Abstract

This paper discusses the Prospective Islamic law in Indonesia. The enforcement of Islamic law in Indonesia experienced the ups and downs, ranging from the colonial period with the Government of Indonesia to the Netherlands in order to reform it.In this study it was found that a prospective law of Islam in Indonesia the development of any regime of the Government of Indonesia is experiencing developments. By the Government of Indonesia does not accept or reject the extremes, but instead selectively receive (not the totality) and gradual.Such a step is done for the sake of maintaining the stability and integrity of the country.

Abstract

Although there were differences in the mechanism of enforcement against Human Rights violations or Human Rights crimes among national law (Law Court of Human Rights) and international law (Statute of Rome 1998) between the two jurisdictions, however, have a relationship. Jurisdiction in the Statute of Rome was said to be only as a complement to the jurisdiction of the national law. When there are indications of "unwilling and unable" to national jurisdiction in processing the cases of Human Rights violations which are also regulated in the Statute of Rome, then this is the reason the Roman Statute of the jurisdiction can apply. In addition, previous State should ratify the Statute of Rome became part of national law.

Abstract

Abstract

This research aims to find out how the implementation of the National Program for community empowerment policy-development of socio-economic Infrastructure of the territory (PNPM-PISEW) in Sub district Office Problem and how it impacts the national community empowerment Program-social economic infrastructure development Areas (PNPM-PISEW) towards the implementation of the national program Office policy Sub Masalle. The population in this research is the number of whole populations examined, which include government officials, community leaders and the community around the site or who benefit from the existence of the PNPM-PISEW. While the sample was about 10 (ten) people of the total population using Random Sampling. From the results of research and analysis conducted, it can be drawn the conclusion that the influence of National Community Empowerment Program policies-social economic infrastructure development Areas (PNPM-PISEW), and socio-economic impact of national community empowerment Program-social economic infrastructure development Areas (PNPM-PISEW) in Sub district Office Masalle. Very positive and significant with a score of 4.27. Category Either.

Abstract

The intention contained in laws and regulations concerning the conservation of fish resources is so that there are activities that lead to protection of fish resources as a whole. During this time the utilization of fish resources more dominant done compared to the protection and preservation, so the impact on the aquatic ecosystem. The purpose of this research is to examine international agreements regarding the conservation of fish resources which have been ratified and implemented into other policies and legislation in order to become a guideline in behavior so bring a change in society. This research is a descriptive qualitative using a data source from an earlier study results and document the latest libraries. Results of the study that the conditions of the CCRF (Code of Conduct for Responsible Fisheries) became a legal basis in the formulation of the provisions concerning the management of fish resources responsibly. Sustainable fisheries zone were never regulated in the regulation of the management of conservation areas. The Fisheries Act has yet to implement the provisions of the UN fish stocks agreement of 1995 relating to the conservation and management of fish resources in the ZEE and Indonesia on the high seas. Therefore the Fisheries Act require refinement, considering Indonesia has been a member of two regional fisheries management organization and ratify the UNITED NATIONS Agreement on fish stocks of 1995.

Abstract

  The judiciary and Criminal child who in fact is for the protection and welfare of children as part of social welfare, wants sanctions preferred action instead of criminal sanctions. In other words, criminal sanctions would only be used as a last effort (the last resort). But in fact, these types of criminal sanctions, in particular imprisonment sanctions are still used as a sanction "Prima Donna", both in the formulation of the Act No. 3 of 1997 Concerning juvenile court, as well as in its application by judges in juvenile court. Therefore it needed amending System sanctions set in the Juvenile Court Act.

Abstract

This research aims to know the fulfillment of the rights of the suspect and the defendant the process of criminal justice in the city of Makassar and obstacles faced in giving the law enforcement apparatus fulfillment for the suspect and the accused as the fulfillment of human rights for suspects in Makassar city. Implementation of the fulfillment of the rights of suspects and defendants have done well, especially in terms of rights provides information, right to obtain health services, and the right to get visits. But there are some rights that is still less than optimal due to several obstacles, i.e. the right to legal assistance and the right to conduct worship for suspects and defendants. Constraints faced by the authorities in terms of the fulfillment of the rights of suspects and accused persons referred to in the conclusions of the first is in terms of the fulfillment of the right to legal assistance, the refusal by a suspect, fearing it will cost you, the lack of number of Advocates in Makassar city, led to the granting of legal aid less than optimal, and the lack of Government attention to the legal counselling activities in the home countrys Arrest Class I Makassar. In terms of the fulfillment of the right to conduct worship services, the lack of human resources available either at Police Resort Cities of Makassar and in State Custody Homes Class Makassar that HE was able to furnish the activities become acts of worship in terms of ustadz and clergy unable to attend religious worship activities to fill. And there are a number of suspects and accused persons who do not want to communicate by the apparatus, so it makes the apparatus difficulty experienced in conducting worship rights for the fulfilment of the suspect and the accused.

Abstract

This research aims to know the effectiveness of the law enforcement against criminal cases in the general election for mayor of the city as well as the factors which affected analysis in this study using the method of the qualitative nature of the approach, that approach with a way to learn, pay attention to the quality and depth of the data obtained. After data analysis is finished, the results will be presented in a descriptive, i.e. with speak and describing what it is in accordance with the problems examined. The effectiveness of the law enforcement against criminal cases in the general election for mayor of the city is still very weak. The mechanism of reporting, and discussion of the results of the report on the level of integrated law enforcement (Gakkumdu), as well as the report of the examination to find out the criminal element in violation of 2005, Makassar city thus increasingly adds to the complicated handling of the crime in 2005. Factors that affect the police in tackling and dealing with criminal acts in 2005, in the city of Makassar is the length of the process of examination of an alleged criminal offence occurrence in 2005, has been with the examination report having to wait for the outcome of the recommendations of the report are Gakkumdu can be forwarded at the stage of investigation or not.

Abstract

Lower levels of educational institutions from primary schools to the very top level that universities are the institutions that are oriented non-profit or public sector. Where the institution is also required to have adequate accounting systems in order to provide information about the activities of the entire organization to stakeholders. This paper aims to explore further, starting from the rules of what is used in the preparation of the accounting system of the institution, the purpose of reporting, sources of funding and educational characteristics of the accounting system until the review journals related to the accountability of higher education institutions.
