Abstract

Land right control under customary law that was communal religious in nature tend to control insecular individual manner despite being controlled by the customary law. Land right registrationis motivated more by intention to transfer the land right. These two conditions may result inconflict and affect the conflict settlement. The land right registration in the context of AgrarianLaw can unintentionally result in conflict due to ignorance of the process in the customary law,or the land right is controlled using the ownership pattern as of Agrarian Law context. Thesettlement of such conflict can be done through non-litigation or litigation manner, but litigationis preferred since it is considered to give legal certainty.Key word: Land Tenure, Conflict Implication

Abstract

The freedom of religion guaranteed by the State can lead to the possibility of a person converting or changing religions from one religion to another. According to Balinese traditional inheritance law, changing religions can affect a child as an heir. Based on this background, this research was conducted with the aims of describing the position of a child as heir who changed religion from Hinduism and outlining the legal consequences for a child as the heir who converted and then returned to Hinduism. The research method used was a normative research method with a statutory approach that used primary, secondary, and tertiary legal materials which were supported by the results of interviews and then analyzed. The results showed that the rank of children as heirs who converted from Hinduism legally no longer had rights and obligations towards their parents, relatives and society. Meanwhile, the legal consequence for children as heirs who change religions is the loss of the child's rights because they are unable to carry all the obligations that will be passed on by their parents and are considered disobedient to their parents and ancestors. However, with the return of the child to Hinduism, all rights and obligations that were previously abandoned can be accepted back with certain conditions agreed upon by the family concerned.

Abstract

The patrilineal descent system, as is also the case in the indigenous Balinese, has the consequence that the heirs in Bali are determined according to the male lineage (purusa). However, it is also possible for women to be appointed as heirs, that is, in the case of the girl being appointed as a sentana rajeg or the status of a girl is changed from predana to purusa status. Based on the background of this research problem formulation as follows: how is the obligation for the manners of Balu Luh in the Suter Bangli Customary Village and how the authority of the manners for the inheritance of her husband. The type of research used is empirical legal research. The results of this research discussion are as follows: Obligations for manners in the village of Suter Bangli, among others, take care of the inheritance of her deceased husband well, behave well, enforce discipline, obey the obligations, carry out obligations, panca yadnya and others, which are then referred to as her husband's legacy properly balu pageh, the widow's right as long as only enjoying it can not sell, give, and give it to others except with the consent of her children and the family of her late husband if her children are still small. This applies to heirlooms and riches (marriage assets), because for heirlooms, a widow does not have any rights, the right is the purusa of the family of her deceased husband, but the widow has the right to enjoy it if the widow is pageh. The authority of the courtesy of her husband's inheritance includes: Maintaining the integrity of the family, not doing things that are not good, so that it can be called a shame. No authority to sell, transfer the assets left by her late husband. May ask for children / sentana, but with the consent of the family of the late husband. May also remarry with the approval of the family of the late husband.

Abstract

The position of the Customary Village as a customary legal alliance, has the authority and obligation to control, regulate and manage all the land belonging to the Customary Village within the Customary Village area as customary rights. In entering into an agreement to lease customary land with another party, Desa Adat has the right to land in terms of granting permits based on agreements made by both parties. Agreements that have been agreed should be accountable so as not to lead to defaults in the future. The method used in this research is the empirical method, by reviewing the statutory procedures that apply in making lease agreements for customary land and using a sociological problem approach to social law relating to legal norms both in legislation and in awig-awig. In PERDA Number 4 of 2019 concerning Customary Villages in Bali regulates the duties and authority of the Customary Villagers in maintaining the economy of the village, so that they are authorized to carry out legal actions (agreements) especially lease agreements for customary land provided they have fulfilled the requirements of the shah. An agreement can be regulated in article 1320 Civil Code. Whereas regarding the application of sanctions for parties who defaulted in the lease agreement on customary land, it was given to those who violated the agreement based on the agreement of the village paruman. Where the sanctions can be resolved based on positive law in Indonesia, namely through the judicial process.

Abstract

Tesis ini difokuskan secara konfrehensif mengenai plagiasi hak cipta karya seni rupa di Bali menurut Undang-Undang Republik Indonesia Nomor 28 Tahun 2014 Tentang Hak Cipta. Dalam tesis ini membahas dua masalah yakni pertama, bagaimanakah pelaksanaan dan perlindungan hukum hak cipta karya seni rupa di Bali dan kedua, bagaimanakah penegakan hukum terhadap pelanggaran hak cipta karya seni rupa di Bali. Empat teori hukum dipergunakan yakni (1) Teori Kepastian Hukum, (2) Teori Perlindungan Hukum, (3) Teori Keadilan Hukum dan (4) Teori Sistem Hukum. Relevansi empat teori hukum yang digunakan sebagai pisau analisis. Hasil tesis yakni: dalam Hak Cipta terdapat dua hak yang melekat, yaitu Hak Ekonomi dan Hak Moral. Kasus plagiat atau plagiasi terhadap hak cipta karya seni rupa di Bali lebih mengarah kepada pelanggaran terhadap Hak Moral Pencipta. Penegakan hukum dan perlindungan terhadap Hak Cipta lebih mengutamakan kepada pelaku pelanggaran karya cipta seni rupa di Bali yang membuat dan yang mendistribusikan ketimbang pengguna perseorangan. Plagiat terhadap karya cipta seni rupa di Bali tidak hanya terbatas pada karya ilmiah dan obyek hak cipta lainnya tetapi juga kepada Hak Paten dan Merk. Kata kunci: Plagiasi, Hak Cipta, Karya Seni Rupa.

Abstract

Isi rumusan awig-awig desa adat tidak hanya sekedar rangkaian kata yang berisi norma terhadap petunjuk hidup tentang apa yang boleh dan tidak boleh dilakukan dan sehrusnya ditatai, karena terhadap penyimpangannya dapat dikenai reaksi yang disebut sanksi. Oleh karena itu isi rumusan awig-awig wajib disosialisasikan agar semua warga tahu isi dan maknanya, karena tidak jarang warga masyarakat tidak tahu tentang awig-awignya apalagi memahaminya. Selain itu tidak semua warga dapat mengerti tentang tata bahasa yang yang digunakan dalam awig-awig terutama generasi muda. Oleh karena itu kegiatan sosialisasi sangat penting dilakukan dengan tujuan menjaring masukan dan pendapat sebelum awig-awig disahkan. Selain itu juga dimaksudkan agar semua warga masyarakat sejak awal tanggap dan menghormati hasil penyuratan awignya sendiri karena telah memiliki nilai keberlakuan sosiologis, filosofis, dan yuridis. Abstract

Penelitian ini bertujuan menggali dan menginventarisasi potensi desa untuk dikembangkan sebagai Daerah Tujuan Wisata (DTW) baru berbasis masyarakat dalam kemasan Desa Wisata dan dikelola secara melembaga dalam konsep koeksistensi. Melalui pola koeksistensi terhadap potensi spiritual dengan potensi sekuler akan diciptakan spirit keseimbangan dalam program pembangunan baik jangka pendek, menengah maupun jangka panjang. Penelitian ini menganalisis hak pengelolaan potensi desa terintegrasi dengan pemberdayaan masyarakat sebagai desa wisata untuk meningkatkan kesejahteraan masyarakat. Metode penelitian yang digunakan, yaitu penelitian hukum empirik dengan pendekatan perundang-undangan, analitik, kasus, dan pendekatan antropologi hukum. Inovasi pengembangan DTW berbasis potensi desa seperti Pura Amertajati yang dikemas dalam desa wisata dapat berimplikasi pada pemeliharaan dan pelestarian sumber daya alam yang akan memberi manfaat ekonomi bagi masyarakat secara berkelanjutan. Oleh karena itu sejak awal perlu dilakukan penguatan hubungan antar kelembagaan yang ada untuk menghindari persaingan seperti pengempon Pura, warung kuliner, parkir, home stay.

Abstract

ABSTRAKIklan layanan kesehatan masyarakat (ILKM) cenderung bertujuan untuk memberikan informasi, mengingatkan, menambah nilai, mempengaruhi, dan bahkan mengubah sikap masyarakat untuk hidup sehat. Namun tidak banyak iklan layanan kesehatan masyarakat bersifat persuasif sehingga tidak cukup berkontribusi maksimal dalam mengajak masyarakat untuk hidup sehat. Oleh karena itu di dalam penelitian ini, iklan layanan kesehatan masyarakat yang cukup sering ditayangkan di media televisi menarik untuk diteliti karena memiliki karakteristik berbeda. Tujuan dari penelitian ini yaitu untuk mengetahui bagaimana gaya bahasa, makna, dan ideologi iklan layanan kesehatan masyarakat (ILKM). Hasil penelitian ini menunjukan bahwa; Gaya bahasa Iklan Layanan Kesehatan Masyarakat (ILKM), secara diksi atau pilihan kata yang digunakan cenderung bersifat tak resmi, bentuknya umum, singkat dan dapat dipahami oleh masyarakat terpelajar biasa. Dilihat dari sudut nada yang terkandung, narasi teks memiliki gaya bahasa sederhana, biasanya cocok untuk memberi instruksi, perintah, pelajaran, perkuliahan, dan sejenisnya; seperti ujaran yang disampaikan singkat, padat dan jelas, dan bernada himbauan. Dari sisi makna, secara semiotik pemaknaan muncul dari hubungan antara penanda (signifier) dan petanda (signified). Pemaknaan yang muncul dari hubungan tersebut merupakan pemaknaan konotasi. Ideologi yang melatarbelakangi tayangan Iklan Layanan Kesehatan Masyarakat (ILKM), bersumber pada konotasi yang dihasilkan. Penyampaian secara imperatif dan pemakaian simbol, warna, latar temperatur (tanda) seperti termometer misalnya, realisasi makna yang mendominasi adalah makna yang mendekati kewaspadaan dan bahaya bagi kesehatan, seperti warna kuning, putih, dan merah, di samping juga ada warna-warna lain. Hasil penelitian ini menemukan bahwa ILKM berkenaan dengan kebersihan, kesehatan, kewaspadaan, kehati-hatian, kepedulian, kebersamaan, perencanaan, kesejahteraan, dan kebahagiaan.Kata kunci: ILKM, gaya bahasa,makna, ideologiABSTRACTPublic health service advertisements (PHSA) tend to provide information, remind, add value, influence, and even change people's attitudes to healthy living. However, not many public health service advertisements are persuasive, so they do not contribute enough to encourage people to live healthy lives. Therefore, in this research, public health service advertisement which is quite often aired on television media interesting to be examined since it has different characteristic. The purpose of this study was to determine the style of language, meaning, and public health service advertising ideology. The results of this study showed that; The Public Health Service Ads (PHSA) language style, diction or word choice used tends to be informal, general, brief and understandable by ordinary learned societies. Regarding the tone contained, the narrative text had a simple language style, usually suitable to give instructions, commands, lessons, lectures, and the like such as speech delivered briefly, solid and clear, and appealed. From the meaning point of view, semiotic meaning came from the relation between signifier and signified. The meaning that emerged from the relationship was the meaning of connotation. The ideology that lied behind the impressions of Public Health Service Ads (PHSA), sourced from the resulting connotation. The way to express imperatively as well as the use of symbols, colors, backgrounds (sign) such as thermometers; for instance, the realization of meaning that dominated was the meaning of approaching alertness and danger on health, such as yellow, white, and red, in addition there were other colors. This has determined that PHSA concerned with hygiene, health, precautions, caution, caring, togetherness, planning, prosperity, and happiness.Keywords: PHSA, language style, meaning, ideology

Abstract

ABSTRAKASI merupakan nutrisi terbaik bagi bayi selama 6 bulan pertama kehidupan mereka. Meskipun demikianpraktik pemberian ASI eksklusif masih rendah. Keberhasilan dalam memberikan ASI pada bayi dipengaruhioleh pentingnya dukungan sosial orang terdekat, terutama dari suami. Pengetahuan mengenai masalahmasalahyang berkaitan dengan menyusui merupakan hal pertama yang harus dimiliki ayah agar dapatmemberi pengaruh pada praktik pemberian ASI. Penelitian ini bertujuan untuk mengetahui hubungan antarapengetahuan ayah dan breastfeeding father terhadap pemberian ASI eksklusif di wilayah kerja PuskesmasMengwi III. Penelitian ini dilakukan di wilayah kerja Puskesmas Mengwi III pada bulan Maret sampaidengan April 2018 terhadap 59 bapak/suami yang memiliki anak umur 6-12 bulan. Penelitian inimenggunakan metode kuantitatif dengan pendekatan studi Cross Sectional, dianalisa secara deskriptif danbivariat. Analisis bivariat menggunakan uji chi square (α=0,05). Hasil penelitian menunjukkan adahubungan yang signifikan antara pengetahuan ayah dan breastfeeding father terhadap pemberian ASIeksklusif di wilayah kerja Puskesmas Mengwi III. Dimana hasil uji statistik tentang pengetahuanmenunjukkan nilai prevelensi rasio sebesar 5,868 dengan nilai p value =0,015 dan hasil uji statistik tentangbreastfeeding father menunjukkan nilai prevalensi rasio sebesar 4,069 dengan nilai p value =0,044.Kata kunci: ASI Ekslusif, Pengetahuan, Breastfeeding FatherABSTRACTBreastmilk is the best nutrition for the babies during their first 6 months, despite knowing the clear benefit ofexclusive breastfeeding, the practice exclusive breastfeeding is still low. The Success in providingbreastmilk for babies influenced by the importance of social support, especially from husband. Theknowledge of breastfeeding issues is a matter for father to have in order to influence the practice ofbreastfeeding. The aim of the study was to determine the relationship between knowledge and father’s role inexclusive breastfeeding practice in Puskesmas Mengwi III. This study was conducted at Mengwi III PublicHealth Center on Maret until April 2018 of 59 father/husband who had children aged 6-12 months. Thisresearch used quantitative method with Cross Sectional study approach, the descriptive and bivariateanalysis. Bivariate analysis using chi square test (α = 0,05).The results showed significant associationbetween knowledge and father’s role as breastfeeding father in exclusive breastfeeding practice inPuskesmas Mengwi III. The results of knowledge show the prevalence ratio 5,868 and p value=0,015. Theresults of father’s role show the prevalence ratio 4,069, p value =0,044.Keywords: Exclusive Breastfeeding, Knowledge, Breastfeeding Father
