Abstract

Pada dasarnya, udara wilayah negara ditutup untuk pesawat negara lain. Tidak ada pesawat bisa terbang di atas wilayah lain atasnya negara atau tanah tanpa otorisasi sebelum negara. Ini berarti setiap penerbangan dilakukan adalah melanggar wilayah udara negara lain. Karakteristik wilayah udara nasional sebagai media gerakan membuatnya sensitif untuk keamanan dan pertahanan negara di bawah (kolong Negara). Kelebihan dari wilayah udara untuk serangan militer, yakni kecepatan, jangkauan, surprice dan penetrasi, dapat dioptimalkan melalui media udara menggunakan pesawat. Untuk itu, setiap negara ruang keamanan wilayah udara standar ketat dan kaku.Basically, air territory of a state is closed for other state aircraft. No state aircraft able to fly over territory of another state or land thereon without authorization before. It means every flight done is violating air territory of another country. The characteristic of national air territory as a movement media makes it sensitive for security and defense of the state beneath (negara kolong). The advantages of air territory for military attack, namely speed, range, surprice and penetration, could be optimized through air media using aircraft. In order that, every state dressing its security air territory standard strictly and rigidly.

Abstract

Berbagai problematika penyeragaman dan penyelarasan hukum maritim perdata akan mewujudkan penegasan efesiensi dan kepastian hukum dalam melakaukan aktivitas kemaritiman internasional, penyeragaman hukum juga mendorong terselenggaranya keadilan dan ketertiban sebagai prinsip utama dalam hukum perdata internasional, implikasi negarayang timbul dari penyeragaman ini bagi negara peserta perjanjian internasional. Konstruksi berfikir dan konsep hukum yang sudah terbangun menurut hukum peserta tersebut. Menerima konstruksi hukum yang berbeda akan mengganggu konstruksi berpikir hukum negara tersebut mengenai masalah tertentu.Various problems of uniformity and alignment of civil maritime law will embody the assertion efficiency and legal certainty in melakaukan international maritime activity, the uniform law also encourages the implementation of justice and order as a main principle in civil law international, negarayang implications arising from this uniformity for the participating countries of international agreements. Construction of thinking and legal concepts that have been built according to the law of the participant. Receiving a different legal construction would disrupt the construction of state law thinks about certain issues.

Abstract

Pengaturan hukum perang di laut tidak mengalami perkembangan yang berarti sejak Konvensi Den Haag tahun 1907. Dengan adanya berbagai perkembangan yang ada memaksa masyarakat internasional untuk membuat berbagai penyesuaian berkaitan dengan pelaksanaan perang di laut. Perkembangan paling penting adalah dengan disahkannya UNCLOS 1982 di Montego Bay, Jamaika, yang berisi ketentuan tentang hak dan kewajiban Negara di laut. UNCLOS 1982 berlaku efektif pada tahun 1994. Semua ketentuan yang ada dalam UNCLOS 1982 berlaku pada masa damai, dan tidak ada satu ketentuanpun yang mengatur tentang penggunaan kekerasan ataupun peperangan. San Remo Manual 1994 berisi tentang pedoman pelaksanaan perang di laut. Karena itu perlu dikaji bagaimana kaitan antara San Remo Manual 1994 dengan UNCLOS 1982.Setting the law of war at sea did not experience significant development since the Hague Convention of 1907. With the various developments that have forced the international community to make various adjusments relating to the conduct of the war at sea. The most important developments is the adoption of  UNCLOS in 1982 inMontego Bay,Jamaica, which contains provisions concering the rights and obligations of the State in the sea. UNCLOS in 1982 became effective in 1994. All the provisions in the 1982 UNCLOS applies in peacetime, and no one rule governing the use of violence or war. 1994 San Remo Manual contains the guidelines for conduct of the war at sea. Because it needs to be studied how the link between the San Remo Manual 1994 with the UNCLOS 1982.

Abstract

Obyek dari Penelitan ini, adalah Penentuan Laut Teritorial antara Negara dengan seberangnya atau berjajar berdasarkan Konvensi Hukum Laut 1982 untuk mentukan titik pangkal dan batas wilayah diantara dua negara. Berdasarkan hasil dari penelitian Penentuan Laut Teritorial antara Negara tersebut adalah merupakan posisi antara dua negara, yang berseberangan, penentuan garis, kecuali bila mereka mempunyai perjanjian antar negara. Perjanjian tersebut bisa berlaku mengingat sejarah atau kondisi letaknya, untuk penentuan titik garis pangkal antar dua negara terdapat berbagai variasinya.The objective of this research is to find out the Delimitation of the territorial sea between States with opposite or adjacent coasts based of united nation convention law of the sea 1982 in order to determine the basepoint and draw the base line between two countries Based of the result of this research the Delimitation of the territorial sea between States with opposite or adjacent coasts  based on the united Nation Convention law of the sea 1982 is the posisition of two countries who opposite each other  or to border on, not the other countries competent except have agreement of that countries. The above provision does not apply, however, where it is necessary by reason of historic title or other special circumstances to delimit the territorial seas of the two States in a way which is at variance therewith.

Abstract

Perolehan tanah oleh perusahaan swasta dapat ditempuh melalui pelepasan hak atas tanah. Pelepasan hak atas tanah dapat dilakukan setelah ada kesepakatan dalam musyawarah mengenai bentuk dan besarnya ganti rugi. Pelepasan hak atas tanah oleh pemegang haknya dibuat dengan akta Notaris. Dengan pelepasan hak atas tanah tidak berakibat hak atas tanah berpindah kepada perusahaan swasta, akan tetapi hak atas tanah menjadi hapus dan kembali menjadi tanah Negara.Acquisition of land by a private company can be reached through the release of land rights. Disposal of land rights can be done after there is agreement in the deliberations about the form and amount of indemnification. Disposal of land rights by the right holder is made by notarial deed. With the release of land rights does not result in land rights was transferred to private companies, but the right to remove and return the land to be State land.

Abstract

Kekebalan dan keistimewaan yang dimiliki seorang wakil diplomatik didasarkan pada pemberian kesempatan seluas-luasnya kepada wakil diplomatik dalam melakukan tugasnya dengan sempurna. Hal tersebut merupakan bentuk perlindungan terhadap perwakilan diplomatik beserta fasilitas-fasilitasnya termasuk di dalamnya gedung perwakilan diplomatik asing. Tanggung jawab negara lahir apabila negara melakukan perbuatan yang bertentangan dengan hukum karena kesalahan atau kelalaiannya sehingga menimbulkan pelanggaran kewajiban hukum internasional. Dalam hal terjadi pelanggaran terhadap kekebalan dan keistimewaan wakil diplomatik, maka negara penerima dapat dikatakan tidak dapat memberikan perlindungan dan kenyaman terhadap para diplomatik dalam menjalankan fungsi dan misi-misinya.Penyelesaian sengketa Internasional antara Indonesia dengan Myanmar dalam kasus penyadapan gedung diplomatik dapat ditempuh dalam berbagai cara diantaranya melalui prosedur penyelesaian secara politik, hukum (yuridis) maupun dalam kerangka kerjasama ASEAN. Namun menggunakan jalur diplomatik atau jalur negosiasi yang didasarkan pada itikad baik dari kedua negara yang merupakan langkah awal yang paling baik dalam penyelesaian sengketa. Bila kesepakatan gagal diambil dalam jalur diplomasi, maka dapat ditempuh cara-cara penyelesaian sengketa secara hukum dan membawanya ke Mahkamah Internasional. The immunities and privileges owned by a diplomatic representative is based on providing greater opportunities to the diplomatic representatives in performing their duties perfectly. This is a form of protection to the diplomatic mission and its facilities-related facilities including the building of foreign diplomatic representative. Responsibility of the state of birth if the state committed acts contrary to law because of mistakes or negligence resulting in violations of international legal obligations. In case of violation of diplomatic immunities and privileges of the vice, then the recipient country can not be said to provide protection and comfort against the run function and diplomatic missions.Settlement of international disputes between Indonesia and Myanmar in diplomatic buildings wiretapping case can be achieved in various ways such as through a political settlement procedures, legal (juridical) and within the framework of ASEAN cooperation. But use diplomatic channels or channels of negotiation that is based on good faith from both countries who are the best first step in dispute resolution. When the deal failed to be taken in diplomacy, it can be done in ways legal dispute resolution and bring it to the International Court of Justice.
