The combination on presidential system and multi-political parties, in its practice cannot lead to the formation of a strong government, but rather this lead to the anomaly presidential system and being trapped in the parliamentary system.

Abstract

In the practical aspect, legal enforcement in Indonesia is still facing a controversy in terms of how a just verdict should be. The said controversy rooted deeply in the differences in the understanding towards the concept of normative law and the concept of progressive law. In the fact, most of legal apparatuses are still confined in normative law as a parameter of the verdicts that they conclude. On the other hand, from progressive law point of view, the existing legal norms are considered for not being a true reflection of the idea of justice. Consequently, the people then rely their hope for justice on the ability of lawyers to afford it

Abstract

Corruption eradication requires not mere technological hardware and good legal enforcement institutions, but this again, requires software instrument in the form of legal culture, which encompasses the ideology of law and the ideology which legal apparatus adopt. More importantly, in this globalization era, corruption prevention interconnects with politics, economics, culture, law, and international world. Two elements, namely social-political control, as well as penalization which is derived from the ideal concept of justice, are key elements in this regard.

Abstract

In considering the principle of check and balances in legislature matter, the grand theme should be proposed in this context is how to guarantee checks and balances within the legislative branch and that principle are implemented properly and reliably. Nonetheless, in Indonesian constitutional system after the Reformation era when the House of Regional Representative (DPD) was established, the achivement of check and balances is still far from its fundamental aim. As a result, the “new” Constitution is challenged to observe an ideal parliament system where checks and balances within the legislative branch can be achieved and the existence of such fundamental institution could effectively bridge local aspiration to national policy.

Abstract

Among the goals of the 1945 constitution amendment is to create the balance among  the legislative, executive and judicative powers, and thus the check and balance function may take place. So as the proposal for enhancing the authority of the parliament members, which is according to the second amendment  hold the supervisory function as has been provided by section 20 (1).

Abstract

From shariah point of view, a person caught committing corruption shall be penalized.  Beside of this, shariah also recognizes a concept so called by ta’zir, it is an authority granted to a person or a body to exercise criminalization policy on cases where Qur’an and Sunnah do not clearly stipulate. Corruption in a case in point. Hence,  a government may possesses the freedom to determine the type of penalty which is considered as in conformity with the condition of the society
