Abstract

The adoption of constitutional question mechanism in the constitution court system, (known as constitutional adjudication), regarded as part of providing a maximum protection to the citizen’s constitution rights. The kind of protection is a must-have entity in every law-based nation (in the democratic system). For Indonesia, which has ambition to establish a democracy-based life along with law-based life, as been said in Article 1 Section 2 and 3 in 1945 Constitution, the consideration for adopting a mechanism of “constitutional question” is not impossible to happen. Abstract

This research focuses on the accomodation of cultural values of Maduranes society in solving carok problem in criminal law. Using the socio-legal research, interview, observation as the primery data, and data analysis are based on the inductive and qualitative manner, this research reveals that changing the criminal law conception as the public law into public law with the private dimension particularly in murder cases caused by self esteem defence is a must to give a chance for cultural values of Maduranes society in solving carok problem. So that, penal mediation based on the cultural values of Maduranes society as a methode to solve carok can be accomodated in criminal law by adopting some principles of traditional village or tribal moots model, victim-offender mediation model, and community panels or courts model.Key words : carok, cultural values, and penal mediation

Abstract

Gross violation on human right has been occurred at many countries. Almost all of the perpetrators are state .In international law foreign state has immunity before national court. Developing of international law showed that in one side gross violation on human right is prohibited and has a status as jus cogens, peremptory nom under international law. However foreign state immunity before national court is fundamental right. International law doesn’t strictly and clearly governed legal consequences jus cogens norm over gross violation on human right. Some of national court remaining recognized state immunity to foreign state with some legal reason. Abstract

This study reveals that verdict of illegal logging cases tried at district courts and supreme courts arises not only contradiction within legal officers but it also leads to arise a public controvercy. This occurs not only due to the inconsistency of understanding of pubic prosecutors and judges toward normative framework of illegal logging issue and anti corruption bill, but also because of the weakneses of moral integrity of legal officer who have a good relationship with actors of illegal logging. Establishing a steady of legal enforcement is necessary to be done in relation to illegal logging cases. A complexety of problem in illegal logging cases have been influeced by certain factors, lack of awarness of local community, public prosecutors and jusges generally use legal administrative approach is more dominant than integrated criminal legal system then the practice of legal enforcement towards illegal logging has failed to control effectively.Key word : Illegal logging, legal enforcement, corruption, and justice

Abstract

The stipulation of the conversion in UUPA (Agrarian Basic Laws), on the one hand is meant to guarantee that there is a law of land ownership which was mostly unsure before, especially for those who individually own their land hereditarily without formal or legal document. Conversion, on the other hand can affect that some traditional land which is informally owned before can be owned by right. The next effect is that the communal and religious duties in the fo =rm of “ayahan” which is attached to the land before disappears and changes into secular, private ownership. Beside that, traditional land belonging to traditional villages becomes less and if this condition is not handled or taken care of, it can threaten the traditional village itself. It seems that the anxiety has just been newly realized so that it brings conflict for the land ownership in Bali and this problem continuous until now and even can be seen in the villages in the traditional villages in every regency in Bali.Key words : conversion, traditional land, land ownership conflict

Abstract

Legal history found that the practice of judicial review has been long recognized in the Muslim community starting the period of the propthet Muhammad Rasullah Saw hundreds years ago long before Justice John Marshall of the United States of America’s Supreme Court in 1803 made a decision for a constitutional case ‘writ of mandamus’ filed by Marbury. The US Supreme Court declared the Judiciary Act 1789 was against the Article II Section of 2 of the US Constitution. The propthe Muhammad saw was remined by Allah SWT for his statement that over the prophtet ojection to use honey as medicine was against the holly Quran. The holly Quran is the hightest-ranked sources of law in Islam. In term of the Perda Syariah should be no objection as long it is line with the holy Quran and no doubt the Perda should also considered in line with the 1945 ConstituionKey words : Islamic law created by local government
