Abstract

The implementation of Presidential election in Indonesia cannot be regarded as democratic since the designof dispute settlement of the Presidential Election by the Constitutional Court is not planned ideally. Thus, this study examines some research problems underlying the issue: first, what is the urgency of redesigning the authority of the Constitutional Court in resolving disputes of Presidential Election in Indonesia? and second, how is the ideal concept of dispute settlement in order to achieve a democratic election? The method used in this research is normative juridical of legislation approach and concept approach. The result of the study revealed that: first, it is highly urgent to redesign the authority of the Constitutional Court in the dispute settlement of PHPU of President and Vice President in Indonesia to democratize the election as well to find alternative solutions to the elections that could provide legal certainty, fairness and expediency. Second, redesigning the authority of the Court in resolving disputes of the Presidential PHPU includes the expansion of the definition of disputed election results; designing the benchmark of structured systematic and massive electoral violations; and redesigning the time given by the Court in resolving electoral disputes.

Abstract

Economic globalization encourages some individuals to move abroad for a better living and livelihod. Currently, it is undeniable that the existence of foreign migrant workers can support the economic sutainability of European Union. However, foreign migrant workers mostly coming from ASEAN countries are only provided with limited social protection. Therefore, the research problems of this study are, first, whether the European Union rules have provided social protection for foreign migrant workers working around the territory or not? Second, what does ASEAN has to do in order to carry out its obligation to protect its citizens working outside ASEAN, especially within the framework of the agreement plan Free Trade Agreement between ASEAN and the EU? The research is conducted with normative method. The results of this study revealed two essential things: first, the rules in the European Union have not provided adequate protection for migrant workers of non-EU, especially for those coming from ASEAN countries. Secondly, there is the possibility for the inclusion of specific provisions related to social protection of migrant workers in the Free Trade Agreement between ASEAN and the EU.

Abstract

The book term of Geographical Indication is a prerequisite for protecting Pandanwangi and Cianjur rice as Geographical Indication products since its registration requirements must be equipped with Geographical Indications book which provides us with a comprehensive and detailed description of the quality, reputation, and distinctive character of the product. Thus, it is highly suggested that the applicant institution represents the stakeholders of Pandanwangi and Cianjur rice have great competence and well expertise to its formulation in accordance with the applicable rules. On this basis, the research problems in this study are formulated as follows, first, are there any obstacles found in the compilation of the Book Term of Geographical Indications of Pandanwangi and Cianjur Rice? Second, how is the Participatory Model in compiling the Book Term of Geographical Indications? The method used in this study is a socio-legal research based on the approach of legal science and social sciences. The study concluded that, first, the constraints in the preparation of the Book Term of IG of Cianjur and Pandanwangi Rice include technical constraints, the legal culture of the society, and the lack of understanding of the benefits of IG protection. Second, a participatory model to guide the preparation of the Terms of IG of Cianjur and Pandanwangi Rice is applied through active cooperation between the Government, AP3C, and Universities.

Abstract

Most TNCs investing in developing countries control the exploitation of natural resources. However, the environmental protection standards applied by TNCs in the home state and the host state are not the same. The bad experiences occuring in some developing countries (Indonesia, India, Ecuador, and Nigeria) triggervarious policies to protect the right to enjoy a healthy environment. This study comprehensively analyzes: first, how is the legal policy of the responsibility of TNCs on the right protection to enjoy healthy environment in Indonesia, India, Ecuador, Nigeria and Finland? Second, what are the similarities and differences in its policymaking? This study is a qualitative research with normative and comparative juridical approach. The results of this study concluded that, first, the legal policies of developing countries towards the violation of TNCs responsibilities to enjoy a healthy environment have the same pattern, which is pretty mild in granting sanction, and prioritizing more on the economic growth rather than protecting the right to enjoy healthy environment. Second, the similar legal policy between these countries lies on the fact that they have recognized the right to enjoy healthy environment as a constitutional right and part of human rights. However, the implementation of the legal protection of the right to enjoy healthy environment differs from one country to another.

Abstract

This study aims at analyzing the implementation of Law No. 40 of 2004 related to the Health Social Security after the Constitutional Court decision No. 07 / PUU-III / 2005. The reseacher uses library research method with content analysis approach. The research result highlights that: the implementation of Law No. 40 of 2004 related to the Health Social Security after the Constitutional Court decision No. 07 / PUU-III / 2005, whose implementation is entrusted to BPJS is still far from fairness for all. The application of Health Social Security BPJS is still problematic in many ways, among which since it implements a tiered service flow prior to the hospital, that is the participants must first check into the first-level health facilities (health centers) before being referred to the hospital. Another problem is regarding the complexity of the service flow of BPJS for implementing a tiered service flow.

Abstract

The formulations of ideal legislative drafting in the formation of environmental-based Regional Regulation is of highly essential matter to be done in a constitutional democracy. On this basis, the research problem in this research is how is the ideal formulation of legislative drafting in order to realize a democratic state of law, especially in the formation of environmental-based regional legal products? The method used in this research is a normative juridical method with qualitative analysis. As a result, this study highlights that in order to realize the ideal of a democratic state of law, the formulation of legislative drafting, especially in the formation of environmental-based regional legal products, should contain regionally-based materials of the specific condition of the area as well as further elaboration of higher legislation. The program establishment of regional regulation as instruments for program planning of Provincial Regulation or District / City Regulation arranged in a planned, integrated and systematic way, operationally lists the Regional Design Regulations which were organized based on certain method and parameters as an integral part of the national legislation system based on the Constitution of Indonesian Republic Year 1945 and the philosophy of the State.Formulation, legislative drafting, ideal, state of law, democratic.

Abstract

The problems in this research are formulated as follow, first, how is the standard value calculated in the transition of BPHTB land rights? Second, how to assure the standard value in the calculation of BPHTB on the transfer of land rights? This research is a normative research supported by empirical data with the approach of legislations. On the basis of this study we concluded that, first, there is uncertain quantification of BPHTB amount to be paid, with the obligation that inhibit the validation process of registration of land rights transfer. Secondly, there should be standard fixed value as the basis for calculating BPHTB by the competent authority, such as the Taxable Value on Property Tax.

Abstract

Fair trials are universal principles included in various international human rights instruments, procedural law and professional codes of conduct that guide judges in analyzing, hearing and deciding cases. Identifying these isntruments enables us to assess the presence or absence of a fair trial. On this basis, the researcher formulates the research problems in the study as follows: first, what is the tendency of violation of the Code and the Judicial Code of Conduct (KE PPH)? Second, what is the tendency of the recommended sanction and sentence for the period of 9 (nine) years of KY (2005-2014)? This research is classified as non doctrinal legal research with socio-legal approach. The study concluded that: first, for the first five-year period, there are no significant increasing trend of case reports, while during the second five years there was a significant raise of case report. Meanwhile, the most region with most case reports is Jakarta Special Region. The most common type of violations of KE PPH is the unprofessional, undisciplined, unfair and dishonest behavior of the judge. Second, as with types of sanctions the moderate sanctions and medium sanctions are highly dominant. Meanwhile severe sanctions in the form of dishonorable discharge, dismissal with pension rights and unofficial sanction for 1-2 years is likely to increase from year to year.
