Abstract

Land right control under customary law that was communal religious in nature tend to control insecular individual manner despite being controlled by the customary law. Land right registrationis motivated more by intention to transfer the land right. These two conditions may result inconflict and affect the conflict settlement. The land right registration in the context of AgrarianLaw can unintentionally result in conflict due to ignorance of the process in the customary law,or the land right is controlled using the ownership pattern as of Agrarian Law context. Thesettlement of such conflict can be done through non-litigation or litigation manner, but litigationis preferred since it is considered to give legal certainty.Key word: Land Tenure, Conflict Implication

Abstract

Penal mediation is a process of extra judicial settlement for criminal case. The application ofpenal mediation on criminal law is to give the justice and protection to the victims of which it isnot accommodate by legality aspect in Indonesia criminal law. The existence of penal mediationprinciple with legal certainty affect the domestic violence (KDRT). The inconsistence continueswhen the penal mediation process relevance is applied to serious domestic violence that violate thehuman rights. The legality principle and human rights must be aligned with the penal mediationprinciple associated with domestic violence (KDRT) to reach ideal justice in the substance ofvictim protection in the domestic violence law, and in general the alignment of the new substancein Indonesian Criminal Code (KUHP) to protect the values and spirit of Indonesian country.Key word: penal mediation principle, legality, domestic violence ( KDRT), HumanRights

Abstract

Man is basically a creature of God who has relation (through worship) to God (fardhu a’in) and relation to other creatures as social beings (fard kifayah). This dual relationship will as consequence make a various instruments of what-the-so-called Legal Pluralism. The Legal Pluralism in human life is a bind positioning the human to commit with what are contained in each instrument, even though the instruments are mostly abstract and are only dialectical symbols that have a strong energy leading the physical nd spiritual side of human to obey the God and to do anything on behalf of the “theological and Social Faith” in order to obtain the physical and spiritual peace. To achieve those needs , human his life as a creature implement the legal pluralism, which is believed to serve as an investment in order that his dual function of creation remain maintained and qualified. The instance of this is the implementation of legal pluralism in the procession of “Merariq” (Marriage) in indigenous people the Lombok Sasak tribe. In that procession, three laws are implemented; religious teaching, traditional law, and State law all of which are integratedly applied in the process (3 in 1). Abstract

Indonesia is well known as a multicultural country in Southeast Asia in term of its ethnic,religion, racial and social stratification. It is Unity in Diversity, which is reflected in the officialmotto of the State to describe the social and cultural diversity of Indonesia. The diversity refers to a cultural configuration which reflects the National identity of Indonesia, containing cultural capital and cultural power. However, cultural diversity yields conflict that could potentially generate social disintegration due to inter-ethnic and inter-religious disputes that may result in the disintegration of Indonesia as a Nation State. In the eyes of legal anthropologists, sources of conflicts are based on discriminatory policies expressed within State’s law and legislations in line to the recognition and protection the existence of local communities, namely traditional adat communities spread out in the region. Thus, State laws enacted and enforced by the Government tend to dominate and marginalize as well as ignore the rights of the local communities particularly over access and control natural resources they based on customary adat law in the region. The paper attempts to offer an answer to the fundamental question whether the 1945 Constitution recognise and protect the traditional communities and their customary adat law by employing a legal anthropological approach with the purpose of obtaining a better understanding regarding the development of State lawin a multicultural Nation toward a more just and equitable State law of Indonesia.Keywords : Multicultural, Unity in Diversity, Conflict, Anthropological Approach

Abstract

Economy and moral rights are the part of basic human rights entitled to the proprietor of theintellectual property that must be full filed by the state, to meet the requirements of Constitution.Similar treatment must be provided by the state to economic and moral rights of indigenouspeoples on their own Intellectual Property, in the form of Traditional Knowledge and TraditionalCultural expressions as described in Article 18 b of the Constitution of 1945 “The state recognizesand respects the customary law community units including their traditional rights as long as itexists and in accordance to society development and principles of Unitary State of The Republicof Indonesia, as stated by the Law.”. Fulfilment of these rights through modern TRIPs-WTOIPRs regime brings about legal problems, considering their different character, where individualand commercial character of modern IPRs contradicts the communal and non-commercialcharacter of Traditional Knowledge and Traditional Cultural Expression. On the other hand,to get modern IPRs protection, Traditional Knowledge and Traditional Cultural Expressionmust meet particular conditions such as originality/ novelty, inventive step and applicable toindustry which indeed unable to fill due to its anonymous inventor, developed and bequeathedfrom generation to generation and is not intended specifically for industrial/commercial purpose.Keywords: Rights, Indigenous Peoples

Abstract

Indonesia is the country that believes in God and having a philosophy of divinity, therefore, thetranquility of religious life is of a legal matter as well as public interest that should be protected.Therefore , since the legal protection on the legal matter is for all citizens, the stipulation of religionoffense must be regulated and protected within criminal law. Based on the above consideration there are several problems to be formulated. These are what is the formulation policy of the available criminal law in overcoming the religious offense. And, how the formulation policy of criminal law in the future in overcoming of religious offense in terms of the renewal of criminal law in Indonesia ?. This research is an analytical descriptive research with normative juridical approach. The data is a secondary data derived from primary, secondary, and tertiary law materials that are obtained through bibliography and documentary studies from secondary data that have been analyzed. The research concluded that a criminal law that is currently used to overcome religious offense is Criminal Code (KUHP) but still with several weaknesses that this offense is considered as the crime over public interest. There is disharmony between status and explanation of offense by either text or formulation. The religious offense within Criminal Code concept 2005 is formulated as Criminal Act for religion and relating to either religion or religious life. The formulation of criminal law in the future should consider the integrating of religion offense in Criminal Code concept 2005 by considering several things as follows: 1). harmonization of criminal act matter, 2). formulation policy of criminal responsibility, and 3) formulation policy of criminal and criminalizing systems.Keywords : Formulation Policy, Religion Offense, and Law Renewal

Abstract

Penelitian ini ditujukan untuk mengeksplorasi apa saja permasalahan hukum dalam penyelesaian sengketa komersial yang melibatkan pemerintah melalui arbitrase internasional. Penelitian ini merupakan penelitian yuridis-normatif. Oleh sebab itu, penelitian ini menggunakan beberapa pendekatan, yaitu pendekatan perundang-undangan (statute approach), pendekatan konsep (conceptual approach), dan pendekatan kasus (case approach). Penelitian ini dilakukan melalui studi kepustakaan terhadap dokumen peraturan perundang-undangan, berbagai putusan pengadilan, buku literatur, dan jurnal hukum yang berkaitan dengan penyelesaian sengketa kontraktual pemerintah melalui arbitrase. Hasil penelitian ini bersifat deskriptif-analitis. Analisis data dilakukan secara kualitatif. Hasil penelitian menunjukkan bahwa keterlibatan Pemerintah RI dalam penyelesaian sengketa kontraktual melalui arbitrase komersil internasional telah memunculkan beberapa permasalahan hukum, diantaranya: a) Negara melalui Undang-Undang Perseroan Terbatas berpotensi mengebiri yurisdiksi Dewan Arbitrase ICSID untuk menyelesaikan sengketa mengenai penanaman modal asing antara negara dengan investor dari negara lain; b) Dalam beberapa kasus terlihat peradilan menghalang-halangi pelaksanaan putusan arbitrase asing apalagi jika pelaksanaan putusan arbitrase tersebut secara nyata-nyata akan merugikan Negara atau Pemerintah Republik Indonesia sebagai salah satu pihak dalam putusan arbitrase tersebut; c) Keterlibatan perusahaan negara dalam kontrak-kontrak komersil seringkali berujung pada pelibatan negara berhadap-hadapan secara langsung dengan swasta asing dalam sengketa di hadapan peradilan asing; dan d) Keengganan perusahaan negara melaksanakan putusan arbitrase asing secara sukarela berpotensi membuat segala bentuk asset negara yang berada di luar negeri dipertaruhkan untuk memenuhi tuntutan ganti rugi investor asing.

Abstract

This research aims to study the application of the article 49 letter (i) of Law No, 3/2006 towardthe Competence of Religious Court within the shariah economy field, to study the settlementmechanism for shariah economy disputes in Religious Court as well as to analyzes theapplication of the article 49 letter (i) of Law No. 3/2006 in Religious Court rulings relating toshariah economy cases. This research uses three (3) approaches; firstly, statute approach is anapproach that studies statutes and regulations relating to the authority of Religious Courts tosettle the shariah economy disputes; second, conceptual approach is an approach that studieslegal concepts and legal experts opinion relating to the syariah economy disputes; and the third,case approach is an approach that studies the religious court’s rulings that have permanent legalpower relating to shariah economy cases. This research comes to conclusion that the article 49letter (i) of Law No. 3/2006 has widely been implemented. Abstract

Child is an integral part of human survival and the survival of a nation. The strategic role ofchildren is explicitly stated as those mentioned as the statement that the state guarantees theright of every child to live, grow and develop, and to be protected from violence and discrimination, therefore the best treatment for them should be considered as the best treatment all mankind. Imprisonment provided through the formal criminal justice system does not effectively deter child criminals. That even made the growth and development as well as psychological state of the child be disturbed by the sanctions. Therefore, it is necessary to reform the criminal justice system by applying the concept of restorative justice which, in solving the problem, involve the perpetrators, victims, families perpetrator/victim and other relevant parties to work together to find a fair settlement with emphasis on restoring back to its original state and not retaliation. Philosophical consideration should be based on the best treatment for children, and juridical basis to achieve legal certainty with settings based on justice and expediency to ensure child protection. Diversion is the diversion to remove the criminal justice process into the outside of the criminal justice process. So in any investigation law enforcer shall seek diversion through the application of restorative justice. Diversion mechanism starts from the later stages of investigation and subsequent prosecution and in the trial.Keywords: Children, Restorative Justice and Diversion.

Abstract

Shariah banking is a business institution that conducts intermediary function or an agentbetween capital/money-owner and customers requiring capital for financing activities. In theimplementation of that function, potential conflict or dispute with the customer may occur andto overcome such dispute, a set of settlement method is required. The Article 55 of Law Number 21 of 2008 concerning Shariah Banking provides options for dispute settlement namely litigation or religious court and extrajudicial (non-litigation) based on the agreement of both parties. The settlement via the religious court is authorized by the law and set forth under Article 49 of Law Number 3 of 2006 concerning the absolute authority of the religious court to investigate, decide and settle Shariah Banking dispute. Whereas, non-litigation method is also regulated in Law Number 30 of 1999 concerning Arbitration and Dispute Settlement Alternatives whose rulings are final and binding. This model of settlement may be carried out through Deliberation, Banking Mediation or the National Shariah Arbitration Body depending on the contract and agreement entered into by both parties. Principally, religious court does not hold the authority to investigate any case that contain arbitration clause. However, the absolute authority will apply when the parties request it through their actual appearance before the court that it automatically nullifies the arbitration clause.Keywords: Shariah Banking, Dispute, Litigation, Religious Court and Non-Litigation
