Abstract

World Health Organization Framework Convention on Tobacco Control (the FCTC) was adopted on 21st May 2003 and came into force on 25th February 2005. Since its adoption, Indonesia has never signed and ratified this Convention. Currently, Indonesia is the fifth largest tobacco market in the world and the third largest cigarrete consumer (WHO data in 2008), thus it is obligatory for Indonesia to obey the minimum standards of tobacco control under the FCTC. There are two problem formulations that will be answered by this writing: first, what are the obstacles faced by Indonesia during the ratification’s plan of the FCTC? Second, how far the FCTC ratification is effective in protecting public health in Indonesia? This study is normative research by using statute and comparative approaches. Indonesian policy on tobacco control always face with obstacles in the area of politic, economic, and human rights side. Most of the laws are still abstract to support public health in general. Particular researches prove that ratification efforts done by Indonesia would not cause adverse impacts to the economic advantages of tobacco but yet would be able to give effective implementation and legal certainty to protect the public health.

Abstract

Economic globalization encourages some individuals to move abroad for a better living and livelihod. Currently, it is undeniable that the existence of foreign migrant workers can support the economic sutainability of European Union. However, foreign migrant workers mostly coming from ASEAN countries are only provided with limited social protection. Therefore, the research problems of this study are, first, whether the European Union rules have provided social protection for foreign migrant workers working around the territory or not? Second, what does ASEAN has to do in order to carry out its obligation to protect its citizens working outside ASEAN, especially within the framework of the agreement plan Free Trade Agreement between ASEAN and the EU? The research is conducted with normative method. The results of this study revealed two essential things: first, the rules in the European Union have not provided adequate protection for migrant workers of non-EU, especially for those coming from ASEAN countries. Secondly, there is the possibility for the inclusion of specific provisions related to social protection of migrant workers in the Free Trade Agreement between ASEAN and the EU.

Abstract

Most of countries in the world have terminated the death sentence for the sake of respecting the human rights internationally as the universal human rights. In fact, China and Indonesia have the different practice in the executing the death penalty for certain crimes.  Using the normative legal research method, this research analysed two core issues including to what extent of the international protection of human rights in China and Indonesia. This study is to analyze two main issues: to what extent the international protection of human rights in China and Indonesia and how the law and the international protection of human right impact the policy of implementation of death sentence in China and Indonesia. This study concluded two points: first, there was a difference in the implementation of human rights both in China and in Indonesia particularly in implementing the death sentence in both countries in which both apply certain limitation in implementing the death sentence. Second, the approval of the International Kovenan about the civil right and political right becomes the basic parameter to what extent those two countries regulate the policy of death sentence and to what extent of the attempt of those two countries in making its domestic law harmonious with the international human right.

Abstract

Open skies policy is a concept of free market of airline industry. It eliminates single government’s influence in regulation and management of aviation industry. As implemented by the ASEAN Single Aviation Market (ASEAN-SAM) per 2015, the open skies policy aims to increase regional connectivity and regional economic growth by permitting airline industries from each ASEAN member states to fly above the Southeast Asian region without any barriers or restrictions. This policy has raised pros and cons from each ASEAN member state. Indonesia and some other states are still reluctant to adopt the open skies policy. By entering into commercial agreement to open their airspace, each member states will challenge their state sovereignty over the airspace above a state’s territory. This study argues that regional open skies policy provides greater economic advantages for the consumers of airline industry. However, this policy does not parallel to the basic principles of ASEAN. State sovereignty must be preserved in the liberalization that open skies represents. ASEAN Way, though inflexible, assigns member states with full sovereignty, which does not limit open skies policy implementation. This study, then, proposed legal framework through model of regional agreement to compromise between the state sovereignty principles and the regional open skies policy.Tantangan dan Peluang dalam Pembentukan Kebijakan Ruang Udara Terbuka ASEANAbstrakKebijakan Udara Terbuka adalah konsep pasar bebas untuk industri penerbangan. Kebijakan ini menghilangkan pengaruh pemerintah dalam mengatur dan mengelola industri penerbangan. Seperti yang diterapkan oleh Pasar Penerbangan Tunggal ASEAN (ASEAN-SAM) pada 2015, Kebijakan Udara Terbuka ditujukan untuk meningkatkan konektivitas regional dan ekonomi regional dengan mengizinkan industri penerbangan dari anggota ASEAN untuk terbang bebas di kawasan Asia tenggara tanpa hambatan. Kebijakan ini telah menimbulkan pro dan kontra dari masing-masing negara anggota ASEAN di mana Indonesia dan beberapa negara masih enggan untuk sepenuhnya mengadopsi Kebijakan Udara Terbuka. Dengan mengadakan perjanjian komersial untuk membuka wilayah udara mereka, setiap negara anggota akan menyerahkan kedaulatan di wilayah udara mereka. Studi ini berpendapat bahwa Kebijakan Udara Terbuka regional memberikan keuntungan ekonomi khususnya bagi konsumen industri penerbangan. Namun, kebijakan ini tidak sejalan dengan prinsip dasar ASEAN. Selain itu, berkurangnya kedaulatan di wilayah udara demi liberalisasi akan merugikan negara. ASEAN Way, meskipun tidak fleksibel, memberikan kedaulatan penuh kepada negara anggota untuk menguasai wilayahnya sehingga tidak memberikan peluang sekecil apa pun untuk mengimplementasikan Kebijakan Udara Terbuka regional. Abstract

Mohamed Morsi was became Egypt’s first democratically elected president based on Presidential election held in 2012. However, he has been ousted from Presidential office just over one year into his presidency. President Morsi and Muslim Brotherhood leaders were arrested. Egypt’s Minister of Defense was appointed Adly Mansour as interim president until an election could take place based on the announcement of Egypt’s Minister of Defense. This announcement caused several days of bloodshed, since around 600 people were killed in clashes as police broke up protest camps of Morsi supporters. This condition raised international protest and urged immediate humanitarian intervention to end turmoil and save most Egyptians. This paper will analyzed whether or not the need of humanitarian intervention give an effective solution for Egypt’s crises.Keywords : humanitarian, resolution, Egypt

Abstract

Since the US withdrew all its military forces, the Taliban as one of the ultra-conservative factions managed to hold control of all Afghanistan. The dominance of the Taliban's power has peaked since the coup d'etat (coup) of the legitimate government in power under President Ashraf Ghani. The international community condemns the coup act and fears the Taliban leadership will pursue policies that are incompatible with human rights values. For this reason, this study examines the legality of the coup act carried out by the Taliban according to international law. In addition, this study will also analyze how the government under the control of the Taliban can gain recognition from other countries so that it can be used as a modality for establishing international relations. By using normative legal research, this study concludes that to determine the legality of the coup carried out by the Taliban, it is very dependent on the constitutionality of the coup according to Afghan law, their effective control, and their compliance with international law. Although the recognition is still ambiguous in practice, the Afghan government under the Taliban needs it to be actively involved in international relations. Keywords: Taliban; Afghanistan; coup; recognition; international law AbstrakSejak seluruh pasukan militer Amerika Serikat ditarik mundur, Taliban sebagai salah satu faksi ultra konservatif berhasil menguasasi seluruh wilayah Afganistan. Dominansi kekuasaan Taliban tersebut memuncak sejak terjadinya coup d’etat (kudeta) atas pemerintah yang sah berkuasa dibawah Presiden Ashraf Ghani. Masyarakat internasional mengecam tindakan kudeta tersebut dan khawatir kepemimpinan Taliban akan melakukan kebijakan yang tidak sesuai dengan nilai hak asasi manusia. Untuk itulah dalam penelitian ini dikaji legalitas tindakan kudeta yang dilakukan oleh Taliban menurut hukum internasional. Selain itu, penelitian ini juga akan menganalisis bagaimana agar pemerintah dibawah kendali Taliban dapat memperoleh pengakuan dari negara lain sehingga dapat digunakan sebagai modalitas menjalin hubungan internasional. Dengan menggunakan penelitian hukum normatif, penelitian ini menyimpulkan bahwa untuk menentukan legalitas kudeta yang dilakukan Taliban maka sangat tergantung pada keabsahan kudeta secara konstitusionalitas menurut hukum Afganistan, penguasaan efektif, dan kepatuhan mereka terhadap hukum internasional. Meskipun pengakuan masih terdapat ambiguitas dalam praktek, namun pemerintah Afganistan dibawah Taliban memerlukannya untuk dapat terlibat aktif dalam hubungan internasional. Abstract

The passing of Law No. 6 Year 2023 on Job Creation has seriously damaged relations between humans and the environment. This statute still provides a lot of convenience and freedom for industry to carry out economic activities and does not pay much attention to the environment. The imbalance between economic activities and environmental sustainability is indicated by the simplification of environmental permits carried out by the government. The government tends to simplify the permit by decreasing the degree of environmental protection obligation documents before establishing business in Indonesia. Using normative legal research methodology, this research examines the suitability of Job Creation Law to the basic principles of environmental sustainability. Apart from that, this research also examines the need to establish an Environmental Protection Authority in Indonesia to make sure that any activities within the territory of Indonesia comply with the environmental protection obligation. The results of this research show that the Job Creation Law prioritizes business interests to expand employment opportunities and ignores environmental conservation efforts. The simplification of permits in the Job Creation Law will accelerate environmental damage without control by diminishing the obligation to fulfill Environmental Impact Assessment (AMDAL) for business actors. If this situation gradually spirals out of control, this research proposes the establishment of an Environmental Protection Authority as a forum to ensure that every business activity in Indonesia must pay attention to environmental sustainability.  Indonesia can learn from the practice of the developing country by empowering the Environmental Protection Authority to develop, supervise, and enforce environmental sustainability obligations.

Abstract

The non-refoulement principle requires each country to consider refugees and asylum seekers in their country of origin if they are subject to persecution and threaten their lives. As a geographically strategic country, Indonesia has been a significant crossroad for international refugees and asylum seekers often consider Indonesia their temporary destination. Moreover, the complex situation of international refugees has encouraged to reinterpret of the principle of non-refoulement into various national measures and domestic policies, given that Indonesia is deemed a transit country for refugees and has not ratified the 1951 Convention on the Status of Refugees. This paper aims to analyse the concept of refugee protection under international law, particularly the non-refoulement principle and investigate the application of the non-refoulement principle in Indonesia. This study employed normative and empirical legal research with statutory, conceptual, and comparative approaches. This study confirms that the non-refoulement principle is part of jus cogens norms in international law but does not fit in its application. Indonesia has inconsistency in upholding the non-refoulement principle into the binding normative rules. Refugees have received far less attention from the Indonesian government due to insufficient infrastructure and financial allocation. Moreover, the existing executive regulations do not provide effective enforcement since these regulations have a lower position in the hierarchy and cannot have deterrent sanctions. Hence, ratification of the 1951 Convention is urgently needed by Indonesia to guarantee the protection of refugees within its jurisdiction. At the regional scope, Indonesia can encourage ASEAN countries to adopt good practices in the European Union to set sharing quotas to ensure that not most refugees escape to Indonesia.Keywords: Customary International Law, Indonesia, Refugees.

Abstract

Cybercrime is a reality that has emerged with the era of digitalization. One of the most commonly occurring cybercrimes is personal data theft. In light of Regulation No. 27 of 2022 regarding the Protection of Personal Data, which has extraterritorial application, it is essential to critically assess the jurisdiction applied to offenders involved in transnational personal data theft. The writer conducted normative research for this narrative, utilizing various scientific approaches such as statute, conceptual, and comparative analysis. This research uses Regulation No. 27 of 2022 as the analytical tool for domestic regulation towards the different conventions and regulatory frameworks within international law pertaining to the enforcement of personal data theft. The research leads to the conclusion that a domestic regulation with extraterritorial traits alone is not the ultimate solution for successfully applying extraterritorial jurisdiction for transnational offenders. In summary, an international framework that promotes and sustains intensive international cooperation is necessary to effectively enforce extraterritorial jurisdiction against offenders involved in transnationally committed personal data theft.

Abstract

The economic value of Intellectual Property Rights (IPR) is universally recognized and can be utilized as a form of collateral to secure bank loans. The validity of this assertion has been established within the international framework and demonstrated through the established practices of various nations, including the United States and the United Kingdom, which have been analyzed in this research. In response to the remarkable expansion of creative actors, Indonesia implemented Government Regulation No. 24 of 2022 concerning the Creative Economy, which permits the use of intellectual property as collateral for debt to tackle financing obstacles. This research aims to closely examine how intellectual property (IP) is used as a guarantee for loans in Indonesia and other selected jurisdictions. It will investigate the problems and risks tied to this type of lending and discuss possible ways for the government to address these issues. This study discovered that while Indonesian law allows the use of IP as collateral, its actual application is limited due to a lack of understanding among both the general public and business sector regarding the comprehensive policies and procedures. Additionally, this study also proposes potential solutions for the future of IP in commercial transactions as mortgages.
