Abstract

The research aims to study the aspect of the contract law reform within the virous regulations living in Indonesia. To obtain the purpose, the research is conducted through a legal normative study. It simultaneously applies to statute, conceptual, and case approaches. This research is conducted through a literature study towards the relevan legal materials. The results of the research elaborated in a descriptive and analytic way using qualitative methods to analyze the data. The research discovers that the norms of Contract law as stipulated in the Book III of Indonesian Code Civil have been gradually and continuously reformed by Indonesian governments since 1960. The reform is carried out partially and spread in various regulation as explained above. Therefore, nowadays in Indonesia, the contract law not only exists in the Book III of Indonesian Code Civil but also in various relevant regulations. The reform has been conducted by the government by breaking through one of the very basic principle and the backbone of contracts law, is that the freedom of contract. As a result, parties in contract have no more absolute freedom to contract or to determine the clauses of contract. Such policy made by government to protect public interest and inferior or subordinate party in a contract. Thus, the contract law nowadays shows that it is not purely private anymore but containing public aspect, where penal and administrative laws penetrate to it. Abstract

The research aims to study legal issues that appear within the government contractual disputeresolution through international commercial arbitration. The research is a legal normative.Therefore, it simultaneously applies to statute, conceptual, and case approaches. This literature research is conducted towards regulations, court decisions, legal books and legal journals that relate to the government contractual dispute resolution through international commercial arbitration. The results of the research elaborated in a descriptive and analytic way using qualitative methods to analyze the data. The research discovers that the presence of the government before the international commercial arbitration to settle disputes with foreign investors brought up some legal issues. Among others these are: a) state (government), through the law of limited company, this potentially reduces the jurisdiction of the ICSID Centre to settle foreign investment disputes between state and foreign investors; b) Courts as shown in some cases, block the enforcement of the foreign arbitration award which inflicts financial loss for state (government); c) the involvement of a state legal entity (state enterprise) ends in the engagement of state (government) as parties within the foreign investment dispute face to face with investors in front of a foreign justice court; and d) the unwillingness of state enterprise to perform the foreign arbitration award makes state assets overseas vulnerable to be confiscated by foreign investors as collateral in their claim for damages.Key Words: Government Contract, Contractual Dispute, Dispute Resolution, InternationalCommercial Arbitration.

Abstract

Penelitian ini ditujukan untuk mengeskplorasi aspek pembaharuan hukum kontrak dalam berbagai peraturan perundang-undangan di Indonesia. Untuk mencapai tujuan tersebut, penelitian ini dilakukan dalam bingkai penelitian yuridis-normatif. Penelitian ini menggunakan beberapa pendekatan, yaitu pendekatan perundang-undangan (statute approach), pendekatan konsep (conceptual approach), dan pendekatan perbandingan (comparative approach). Penelitian ini dilakukan melalui studi kepustakaan terhadap berbagai bahan hukum yang relevan. Hasil penelitian ini bersifat deskriptif-analitis. Analisis data dilakukan secara kualitatif. Hasil penelitian menunjukkan bahwa norma hukum kontrak sebagaimana yang diatur dalam Buku III KUHPerdata telah diperbaharui oleh pemerintah secara bertahap dan berkesinambungan sejak tahun 1960. Pembaharuan itu dilakukan secara parsial dan tersebar melalui berbagai macam peraturan perundang-undangan sebagaimana yang telah diuraikan di atas. Sehingga, hukum kontrak di Indonesia sekarang ini bukan hanya ada dalam Buku III KUHPerdata tetapi juga ada dalam berbagai peraturan perundang-undangan yang relevan. Pembaharuan itu dilakukan oleh pemerintah dengan menerobos asas kebebasan berkontrak yang menjadi tulang punggung hukum perjanjian sehingga para pihak tidak lagi memiliki kebebasan penuh dalam berkontrak atau untuk menentukan isi perjanjiannya. Hal itu dilakukan oleh pemerintah atas dasar kepentingan umum dan melindungi pihak yang mempunyai kedudukan yang lemah dalam kontrak. Dengan demikian, hukum kontrak kini bercorak tidak lagi murni bersifat keperdataan tetapi mengandung aspek hukum publik, dimana aspek hukum pidana dan hukum administratif telah mewarnai dan masuk di dalamnya.

Abstract

Undang-undang Nomor 13 Tahun 2003 tentang ketenagakerjaan memberikan peluang dan kemudahan bagi perusahaan untuk melakukan efisiensi baik managemen maupun financial melalui penerapan sistem ketenegakerjaan outsourcing. Abstract

Penelitian ini ditujukan untuk mengeksplorasi apa saja permasalahan hukum dalam penyelesaian sengketa komersial yang melibatkan pemerintah melalui arbitrase internasional. Penelitian ini merupakan penelitian yuridis-normatif. Oleh sebab itu, penelitian ini menggunakan beberapa pendekatan, yaitu pendekatan perundang-undangan (statute approach), pendekatan konsep (conceptual approach), dan pendekatan kasus (case approach). Penelitian ini dilakukan melalui studi kepustakaan terhadap dokumen peraturan perundang-undangan, berbagai putusan pengadilan, buku literatur, dan jurnal hukum yang berkaitan dengan penyelesaian sengketa kontraktual pemerintah melalui arbitrase. Hasil penelitian ini bersifat deskriptif-analitis. Analisis data dilakukan secara kualitatif. Hasil penelitian menunjukkan bahwa keterlibatan Pemerintah RI dalam penyelesaian sengketa kontraktual melalui arbitrase komersil internasional telah memunculkan beberapa permasalahan hukum, diantaranya: a) Negara melalui Undang-Undang Perseroan Terbatas berpotensi mengebiri yurisdiksi Dewan Arbitrase ICSID untuk menyelesaikan sengketa mengenai penanaman modal asing antara negara dengan investor dari negara lain; b) Dalam beberapa kasus terlihat peradilan menghalang-halangi pelaksanaan putusan arbitrase asing apalagi jika pelaksanaan putusan arbitrase tersebut secara nyata-nyata akan merugikan Negara atau Pemerintah Republik Indonesia sebagai salah satu pihak dalam putusan arbitrase tersebut; c) Keterlibatan perusahaan negara dalam kontrak-kontrak komersil seringkali berujung pada pelibatan negara berhadap-hadapan secara langsung dengan swasta asing dalam sengketa di hadapan peradilan asing; dan d) Keengganan perusahaan negara melaksanakan putusan arbitrase asing secara sukarela berpotensi membuat segala bentuk asset negara yang berada di luar negeri dipertaruhkan untuk memenuhi tuntutan ganti rugi investor asing.

Abstract

This research aims to normatively study and analyze the government’s obligation to make spatial planning and land use management; and also to review and analyze the legal conception of spatial planning and land use management in accordance with the legislations existing in Indonesia. This study is normative, i.e. a research which examines the fundamentals/principles of law, review the norms and legal concepts regulating spatial planning and land use management. This research applies normative approach; there are statute approach, conceptual approach, and comparative approach. It uses library resources which consist of primary, secondary, and tertiary legal materials. The research discovers that government is required to establish spatial planning and land use management on the basis of philosophical, juridical, and empirical foundations. Furthermore, spatial planning is a process to determine the spatial structure and pattern which covers the arrangement and establishment of the spatial plan. While the land use management is a pattern of the land use management which covers possession, use and utilization of land which constitute land use consolidation through institutional arrangements associated with the use of land as an integrated system for the benefit of a fair society. Spatial planning and land use management is an integral and inseparable, as land use management is part of the spatial plan, so that they are actually under the same legal basis. This research recommends that spatial planning and land use management should fully be committed to create the spatial and land utilization and also natural resources effectively and efficiently.

Abstract

The research aims to study the competence of the District Court of Central Jakarta to annul the arbitration award of Geneva, and whether the judgment of the District Court of Central Jakarta annulling the arbitration award of Geneva is relevant to the existing law of arbitration in Indonesia. The research is juridical normative, i.e., using library research to obtain secondary data in the field of law and using field research for support. Therefore, it uses two types of data: primary data from interview with resource persons and secondary data from library research by means of document study on the primary, secondary, and tertiary legal materials. It uses qualitative method to analyze the data. The research reveals, according to the Arbitration Law No. 30 of 1999, Regulation of the Supreme Court No. 1 of 1990, Rules of International Centre for Settlement of Investment Disputes, and New York Convention 1958, that the District Court of Central Jakarta has no competence to annul the arbitration award of Geneva. The use of public policy as ground for annulment of arbitration award of Geneva by Forum of District Court of Central is not correct because public policy is not found, ether in Rules of International Centre for Settlement of Investment Disputes or New York Convention 1958, as ground for annulment of arbitration award. Besides, public policy provided in the Arbitration Law No. 30 of 1999, Regulation of The Supreme Court No. 1 of 1990, and New York Convention 1958 is not related to the annulment of international arbitration award but the refusal and enforcement of international arbitration award. Nevertheless, Forum Court's interpretation toward public policy is correct because such interpretation is not based on assumption but on the fact that the enforcement of arbitration award of Geneva violates the Presidential Decree No. 39 of 1997 and No. 5 of 1998, as well as the monetary crisis threatening Indonesian prosperity.

Abstract

Penelitian ini bertujuan menemukan keberadaan konflik penyerobotan tanah terlantar oleh masyarakat, faktor yang menyebabkan terjadinya konflik penyerobotan tanah terlantar dan akhirnya mengetahui peran BPN dalam menyelesaikan konflik penyerobotan tanah terlantar oleh masyarakat di wilayah kerja BPN Lombok Barat. Disamping itu, penelitian ini juga bertujuan untuk menemukan dan menganalisis peran BPN dan model penyelesaian konflik penyerobotan tanah terlantar oleh masyarakat di wilayah kerja di BPN Lombok Barat. Metode dalam penelitian ini adalah metode penelitian hukum empiris. Hasil penelitian ini menunjukkan bahwa tidak ada satupun dari tanah yang ditinggalkan oleh pemegang hak (investor) sebagai tanah terlantar. Tanah-tanah hak tersebut baru hhanya berstatus sebagai tanah yang terindikasi terlantar. Kasus penyerobotan tanah oleh masyarakat terjadi di berbagai lokasi. Akan tetapi, kasus penyerobotan tanah dan berujung pada konflik dengan investor namun belum dilaporkan kepada BPN Lobar baru satu, yaitu dalam kasus PT. Mekaki Indah. Adapun kasus penyerobotan tanah oleh masyarakat yang berujung pada konflik dan telahh dilaporkan ke BPN Lobar juga satu kasus yaitu dalam kasus PT WAH di Gili Terawangan. Ada beberapa faktor yang menyebabkan terjadinya konflik tersebut. Pertama: karena adanya konflik kepentingan dalam mengeksploitasi dan menguasai tanah. Masyarakat butuh tanah untuk keperluan bisnis. Kedua, masyarakat mengangggap bahwa tanah yang dikuasai oleh investor merupakann hak milik nenek moyang mereka. Disamping itu, peluang ekonomis juga menjadi salah satu penyebab terjadinya penyerobotan tanah oleh masyarakat.

Abstract

This research tries to find out and analyze: factors which bring about dispute or conflict within the making use of water resources in the sub-district of Batulayar and also its settlement. This research discovers that the possession of water resources in Batulayar is on state hand through the public work office (agency) of west Lombok and technically executed by the doorman of the main water dam which locates in the forest area of Pusuk. In relation with its distribution, the doorman of the main water dam refers to the agreement among and the request of Pekaseh (the distributors of water). Yet, however, there is always factor bring about conflict, which finally leads to dispute. Up to now, still, the dispute of water resources in the sub-district of Batulayar can always be settled through non-litigation mechanism.
