Abstract

Indonesia is an archipelagic country as well as a pluralistic country in religion, ethnicity, language, and others. The state also guarantees citizens to continue their offspring through a legal marriage as regulated in Law Number 1 of 1974 concerning Marriage. In the marriage law, it is stated that the validity of marriage is based on the law of their respective religions. This means that interfaith marriages cannot be carried out as was the case before this law was introduced. The research method used is descriptive analytical with a juridical normative approach. After an academic study, it turns out that this view is wrong, because the law provides a way out by submitting an application to the local district court so that interfaith marriages can be registered as legal marriages. One example of practice, interfaith marriages carried out at the Surakarta District Court in Stipulation No. 333/Pdt.P/2019/PN.Skt.Keywords: Interfaith Marriage; Legal Perspective; Human Rights. AbstrakNegara Indonesia adalah negara kepulauan sekaligus sebagai negara pluralistik dalam agama, suku, bahasa, dan lain-lain. Negara juga menjamin warga negara untuk melanjutkan keturunan melalui perkawinan yang sah sebagaimana diatur dalam Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan. Dalam undang-undang perkawinan menyatakan bahwa sahnya perkawinan berdasarkan hukum agamanya masing-masing. Ini berarti perkawinan beda agama tidak bisa dilakukan seperti yang pernah berlaku sebelum undang-undang ini ada. Metode penelitian yang digunakan adalah deskriptif analitis dengan pendekatan  normatif yuridis. Setelah dilakukan telaah akademik ternyata pandangan itu keliru, karena undang-undang memberi jalan keluar dengan cara mengajukan permohonan kepada pengadilan negeri setempat agar perkawinan beda agamanya dapat dimohonkan pencatatannya menjadi perkawinan yang sah. Salah satu contoh praktik, perkawinan beda agama yang dilakukan di Pengadilan Negeri Surakarta dalam Penetapan No.333/Pdt.P/2019/PN.Skt.Kata Kunci: Perkawinan Beda Agama; Perspektif Hukum; Hak Asasi Manusia

Abstract

The Constitutional Court (MK) through MK Decision Number 137/PUU-XIII/2015 has canceled the enactment of regulations related to the authority of the Minister of Home Affairs in canceling regional regulations. The judicial review was submitted by the Association of Indonesian Regency Governments (Apkasi). The research method used is a qualitative research method with a literature approach and the Statute Approach. The results of the study stated that the Constitutional Court granted the Petitioner's request as long as the review of Article 251 paragraph (2), paragraph (3), and paragraph (8) and paragraph (4) as long as the phrase '…cancellation of Regency/City Perda and Regent/Mayor Regulation as intended in paragraph (2) is stipulated by a governor's decision as the representative of the Central Government' Law no. 23 of 2014 concerning Regional Government.” This decision of the Constitutional Court was regretted by several parties. Because so far the authority of the Minister of Home Affairs is considered a breakthrough in clearing local regulations that hinder the running of the bureaucracy, for example in matters of investment, taxes, and user fees. As a legal consequence of the Constitutional Court's decision, the Minister of Home Affairs no longer has the authority to cancel regional regulations that violate higher regulations or at the implementation level are deemed problematic or contrary to the public interest. Except through judicial review to the Supreme Court.Keywords: Constitutional Court Decision; Local regulation; Minister of Home Affairs Abstrak:Mahkamah Konstitusi (MK) melalui Putusan MK Nomor 137/PUU-XIII/2015 telah membatalkan berlakunya aturan terkait kewenangan Menteri Dalam Negeri dalam membatalkan peraturan daerah. Uji materi tersebut diajukan oleh Asosiasi Pemerintah Kabupaten Seluruh Indonesia (Apkasi). Metode penelitian yang digunakan adalah metode penelitian kualitatif dengan pendekatan literatur dan Statute Approach. Hasil penelitian menyatakan bahwa Mahkamah Konstitusi mengabulkan permohonan Pemohon sepanjang pengujian Pasal 251 ayat (2), ayat (3), dan ayat (8) serta ayat (4) sepanjang frasa ‘…pembatalan Perda Kabupaten/Kota dan Peraturan Bupati/Wali Kota sebagaimana dimaksud pada ayat (2) ditetapkan dengan keputusan gubernur sebagai wakil Pemerintah Pusat’ Undang-Undang No. 23 Tahun 2014 tentang Pemerintah Daerah.” Putusan Mahkamah Konstitusi  ini banyak disayangkan oleh beberapa pihak. Sebab selama ini wewenang Mendagri dianggap sebagai terobosan dalam membersihkan perda yang menghambat jalannya birokrasi, misalnya dalam urusan investasi, pajak, dan retribusi. Akibat hukum dari Putusan MK ini maka Mendagri tak lagi punya kewenangan untuk membatalkan perda yang menabrak peraturan lebih tinggi atau dalam tataran implementasi dirasa bermasalah atau bertentangan dengan kepentingan umum. Abstract

In fact, there are still many problems that always arise, such as starting from the registration of the pilgrimage, the cost of the pilgrimage, accommodation and transportation for the pilgrimage, the management of the pilgrimage funds, to the failure of a number of prospective pilgrims to go to the holy land. This study uses a qualitative research method, with a literature and empirical approach, interview data collection techniques, observation and documentation. The results of the study show that: Standards for Hajj and Umrah Services at PT Budi Luhur Abadi (Bilad Tour), Bogo City Branch Offices include: Standards for Hajj and Umrah Bilad Tour services, Bogor City Branch Offices guided by the regulations of the Minister of Religion and the Law of the Republic of Indonesia, namely Number 17 of 1999 Article 14. In the implementation of services, all of them are guided by the standards of laws and regulations issued by the Ministry of Religion. Development of Hajj and Umrahdi Bilad Tour, Bogor City Branch Office. The last five years can be seen the development of the ups and downs in the acquisition of pilgrims for Hajj and Umrah that has occurred.Keywords: Hajj and Umrah Services; Bogor; PT. Nobility AbstrakPada kenyataannya masih banyak diketemukan problematika yang selalu muncul seperti mulai dari pendaftaran haji, biaya haji, akomodasi dan transportasi haji, pengelolaan dana haji, hingga gagalnya sejumlah calon jamaah haji plus berangkat ke tanah suci. Penelitian ini menggunakan metode penelitian Kualitatif, dengan pendekatan literatur dan empiris, teknik pengumpulan data wawancara, observasi dan dokumentasi. Hasil penelitian menunjukan bahwa:  Standar Pelayanan Haji dan Umrah di PT Budi Luhur Abadi (Bilad Tour), Kantor Cabang Kota Bogo meliputi: Standar pelayanan Haji dan Umrah Bilad Tour, Kantor Cabang Kota Bogor berpedoman pada peraturan peraturan Mentri Agama dan Undang undang Republik Indonesia yaitu Nomor 17 Tahun 1999 Pasal 14.  Dalam pelaksanaan pelayanan semuanya berpedoman pada standar undang-undang dan peraturan-peraturan yang di keluarkan oleh Kemenag. Perkembangan Haji dan Umrahdi Bilad Tour, Kantor Cabang Kota Bogor. Lima tahun terakhir ini bisa di lihat perkembangan naik turunya perolehan jamaah haji dan umrah yang telah terjadi.Kata Kunci: Pelayanan Haji dan Umroh; Bogor; PT. Budi Luhur

Abstract

This study analyzes the implementation of restorative justice in the settlement of criminal law disputes in Minangkabau by Kerapatan Adat Nagari (KAN). Kerapatan Adat Nagari (KAN) is customary institutions ratified in state regulations. Traditionally, these institutions have the authority to resolve legal problems occurred in Minangkabau community. Empirical legal research was used in this study. The primary legal sources of this research are Nan Duo Puluah Law applied in Minangkabau community and the interview of the Head of Kerapatan Adat Nagari (KAN) Minangkabau. The KAN interviewed were the Head of KAN Nagari Batu Ampa Regency of Lima Puluh Kota, the Head of KAN Nagari Tigo Jangko Regency of Tanah Datar, and Minangkabau Indigenous Community Leaders. In addition, books, research reports, and legal experts’ opinions were used as the secondary legal sources of the study. Based on the results of the study, it can be concluded that the method of resolving criminal law disputes by KAN actually contains the theory of restorative justice, even before this theory developed as it is today. Regarding compliance with the results of dispute resolution by KAN, the Minangkabau community has reached the level of internalization compliance. Because for the Minangkabau people, KAN is an inseparable part of their customs.Keywords: Restorative Justice; Dispute Resolution; Minangkabau Community AbstrakStudi ini menganalisis implementasi restorative justice dalam penyelesaian sengketa hukum pidana di Minangkabau oleh Kerapatan Adat Nagari (KAN). Kerapatan Adat Nagari merupakan lembaga adat yang dilegalkan dalam peraturan negara. Secara adat, lembaga tersebut memiliki kewenangan dalam menyelesaikan permasalahan hukum yang terjadi di masyarakat Minangkabau. Untuk memudahkan dalam menganalisis penelitian ini, penulis menggunakan penelitian hukum empiris. Kemudian yang menjadi sumber hukum primer penelitian ini adalah Undang-Undang Nan Duo Puluah yang diimplementasikan pada masyarakat Minangkabau. Selain itu, peneliti juga mewawancarai Ketua Kerapatan Adat Nagari (KAN) Minangkabau. Adapun Ketua KAN yang diwawancarai adalah Ketua KAN Nagari Batu Ampa Kabupaten Lima Puluh Kota, Ketua KAN Nagari Tigo Jangko di Kabupaten Tanah Datar, dan Tokoh Masyarakat Adat Minangkabau. Untuk sumber hukum sekunder, peneliti menggunakan buku, laporan penelitian, dan pendapat ahli hukum. Berdasarkan hasil penelitian, maka dapat disimpulkan bahwa metode penyelesaian sengketa hukum pidana oleh KAN sebenarnya sudah mengandung teori restorative justice, bahkan sebelum teori ini berkembang seperti sekarang ini. Mengenai kepatuhan terhadap hasil penyelesaian sengketa oleh KAN, masyarakat Minangkabau sudah mencapai tingkat kepatuhan internalization. Sebab bagi masyarakat Minangkabau, KAN merupakan bagian yang tidak bisa dilepaskan dari adat istiadat mereka.Kata Kunci: Restorative Justice; Penyelesaian Sengketa; Minangkabau

Abstract

This paper discusses two basic issues regarding the problem of the ecological crisis in relation to religion. First, because of the belief that the root of the catastrophe of environmental damage is caused by the dwindling spirituality of modern humans. This thinness of spirituality causes them to lose touch with the sacredness of all things. Until in the end they assumed that nature was only limited to objects that could be exploited freely. Meanwhile, spiritual issues are a core part of every religion. Second, there are accusations that religion has become the inspiration behind the environmental crisis. Religion, with all its doctrines, is considered to have inspired followers of related religions to exploit nature. The method used is qualitative and in the discussion it uses descriptive analysis to reveal and explain ecospiritual in the Qur'an. This paper concludes that in fact religions view the ecospiritual, especially regarding the creation of nature, the sacredness of nature and the relationship between humans and nature, in short it can be concluded that Islam, Christianity, Confucianism, and Judaism have the same perspective on the creation of nature. These religions explain that nature was created by God, but unlike Hinduism and Buddhism, the two religions do not provide an opinion regarding the creation of nature. Then, regarding the sacredness of nature, Islam, Christianity, Hinduism, Buddhism, and Judaism explain that Nature is sacred. However, not with Confucianism, this religion does not have any opinion about the sacredness of nature. Finally, regarding the relationship between humans and nature, the seven religions state that the relationship between humans and nature is the same, the similarities are elements of creation.Keywords: Ecospiritual, Nature and Human Relations, Religion. Abstrak. Tulisan ini membahas dua hal mendasar mengenai permasalahan krisis ekologi kaitannya dengan agama. Pertama, karena adanya keyakinan bahwa akar dari malapetaka kerusakan lingkungan itu disebabkan oleh spiritualitas manusia modern yang semakin menipis. Tipisnya spiritualitas ini menyebabkan mereka kehilangan kontak dengan sakralitas segala sesuatu. Hingga pada akhirnya beranggapan bahwa alam hanyalah sebatas benda yang bisa dieksploitasi secara bebas. Sementara itu, persoalan spiritual adalah bagian inti dari setiap agama. Kedua, karena adanya tudingan yang menyebut bahwa agama telah menjadi inspirator dibalik krisis lingkungan. Agama, dengan segala doktrinnya, dianggap telah menginspirasi para pengikut agama terkait untuk melakukan eksploitasi terhadap alam. Metode yang digunakan adalah kualitatif dan dalam pembahasannya menggunakan deskriftif analisis untuk menyingkap serta menjelaskan ekospiritual di dalam Alquran. Tulisan ini memberikan kesimpulan bahwa sesungguhnya agama-agama memandang tentang ekospiritual khususnya terkait penciptaan alam, sakralitas alam dan relasi antara manusia dengan alam, secara singkat dapat disimpulkan bahwa Agama Islam, Kristen, Kong Hu Cu, dan Yahudi memiliki kesamaan perspektif mengenai penciptaan alam. Agama-agama tersebut menjelaskan bahwa alam diciptakan oleh Tuhan, namun berbeda dengan agama Hindu dan Budha, kedua agama tersebut tidak memberikan pendapat terkait penciptaan alam. Kemudian, mengenai sakralitas alam, agama Islam, Kristen, Hindu, Budha, dan Yahudi menjelaskan bahwa Alam itu suci. Namun, tidak dengan agama Kong Hu Cu, agama tersebut tidak berpendapat apapun tentang sakralitas alam. Terakhir, mengenai relasi manusia dan alam ketujuh agama tersebut menyebutkan bahwasannya hubungan manusia dan alam adalah sama, persamaannya tersebut merupakan unsur penciptaan.Kata Kunci: Ekospiritual, Relasi Alam dan Manusia, Agama
