Tinggi umum. Namun demikian Sebagai Fakultas yang berada di bawah Institusi Islam, Sarjana Fakultas Syariah dan Hukum tidak hanya memiliki beban dampak dari penyetaraan gelar tersebut namun juga harus mempertahankan misi tafaqquh fi al Din sebagai karakter Mahasiswa di lingkungan PTKIN. Ilmu Hukum Profetik sebuah pendekatan integrasi ilmu menawarkan model integrasi keilmuan dalam menemukani nilai competitive advantage Mahasiswa fakultas Syariah dan Hukum, tanpa harus meninggalkan Tafaqquh Fi al Din sebagai misi dan karakter Mahasiswa Fakultas Syariah dan Hukum di Lingkungan PTKIN. Ilmu Hukum Profetik sebagai sebuah pendekatan mengenai integrasi ilmu sangat menarik di kaji dengan rumusan: (1) Bagaimana sarjana hukum di lingkungan FSH PTKIN memiliki competitive advantage? (2) Bagaimana rumusan Ilmu Hukum Profetik (IHP) dapat menjadi keuanggulan kompetitif bagi lulusan FSH di lingkungan PTKIN? Tujuan dari penelitian ini adalah: (1) dengan mengidentifikasi competitive advantage yang dimiliki oleh sarjana hukum FSH di lingkungan PTKIN, maka akan diketahui nilai kelebihan Mahasiswa Fakultas Syariah dan Hukum sebagai nlai utamanya. (2) Dengan Menemukan konstruksi rumusan Ilmu Hukum Profetik (IHP) akan menjadi keunggulan kompetitif bagi lulusan FSH di lingkungan PTKIN.  Penelitian ini adalah penelitian Kualitatif dengan pendekatan filosofis, fenomenologis, dan pedagogis. Sumber data dilakukan dengan cara melakukan wawancara kepada para expert untuk mengetahui konsep Profetik yang kemudian dikembangkan ke dalam Ilmu Hukum Profetik.Kata Kunci: Hukum Profetik, Profetik, Integrasi Ilmu Hukum profetik

Abstract

The implementation of the mortgage execution auction based on article 6 UUHT which is carried out in accordance with the procedure and fulfills formal legality according to Article 25 PMK No 213/PMK.06/2020, the auction cannot be canceled, so if there is a lawsuit to cancel the auction that has been carried out, it must be decided to refuse lawsuit. The research method used in this study is normative-empirical with a Judicial Case Study approach. The results showed that the judge's decision stating that the auction was canceled resulted in a guarantee of legal certainty over the implementation of the auction based on Article 6 of the UUHT to be ignored, and the decision that declared the auction canceled because the debtor was declared in bad faith had committed an unlawful act causing losses. For auction buyers, due to the responsibility of the debtor who intentionally commits an unlawful act and the creditor who is declared negligent in accepting the object of mortgage, it is not stated concretely in the judge's decision.Keywords: Legal Certainty; Execution Auction; Mortgage right; Lawsuit for Unlawful Acts; Debtor Abstrak:Pelaksanaan lelang eksekusi hak tanggungan berdasarkan pasal 6 UUHT yang dilakukan sesuai dengan prosedur dan memenuhi legalitas formal menurut Pasal 25 PMK No 213/PMK.06/2020, lelang tidak dapat dibatalkan, sehingga apabila ada gugatan untuk membatalkan lelang yang sudah dilaksanakan maka harus diputuskan menolak gugatan. Metode penelitian yang digunakan dalam penelitian ini adalah normatif-empiris dengan pendekatan Judicial Case Study. Hasil penelitian menunjukkan bahwa, putusan Hakim yang yang menyatakan lelang dibatalkan berakibat jaminan kepastian hukum atas pelaksanaan lelang berdasarkan Pasal 6 UUHT menjadi terabaikan, dan putusan yang menyatakan pelelangan batal karena debitur dinyatakan beritikad buruk telah melakukan perbuatan melawan hukum menimbulkan kerugian. Bagi pembeli lelang karena tanggung jawab debitur yang dengan sengaja melakukan perbuatan melawan hukum dan kreditur yang dinyatakan lalai menerima objek hak tanggungan tidak disebutkan secara konkrit dalam putusan hakim.Kata Kunci: Kepastian Hukum; Lelang Eksekusi; Hak Tanggungan; Gugatan Perbuatan Melawan Hukum; Debitur

Abstract

Student learning styles are very diverse. Teachers must have knowledge and skills in teaching. Teachers must recognize the characteristics of students in the delivery of learning. This study aims to determine the learning styles of 6th grade students at MI Al-Zaytun, Mekarjaya Village, Gantar District, Indramayu. The results showed that each student has a different learning style, so that in one class there are various learning styles as well. Visual style is learning style using sight, audiotorial learning style is learning style using hearing, kinesthetic learning style is using movement. In class 6 B 01 is more dominant to visual learning style as much as 37%, class 6 B 02 is more dominant to visual learning style as much as 36%, class 6 B 03 is more dominant to visual learning style 36%, class 6 B 04 is more dominant to visual learning style 35% visual learning, class 6 B05 is more dominant to Visual learning style 35%, class 6 B 06 is more dominant to Auditorial learning style 34%, class B 07 is more dominant to audiotorial learning style as much as 36%, class 6 B 08 is more dominant to kinesthetic learning style as much as 36%. By knowing the learning styles of students, it can make it easier for teachers to learn with students, make it easier for students to catch lessons and increase students' enthusiasm for learning.Keywords: Visual Learning Style; Auditory Learning Style; Kinesthetic Learning Style AbstrakGaya belajar siswa sangat beragam. Guru harus memiliki pengetahuan dan keterampilan dalam mengajar. Guru harus mengenali karakteristik peserta didik dalam penyampaian pembelajaran. Penelitian ini bertujuan untuk mengetahui gaya belajar siswa kelas 6 MI Al- Zaytun, Desa Mekarjaya, Kecamatan Gantar, Indramayu. Hasil penelitian ini setiap siswa memiliki gaya belajar yang berbeda sehingga dalam satu kelas terdapat bermacam gaya belajar pula. Gaya visual merupakan gaya belajar menggunakan penglihatan, gaya belajar audiotorial merupakan gaya belajar menggunakan pendengaran, gaya belajar kinestetik menggunakan gerakan. Pada kelas 6 B 01 lebih dominan kepada gaya belajar visual  sebanyak 37 %, kelas 6 B 02 lebih dominan kepada gaya belajar visual sebanyak 36 %, kelas 6 B 03 lebih dominan kepada gaya belajar visual 36%, kelas 6 B 04 lebih dominan kepada gaya belajar visual 35 %, kelas 6 B05 lebih dominan kepada gaya belajar Visual  35 %, kelas 6 B 06 lebih dominan kepada gaya belajar Auditorial 34 %, kelas B 07 lebih dominan kepada gaya belajar audiotorial sebanyak 36 %, kelas 6 B 08 lebih dominan kepada gaya belajar kinestetik sebanyak 36%. Dengan mengetahui gaya belajar yang dimiliki siswa, dapat memudahkan guru dalam pembelajaran dengan siswa, memudahkan siswa dalam menangkap pelajaran serta meningkatkan semangat belajar siswa.Kata kunci: Gaya Belajar Visual; Gaya Belajar Auditorial; Gaya Belajar Kinestetik
