Dalam Hukum Tanah Nasional ditetapkan bahwa hak atas tanah yang dapat diwakafkan untuk kepentingan peribadatan, pendidikan, dan sosial adalah Hak Milik. Pihak yang mewakafkan tanah disebut wakif, sedangkan pihak yang diserahi tanah wakaf disebut nadzir. Wakaf tanah Hak Milik dibuktikan dengan Akta Ikrar Wakaf yang dibuat oleh Pejabat Pembuat Akta Ikrar Wakaf (PPAIW). Wakaf tanah Hak Milik wajib didaftarkan ke Kantor Pertanahan untuk diterbitkan Sertipikat Wakaf sebagai tanda bukti haknya.The National Land Law stipulated that the rights which can waqf the sake of workship, education, and social are the property. Setelah berlakunya Undang-Undang Nomor 12 Tahun 2008 tentang Perubahan Kedua atas Undang-Undang Nomor 32 Tahun 2004 tentang Pemerintahan Daerah, sebagai penjabaran Pasal 18, membawa berbagai perubahan baru dalam penyelenggaraan pemerintahan di daerah. Undang-undang ini telah mengubah secara mendasar praktek-praktek pemerintahan, salah satunya adalah menyangkut kedudukan, tugas pokok dan fungsi Kecamatan. Perubahan tersebut membawa akibat berubahnya bentuk organisasi, pembiayaan, pengisian personil, pemenuhan kebutuhan logistik dan akuntabilitasnya, selain perubahan mengenai definisi Kecamatan itu sendiri. Sebelumnya, Kecamatan merupakan wilayah administratif dalam rangka dekosentrasi yakni lingkungan kerja perangkat pemerintah yang menyelenggarakan pelaksanaan tugas pemerintahan umum di daerah, sedangkan menurut Undang-Undang Nomor 12 Tahun 2008, Pasal 126 Pasal 3, yakni Kecamatan merupakan perangkat daerah Kabupaten atau Kota dalam rangka asas desentralisasi. Menegaskan, apabila dulu dalam kerangka asas dekosentrasi Kecamatan merupakan salah satu wilayah administrasi pemerintahan, selain Nasional, Propinsi, Kabupaten dan Kotamadya, maupun Kota Administratif. Namun, pada saat sekarang ini Kecamatan adalah wilayah kerja dari perangkat daerah. Dapat dikatakan pula bahwa Kecamatan bukan merupakan wilayah kekuasaan, akan tetapi Kecamatan adalah wilayah pelayanan.Since the enactment of Law No. 12 Year 2008 on The Second Amendment to Law Number 32 Year 2004 on Regional Government, as an interpretation of Article 18, to bring new changes in governance in the region. This law has fundamentally changed the practices of government, one of which is related to the position, duties and functions of the District. The changes were brought as a result of changing the shape of the organization, financing, charging personnel, logistics fulfillment and accountability, in addition to changes in the definition of the township itself. Previously, the District is an administrative region in the context of the work environment that is deconcentration government that organizes the implementation of tasks in the area of public administration, while according to Law No. 12 of 2008, Article 126 Section 3, that the District is the district/city in the context of the principle of decentralization. That is, if used within the framework of the principle of deconcentration districts is one of the administrative area, in addition to national, provincial, district and municipality, as well as administrative city. Pengalihan sebagian pekerjaan kepada perusahaan lain diperbolehkan oleh Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan sebagaimana diatur dalam Pasal 64 sampai dengan Pasal 66, dan mengenai kedudukan pekerja alih daya diperjelas dalam Putusan Mahkamah Konstitusi Nomor 27/PUU-IX/2011 tentang Sistem Penyerahaan Sebagian Pekerjaan Kepada Perusahaan Penyedia Jasa Pekerja kemudian ditindaklanjuti dengan Peraturan Menteri Tenaga Kerja Nomor 19 Tahun 2012 tentang Syarat-syarat Penyerahan Sebagian Pelaksanaan Pekerjaan Kepada Perusahaan Lain. Perusahaan Penyedia Jasa Pekerja tetap bertanggungjawab terhadap keberadaan pekerja alih daya meskipun perusahannya dalam keadaan pailit atau bankrut, dan pekerja tetap mendapatkan perlindungan hukum meskipun pekerja alih daya yang bersangkutan melakukan pekerjaan dengan Perjanjian Kerja Waktu Tertentu. Metode Penelitian ini menggunakan metode yuridis normatif, dengan pendekatan secara conceptual approach pendekatan konseptual dan statute approach pendekatan perundang-undangan. Kesimpulan dalam penelitian ini perusahaan penyedia jasa pekerja dalam keadaan pailit tetap harus bertanggungjawab kepada pekerja alih daya yang melakukan perjanjian kerja waktu tertentu sampai batas waktu yang telah ditentukan dan pekerja alih daya tetap mendapatkan perlindungan hukum sebagaimana yang telah ditentukan Undang-Undang.The transfer of some of the work to another company permitted by the Act No.13 of 2003 onEmployment as stipulated in Article 64 through Article 66, and the power over the workers’ status clarified in the Decision of the Constitutional Court. Prosedur dan Persyaratan penerbitan izin lingkungan telah di atur dalam Undang-Undang Perlindungan dan Pengelolaan Lingkungan Hidup. Hal ini penting, karena akan memberikan gambaran kepada seseorang atau badan hukum apa saja yang harus dipenuhi apabila ingin mengajukan izin lingkungan. Dengan dijelaskannya prosedur dan persyaratan tersebut, maka pejabat yang berwenang telah diberi rambu-rambu dalam menerbitkan izin lingkungan.Procedures and Requirements for the issuance of an environmental permit has been regulated in Law-Law Protection and Environmental Management. This is important, because it will give an overview to the person or any legal entity that must be fulfilled if you want to submit an environmental permit. With the procedures and requirements are explained, the authorities had given the signs-signs in issuing permits.

Lahirnya Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak (Lembaran Negara RI Tahun 2012 Nomor 153 Tambahan Lembaran Negara RI Nomor 5332) merupakan harapan bagi anak-anak yang berhadapan dengan hukum baik sebagai pelaku maupun sebagai korban untuk tetap mendapatkan hak-haknya. Hal penting yang diatur dalam UU-SPPA adalah pelaksanaan diversi. Hal-hal yang harus dipersiapkan dalam pemberlakuan UU-SPPA ada dua aspek, yaitu fisik dan non fisik. Persiapan secara fisik berupa sarana dan prasarana, yang selama ini masih belum ada Pemerintah daerah harus mempersiapkan lembaga-lembaga seperti Lembaga Pembinaan Khusus Anak, Lembaga Penempatan Anak Sementara, Lembaga Penyelenggaraan Kesejahteraan Sosial. Sedangkan persiapan non fisik meliputi penegak hukum yang mempunyai sertifikat sebagai penyidik anak, jaksa anak, dan hakim anak. Sedangkan faktor penghambat atas pemberlakuan UU-SPPA yang paling dominan ada pada UU-SPPA itu sendiri karena masih banyak aturan yang memerlukan petunjuk teknis untuk melaksanakannya, seperti aturan tentang prosedur diversi. Jika diversi merupakan amanat dalam UU-SPPA, maka selama lembaga-lembaga baru belum tersedia, maka pelaksanaan diversi akan mengalami hambatan. Demikian juga selama belum tersedia penegak hukum khusus anak, maka amanat UU-SPPA juga tidak akan terlaksana.The establishment of Law of Number 11, 2012 about the system of children penal judgment (government gazette 2012 number 153 and additional government gazette number 5332, abbreviated UU-SPPA) is “a hope” for children facing the law both as doers or victims to get their rights. The important thing arranged in UU-SPPA is the completion of children penal from penal judgment process out of penal judgment. There are two aspects to prepare in establishing UU-SPPA, namely physical and non physical. The local governmet has to prepare the institutions such as Lembaga Pembinaan Khusus Anak, Lembaga Penempatan Anak Sementara, Lembaga Penyelenggaraan Kesejahteraan Sosial. This law accomodates children interest and protection that has given the completion of children cases facing the law. While the dominant inhibiting factor is in UU-SPPA its self since there are so many rules that need technical instructions to implement, such as the rule of diversion procedure. If the diversion is a mandate in UU-SPPA and the new institutions are not available so it will make the establishment of diversion facing obstacle. Moreover, if there is no children law holder, the mandate of SPPA will not also be implemented.

KEDUDUKAN HUKUM NOKEP 883-DIR/KPS/10/2012 SEBAGAI DASAR PEMBERIAN HAK PENSIUN BAGI PEKERJA PT BRI PERSERO TBK Asri Wijayanti

Sebelum disahkannya Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, pekerja yang diberhentikan karena memasuki usia pensiun, mendapat hak atas dana pensiun (bagi pegawai negeri) atau hak atas pesangon (bagi pekerja swasta). Kedudukan SK Direksi Nokep 883-DIR/KPS/10/2012 yang dianalisis berdasarkan Pasal 167 Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, telah mengikutsertakan pekerja dalam program pensiun yang iuran atau preminya dibayar oleh PT BRI Persero Tbk dan pekerja. Substansi SK Direksi Nokep 883-DIR/KPS/10/2012 telah melanggar Pasal 167 ayat (3) Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan.Prior to the enactment of Law 13/2003, workers whose did dismissal due to retirement, the right to receive pension funds (for civil servants) or rights to severance pay (for private sector workers). The aim of the article to provide an alternative solution for the national case on retired PT BRI Persero Tbk on going at this time, Status of Directors Nokep 883-DIR/KPS/10/2012 SK analyzed based on Article 167 Law 13/2003, this is BRI has included workers/employees in the pension plans whose contributions/premiums paid by the BRI and workers. SK Nokep 883-DIR/KPS/10/2012 Directors has violated Article 167 paragraph (3) of Law 13/2003.
