Abstract

Land right control under customary law that was communal religious in nature tend to control insecular individual manner despite being controlled by the customary law. Land right registrationis motivated more by intention to transfer the land right. These two conditions may result inconflict and affect the conflict settlement. The land right registration in the context of AgrarianLaw can unintentionally result in conflict due to ignorance of the process in the customary law,or the land right is controlled using the ownership pattern as of Agrarian Law context. Thesettlement of such conflict can be done through non-litigation or litigation manner, but litigationis preferred since it is considered to give legal certainty.Key word: Land Tenure, Conflict Implication

Abstract

Tanah merupakan salah satu bagian terpenting bagi masyarakat. Keterikatan masyarakat dengan tanah yang dipijak semakin kentara bagi suatu masyarakat adat. Tidak jarang kepemilikan atas tanah adat pun berpotensi menimbulkan konflik, sebagaimana yang akan dibahas dalam artikel ini. Tanah Pauman merupakan objek pembahasan tulisan ini dan secara spesifik akan dibahas bagaimana model pendaftaran hak atas tanah dalam perspektif Hukum Agraria Nasional dan implikasi pendaftaran tersebut. Dari hasil penelitian ditemukan bahwa konversi tanah pauman dengan menggunakan ’Pura Pauman’ sebagai subjek hak merupakan model pendaftaran menurut Undang-Undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria yang mampu melestarikan ’pemilikan komunal pauman’ serta aspek kepastian hukum, perlindungan, kemanfaatan sekaligus sebagai upaya pelestarian warisan nilai budaya. The Model of Registration on The Right of Pauman Land as King’s Rewards to Preserve The Cultural Heritage in Karangasem District AbstractLand is among the most important aspect of a community. It is even more evident in the tight-knit relationship between indigenous people and their land. Unfortunately, there are often conflicts regarding ownership of indigenous land as will be discussed in this article. This article will be discussing the issues regarding Pauman Land, specifically how is the model of land registration under the Basic Agrarian Law perspective and the implications that will follow. The result of the research shows that the conversion of Pauman Land by using ‘Pauman temple’ as a subject of right is the registration model pursuant to Basic Agrarian Law which is able to preserve ‘pauman communal ownership’ as well as legal certainty aspect, protection, expediency as the effort of heritage cultural value at once. Keywords: legal certainty, cultural value, heritage cultural preservation, land registration, Pauman land. DOI: https://doi.org/10.22304/pjih.v4n2.a10

Abstract

The study in this paper aims to show the strength of the Village Rural Institution owned by Desa Adat (costumory village) in Bali in the current globalization based on Awig-Awig (costumary law). This study is based on normative legal research methods and emperical law using satute approach, analytical, case, legal anthropology, and costumory law. The results of the study show that the presence of various financial institutions such as banking, finance, cooperatives have no significant effect on the existence of Lembaga Perkreditan Desa as a non-bank financial institution owned by Desa Adat. It is precisely the financial institutions established under state law are afraid of the existence of Rural Credit Institutions owned by Adat Village because of the strength of its legal alliance body and its awig-awig. So it can be concluded that the Village Rural Institution owned by Desa Adat in Bali can coexistence with various institutions and state law. Since the administration as a model of legal document used by Rural Credit Institution in credit distribution can imitate the model of banking administration in general with some adjustment to the local wisdom law for the welfare of the people of Desa Adat

Abstract

Public health service advertisements (PHSA) tend to provide information, remind, add value, influence, and even change people's attitudes to healthy living. The purpose of this study was to determine the style of language, meaning, and public health service advertising ideology. The results of this study showed that; (1) the Public Health Service Ads (PHSA) language style, (2) the diction or word choice used tends to be informal, general, brief and understandable by ordinary learned societies. Regarding the tone contained, the narrative text had a simple language style, usually suitable to give instructions, commands, lessons, lectures, and the like. From the meaning point of view, semiotic meaning came from the relation between signifier and signified or it was the meaning of connotation. The ideology that lied behind sourced from the resulting connotation. The way to express imperatively as well as the use of symbols, colors, backgrounds (sign) such as thermometers; for instance. This has determined that PHSA concerned with hygiene, health, precautions, caution, caring, togetherness, planning, prosperity, and happiness.Keywords: PHSA, language style, meaning, ideology

Abstract

Adat Lands as a communal lands nowadays are helds individually. Adat lands in the forms of "Pekarangan Desa" or "Ayahan Desa" actually have Religious-Communalistic Characteristic. These kinds of Adat Lands is sticked with "Ayahan" as an individual obligation of the holders as dedication to their Adat Villages. Recently some of those Adat Lands has been converted into fully individual's land according to the Law Number 5 of 1960. It affected these land has no Religious-Communalistic characteristic anymore, but only has social function in the secular concept. Nowadays, the exiles of adat lands in some Adat Villages in Bali could not avoided potentially emerging conflict. There is no clear understanding of the meaning of "holding process", "holder" and "exiles" which understood as the subject of the rights context, not to the status of the land's context.

Abstract

The stipulation of the conversion in UUPA (Agrarian Basic Laws), on the one hand is meant to guarantee that there is a law of land ownership which was mostly unsure before, especially for those who individually own their land hereditarily without formal or legal document. Conversion, on the other hand can affect that some traditional land which is informally owned before can be owned by right. The next effect is that the communal and religious duties in the fo =rm of “ayahan” which is attached to the land before disappears and changes into secular, private ownership. Beside that, traditional land belonging to traditional villages becomes less and if this condition is not handled or taken care of, it can threaten the traditional village itself. It seems that the anxiety has just been newly realized so that it brings conflict for the land ownership in Bali and this problem continuous until now and even can be seen in the villages in the traditional villages in every regency in Bali.Key words : conversion, traditional land, land ownership conflict

Abstract

This research is intended to identify the water resources management model carried out by Paksebali Village in the development of Tourism Villages in Klungkung Regency. Water resources (SDA) managemet in the development of tourism villages through coexistence between the Customary Villages and the Dinas (state) Villages which are oriented towards empowering rural communities for community welfare. So the Paksebali Village can coexit both the legal structure and the legal substance of the use of Unda River's surface water as a water attraction, restaurant, prewed in the development of new tourist destinations in Klungkung Regency through the development of a tourism village.

Abstract

The Village Credit Institution (LPD) owned by Desa Adat in Bali is oriented to strengthen the economy of indigenous peoples (krama adat) through lending (loans) and savings. The main source of capital for LPDs is the commitment and trust of all village manners which are submitted through the Adat Village Management Board (Prajuru) and the LPD Board. The strengthening of LPDs is in its management and accounting system and its supervision, because it is not uncommon for LPDs that are already large due to weak monitoring systems, poor management and accounting systems to misuse LPD funds utilization which causes LPD to no longer be operational or temporarily bankrupt like LPD in Adat Selulung Village, Kintamani Bangli. The bankruptcy of the LPD was also caused by the weakness of the Prajuru Adat in taking quick steps to replace corrupt officials on the one hand, while on the other hand it did not abolish its obligation to return funds that could not be accounted for through the imposition of civil sanctions or those known as pamidanda (sanction) in awig-awig.

Abstract

In the period of kingdom, Pauman land was collectively owned by the community called pauman. After the independence and at the time Land Law had been imposed, even in some villages the land had been proposed to be owned individually and some of the land had been sold, so the problem discussed were; what model was applied for the pauman land ownership and how the management was done when the Land Law had been imposed. The model of the research was a research of normative law with legislation, concept, analytic, and case approach. The sources of the regulation which were used in this research were primary law sources, secondary law sources, and tertiary law sources which were collected by interview (affirmation), note taking and document. And then it was done interpretation technique. The result of the research showed that there was still collective ownership for pauman land in which the members of the owners were permanent and some were dynamic depended upon the development of the genealogical main owners. Meanwhile, in some villages the ownership tended to be secularly individualization through having the legality of the law in context of Land Law so that some pauman lands dismissed, infect the pauman land was the basic of the managing commitment and there was no more unity of community as the result of authority and ownership transference through trading them to other people. That’s why serious efforts are needed to preserve the pauman lands.
