Abstract

Through Law Number 6 of 2014 it opens space for governance in accordancewith the characteristics, culture, and local wisdom of each region. Soromandi subdistrict, for example, is one of the areas in Bima district which has a characteristicin governance that is still firmly held, namely a strong mutual cooperation culturethat is still alive today. From this description, two main problems can be drawn; 1)What is the role of the village government in maintaining local wisdom inSoromandi District, 2) What are the efforts made by the village government inincreasing local wisdom in Soromandi District.This research is normative andempirical legal research, namely legal research that examines the factualimplementation or implementation of positive legal provisions in every particular SELISIK - VOLUME 7, NOMOR 1, JUNI 2021ISSN:2460-4798 (PRINT) & 2685-6816 (ONLINE)117legal event that occurs in society. Abstract

The sale of dog meat at the Pasar Jaya Regional Company, Senen Block III, began with news circulating on social media which was revealed by Animal Defenders Indonesia. The sale has been going on for more than 6 years and every day the trader sells 4 dog meat. The sale of dog meat at the Pasar Jaya Regional Company on Senen violates the regulations for selling at the Pasar Jaya Senen Regional Company, because dog meat is one of the products that cannot be traded. The sale of dog meat violates Law No. 18 of 2012 concerning Food, because dog meat is a type of commodity that cannot be traded. In Islamic law, dog meat is a forbidden food. Law Number 33 of 2014 concerning Halal Product Guarantees, business actors in selling non-halal products must include non-halal signs on their products, which can be in the form of writing or images stating that they are not halal. Traders also violate Law Number 8 of 1999 concerning Consumer Protection, because business actors in carrying out their business activities do not provide clear information to consumers about the products they sell and do not have good intentions. The problem is what are the forms of violation of Muslim consumer rights in the sale of dog meat and the form of sanctions given to business actors. The research method used is normative research using library data. The results of the study show that the sale of dog meat is a violation of the rights of Muslim consumers because traders do not provide information that the product they sell is dog meat. The sale is carried out close to halal products, this is a violation. The sanction given by the manager of the Pasar Jaya Regional Company on Senen to traders was a warning to business actors to close their stalls. The warning is heeded by business actors by closing their stalls.Key words: Dog meat, Violation, Muslim Consumer Rights

Abstract

The participation of the village government in the implementation of village tourism is expected to be able to prosper the village community. The purpose of this study was to determine the role of the village government in the implementation of tourism in the village of Sleman district. The research methods used are normative and empirical research methods. In this study, it can be seen that the village government in Sleman Regency has not participated in village tourism yet

Abstract

Indonesia is an archipelagic country as well as a pluralistic country in religion, ethnicity, language, and others. The state also guarantees citizens to continue their offspring through a legal marriage as regulated in Law Number 1 of 1974 concerning Marriage. In the marriage law, it is stated that the validity of marriage is based on the law of their respective religions. This means that interfaith marriages cannot be carried out as was the case before this law was introduced. The research method used is descriptive analytical with a juridical normative approach. After an academic study, it turns out that this view is wrong, because the law provides a way out by submitting an application to the local district court so that interfaith marriages can be registered as legal marriages. One example of practice, interfaith marriages carried out at the Surakarta District Court in Stipulation No. 333/Pdt.P/2019/PN.Skt.Keywords: Interfaith Marriage; Legal Perspective; Human Rights. AbstrakNegara Indonesia adalah negara kepulauan sekaligus sebagai negara pluralistik dalam agama, suku, bahasa, dan lain-lain. Negara juga menjamin warga negara untuk melanjutkan keturunan melalui perkawinan yang sah sebagaimana diatur dalam Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan. Dalam undang-undang perkawinan menyatakan bahwa sahnya perkawinan berdasarkan hukum agamanya masing-masing. Ini berarti perkawinan beda agama tidak bisa dilakukan seperti yang pernah berlaku sebelum undang-undang ini ada. Metode penelitian yang digunakan adalah deskriptif analitis dengan pendekatan  normatif yuridis. Setelah dilakukan telaah akademik ternyata pandangan itu keliru, karena undang-undang memberi jalan keluar dengan cara mengajukan permohonan kepada pengadilan negeri setempat agar perkawinan beda agamanya dapat dimohonkan pencatatannya menjadi perkawinan yang sah. Salah satu contoh praktik, perkawinan beda agama yang dilakukan di Pengadilan Negeri Surakarta dalam Penetapan No.333/Pdt.P/2019/PN.Skt.Kata Kunci: Perkawinan Beda Agama; Perspektif Hukum; Hak Asasi Manusia

Abstract

Setiap bidang tanah yang telah diproses pendaftarannya wajib diumumkan dan kemudian dibukukan baru diterbitkan sertipikatnya. Pengumuman itu bersifat negatif bertedensi positif. Karena itu sertipikat dinyatakan sebagai alat bukti yang kuat (bukan mutlak). Ini berarti masih dimungkinkan pihak-pihak mengajukan keberatan atas sertipikat itu, asal saja dilakukan tidak lebih dari 5 tahun sejak sertipikat itu diterbitkan, disertai syarat selama itu ia sudah pernah melakukan komplain kepada pemegang hak, kantor pertanahan setempat atau pengadilan. Upaya hukum itu dikenal dengan sebutan rechtsverwerking yang bermakna menambah kepastian hukum sertipikat hak atas tanah.

Abstract

The notary is a public official who is authorized to make authentic deeds, in which the obligation of a notary in carrying out his position must act honestly, reliably, independently, impartially, thoroughly, and safeguard the interests of the parties involved in legal actions. This is known as the precautionary principle for a notary in carrying out his position as a public official. The purpose of this writing is to examine the legal implications of counterfeiting and the responsibility of a notary to the binding sale and purchase agreement he made. The research method used in this paper is normative juridical with a statutory and case study approach. The results and findings obtained after conducting research and analysis of the problems in this paper, namely the legal impact due to the negligence of a notary in making a binding sale and purchase agreement because to forgery, so that the legal consequences of these PPJB are void, this is because it is not in accordance with the legal requirements of an agreement as stated in Article 1320 of the Civil Code, namely those relating to lawful causes. This happens because the notary in carrying out his authority does not carry out his obligations related to the principle of precautionary, therefore the notary must be responsible for his actions that have been carried out in accordance with the law and code of ethics. So it can be concluded that the deed made by the notary is null and void and is not an authentic deed but a private deed.

Abstract

Indonesia is a maritime country, where the sea area is larger than the land area. To realize the country's goal of becoming a prosperous country, as stated in the Preamble to the fourth paragraph of the 1945 Constitution, the Minister of Maritime Affairs and Fisheries Regulation No. 93/PERMEN-KP/2020 concerning Maritime Tourism Villages was issued, in addition to that there is also a regional regulation for Konawe Regency. North No. 2 of 2016 concerning the Master Plan for Regional Tourism Development for North Konawe Regency for 2016-2026 and also North Konawe Regent Decree No. 86 of 2022 concerning Designation of Developing Classification Tourism Villages and Pilot Classification Tourism Villages in North Konawe Regency. This is one of the efforts made by the government to improve the standard of living of the people living in the maritime village. The research method used is descriptive analysis with normative and empirical juridical approaches. Untuk mewujudkan tujuan negara menjadi negara yang sejahtera, sebagaimana tercantum dalam Pembukaan Alinea keempat Undang-Undang Dasar 1945, maka dikeluarkannya Peraturan Menteri Kelautan dan Perikanan No.93/PERMEN-KP/2020 tentang Desa Wisata Bahari, selain itu ada juga Peraturan daerah Kabupaten Konawe Utara No. 2 Tahun 2016 tentang Rencana Induk Pengembangan Pariwisata Daerah Kabupataen Konawe Utara tahun 2016-2026 dan juga Keputusan Bupati Konawe Utara No 86 Tahun 2022 tentang Penetapan Desa Wisata Klasifikasi Berkembang dan Desa Wisata Klasifikasi Rintisan di Kabupaten Konawe Utara. Hal ini merupakan salah satu upaya yang dilakukan oleh pemerintah dalam meningkatakan taraf hidup masyarakat yang berada di desa bahari tersebut. Metode penelitian yang digunakan adalah deskriptif analisis dengan pendekatan yuridis normatif dan empiris. Adapun hasil penelitian yaitu bahwa peran desa wisata di kepulauan Labenkie sangat membantu dalam meningkatkan kesejahteraan masyarakat Labengki.Kata Kunci: Pariwisata, Desa bahari, Kesejahteraan

Abstract

The Consumer Dispute Resolution Agency (BPSK) was established as a solution to avoid resolving consumer disputes through general courts. Proceeding in the general court takes a long time and costs a lot of money, whereas resolving consumer disputes requires fast and cheap procedural law. Consumer Dispute Resolution Agency Provisions in Law Number 8 of 1999 concerning consumer protection which strictly regulates consumer rights that consumers have the right to correct, clear and honest information regarding the actual condition and guarantee of goods/services, of course the Consumer Protection Law accommodating legal certainty for consumers to obtain the rights to everything they want or buy, so that legal certainty for consumers if they do not get clear and correct information from developers or business actors for consumers who buy a house or place to live can be guaranteed if their rights their rights are not fulfilled .

Abstract

The fourth industrial revolution has brought about major changes in how we live and labor, specifically affecting family dynamics. This abstract explores how families adjust to these changes to maintain productivity and well-being in the digital age. We concentrate on the effects of technology adoption on the labor market and the necessary skills, including automation, artificial intelligence, and the Internet of Things (IoT). Adapting abilities to stay professionally relevant and maintain social-emotional balance in the face of evolving digitally affected interaction patterns is a major problem for families. This study emphasizes how crucial it is for families to adjust quickly in order to acquire new skills and maintain up good communication. We demonstrate how families can prosper in the digital age by effectively adapting. Families that recognize and solve these issues will be able to maintain their well-being in the face of swift global change.

Abstract

Family law is a branch of law that regulates relationships and interactions between family members. Because underlying family law are a number of factors that reflect the complexity and diversity of societies as well as different cultural values throughout the world. This research aims to carry out an indepth analysis of certain aspects of family law, such as regulations on marriage, divorce, child custody or family inheritance. This analysis can include a study of legal developments, comparisons with other legal systems, and evaluation of the effectiveness of implementing regulations, then understanding how social changes and changes in values in society affect family law. The method used is bibliometric analysis with a systematic literature review approach, there are 72 documents originating from Scopus metadata. Family law publications have increased from year to year over a period of 20 years, in 2011 there were 39 publications regarding family law, then they fell again in line with little attention to aspects of family law, from 2015 to the peak in 2020 there were 77 publications which has been published. Factors that cause this are due to social change, technological progress, and the evolution of societal values, social change. Increased awareness of individual rights, especially the rights of women and children, has encourage interest in change and reform of family law and Globalization brings new ideas and cultural influences that can influence the way family law is viewed. Research findings may have limitations in terms of applicability or relevance if laws or policies change. Family law is subject to continuous change and adaptation, particularly in response to changes in society and values. Research may not always be able to capture or respond quickly to changes.
