Abstract

Daerah Tegal khususnya banyak memiliki potensi dalam hal home industri logam besi yang terdapat di Kecamatan Talang khususnya di Desa Langgen. Produk yang dihasilkan dapat berupa barang setangah jadi ataupun yang sudah siap di distribusikan, dan produk tersebut juga tidak kalah saing dengan produk yang ada di daerah lain. Hasil produk besi yang ada telah di distribusikan ke berbagai daerah yang ada di Indonesia. Industri besi ini memberikan sumbangan yang cukup besar terhadap kemajuan perekonomian di Tegal khususnya di Kecamatan Talang. Sejauh ini kesejahteraan karyawan yang ada di Kecamatan Talang Kabupaten Tegal khususnya di Desa Langgen terlihat masih kurang. Mengacu pada standar upah minimum kerja (UMK) di Kabupaten Tegal sebesar Rp 1.487.000,00,- per bulan sesuai dengan Keputusan Gubernur Nomor 560/50 tahun 2016 tentang upah minimum pada 35 Kabupaten/Kota di Provinsi Jawa Tengah tahun 2017. Namun demikian, kesejahteraan karyawan juga tidak akan tepenuhi seorang wirausahawan tersebut tidak dapat memberdayakan home industrinya dengan baik dan benar. Kata kunci : Etos Kerja, Motivasi Kerja, Pemberdayaan, Kesejahteraan

Abstract

Kompilasi Hukum Islam (KHI) considered an injustice which felt by the grandchildren  from the daughters according to jumhur, who did not take a part because of the z{awi al-arham status, or grandchildren from the sons who are covered by the son, referring to the provisions of KHI which tried to positioned the grandchildren who are covered so grandchildren entitled to acquire heritage treasures as a form of the offer for the concept of justice and welfare for the grandchild who is called the heirs of substitute. The formulation of the problem that wants to find out the answers the are: How is the replacement of the heirs in Kompilasi Hukum Islam? Why does the Kompilasi Hukum Islam determine the heirs of substitute?. To answering the problems above, the writer used law research with the normative juridical approach method, that is a law research conducted by prioritizing the existence of referenced materials or document which called secondary data, includes of primary, secondary, and tertiary law materials. The research specification is an analytical descriptive, which aims to provide an overview of the qualitative methods of law theories and law doctrines as well as the opinions of Islamic jurists.Keywords: The Heirs of Substitute, Kompilasi Hukum Islam (KHI).

Abstract

Rentenir adalah orang yang meminjamkan uang kepada Nasabah dalam rangka memperoleh profit melalui penarikan bunga. Orang yang mencari nafkah dengan membungakan uang; tukang riba;pelepas uang; lintah darat.kegiatan renten adalah suatu bentuk aktivitas yang memberikan pinjaman kepada orang yang membutuhkan dengan bentuk imbalan bunga yang telah ditentukan oleh pihak renten tersebut. Sasaran dari rentenir ialah para pedagang kecil di pasar-pasar dan orang miskin di desa-desa. rentenir ini memanfaatkan kepolosan orang-orang miskin tersebut untuk meraup untung besar. Mereka menawarkan kemudahan dalam mendapatkan uang seberapapun besarnya tanpa jaminan apapun dan anytime-anywhere (kapanpun-dimanapun). Kemudahan inilah yang menjadi alasan mayoritas warga pasar menerima tawaran rentenir dan meminjam uang kepada mereka, meskipun mereka telah mengetahui besarnya bunga yang harus mereka bayar. Besarnya bunga yang dibebankan, mengakibatkan semakin banyaknya hutang mereka. Hutang yang semula hanya Rp 1.000.000,00 dalam satu tempo satu bulan menjadi Rp 1.200.000,00. Ini dikenal dengan sistem “rolasan”. Jika ketika jatuh tempo tidak bisa membayar, maka bulan berikutnya utang beserta bunganya akan dibungakan kembali, jadi dari Rp 1.200.000,00 menjadi Rp 1.400.000,00. Bayangkan ketika kita berhutang Rp 10.000.000,00, maka dalam tempo satu bulan ia harus mengembalikan Rp 12.000.000,00.Sistem pinjaman yang diberikan rentenir adalah Bang Keliling/Bang Harian/ Pinjaman Paket, Hutang Bayar Bunga Mingguan/Bunga Bulanan, dan Gadai Sewa.Berdasarkan hasil penelitian praktik peminjaman uang oleh masyarakat tidak memaksa harus meminjam uang dengan rentenir, artinya debitur atau si peminjam dengan kemauannya sendiri datang meminjam kepada para rentenir dan menyanggupi tentang bunga yang ditetapkan oleh para rentenir yang harus ia bayarkan. Hal ini menggambarkan bahwa antara keduanya telah terjadi kesepakatan dan telah sama-sam rela tentang bunga yang di tetapkan, Penbungaan uang (rente) yang di praktikkan mengalami berlipat ganda karena kreditur harus mebayar utangnya setiap hari berserta bunga yang di tetapkan, selama waktu yang ditentukan dan apabila terlambat membayar besak harinya harus membayar dua harinya dan seterusnya. Dan debitur merasa keberatan dan sulit untuk membayarnya. Dan apabila tidak pandai menggunakan dan yang ia pinjam dan bukan menggunakan untuk kebutuhan produktif maka ia akan berdampak negative dan berakibatkan perekonomian keluarga kurang baik karena harus berbagi penghasilan untuk kebutuhan keluarga dan untuk membayar cicilan kepada rentenir.

Abstract

AbstrakPernikahan bagi manusia adalah sesuatu yang sangat sakral dan mempunyai tujuan yang sakral pula, dan tidak terlepas dari ketentuan-ketentuan yang ditetapkan syari'at agama. Tujuan utama dari pernikahan adalah untuk membentuk keluarga bahagia yang penuh ketenangan cinta dan rasa kasih sayang. Tapi untuk saat ini Keluarga tidak lagi dilihat sebagai ikatan spiritual yang menjadi medium ibadah kepada Sang Pencipta. Kawin-cerai hanya dilihat sebatas proses formal sebagai kontrak sosial antara dua insan yang berbeda jenis. Perkawinan kehilangan makna sakral dimana Allah menjadi saksi atas ijab-kabul yang terjadi. Ini bertolak belakang dengan adagium yang menyatakan keluarga adalah garda terdepan dalam membangun masa depan bangsa peradaban dunia. Dari rahim keluarga lahir berbagai gagasan perubahan dalam menata tatanan masyarakat yang lebih baik. Tidak ada satu bangsa pun yang maju dalam kondisi sosial keluarga yang kering spiritual, atau bahkan sama sekali sudah tidak lagi mengindahkan makna religiusitas dalam hidupnya.Kata Kunci: Keluarga Sakinah, Perkawinan, Quraish Shihab AbstractMarriage for humans is something that is very sacred and has a sacred purpose as well, and not apart from the provisions set by the religious shari'ah.The main purpose of marriage is to form a happy family that is full of peace of love and compassion.But for now the Family is no longer seen as the spiritual bond that becomes the medium of worship to the Creator.Married-divorce is only seen as a formal process as a social contract between two different types.Marriage loses a sacred meaning whereby God bears witness to the affidavits.This is contrary to the adage that the family is the front guard in building the future of the world civilization nation.From the womb of the family was born various ideas of change in organizing a better society.No single nation has advanced in the social condition of a spiritual, spiritual family, or even completely ignoring the meaning of religiosity in its life.Key Word: Sakinah Family, Marriage, Quraish Shihab

Abstract

AbstactThe adopting of children and adopted children is part of substation from law of children safety  which were be part from the law winch life and flourish in civil society in accordance with the  usually and the different motivation and  feel of law winch life and flourish in any area. Therefore, the case of children adoption must be regulated in specific in constriction that.From commentary about that can formulation case as follows: (1) How is the position adopted children in farting of heritage according to heritage KHI? (2) if haven’t the dispute about heritage treasure, how the solution? The kind of this research is descriptive qualitative, where is the releaser is mean to know the condition about what, how, and to par, how much and etc. with the description result data research with word by word or the separated sentence according to category and analysis for getting the conclusion.With this research writer will be describing clarity the position of children in Islamic Law Compilation (KHI). The kind of research use the research library while the technique of analysis is with to find and analysis references primer and secondary. The result of research, is: (1) the definition of adopted children too and there to there are in pasal 171 huruf h KHI which declare that adopted children is the children which in the nurture for the daily of them life, the case of education and any other switch the responsibility from the pure parent to adopted parent by the justices jurisdiction (2) the adoption of children according to KHI not because the justice relation of generation or the blood a child with his / her parent who born. (3) Accomplishment the dispute in family law, in this case marriage and the heritage still be authority of Islamic justice.The suggestions is: (1) in order to the Islamic civil society in Indonesia who want or were do adoption of children suggested to study about the provision of Islamic law use any books about adoption of children so that get the reference about the role of children adoption in al-Qur’an or Hadits. (2) in order to the adopted parent preparation all about the necessary of adopted children is especially about the case of education, welfare and the healthy from now and make a massage in from of the witness, in order to later if the adopted parent is death and leave the heritage, no to inflict the conflict between adopted children and heir from adopted parent.Keyword:Adopted Children, Haritage

Abstract

ABSTRACT                 Religion Affairs Office (KUA) subdistrict Pangenan, Cirebon regency has tasks and functions such as the service,  monitoring and record keeping marriage in their territory. Marriage which has force of law is that marriage which the prerequirement and  pillars of the marriage are met  and the marriage occurs in front of the marriage chief (The Official of Marriage Jotter/PPN). The pillars of marriage are:  The candidate of bride groom, The candidate of bride, Wali (The custodian), two witnesses and the consent (the agreement). In subdistrict Pangenan, the custodian in applying the consent his daughter or  his sister whom under his authority, represent his authority to marriage chief or PPN or the one who is intended to. The custodian represent  his authority to the one who is intended to (a representative) constitutes authority which is given by Islam freely. The consequence of the free authority occured that the custodian mandates it to a representative (wakil) and the representatative remandates to another one (in this research called taukil wakil wali nikah). Seeing this case, KUA subdistrict Pangenan prevents dan forbids the people to do so.The objective of the research is to reveal the people excuses in doing or applying taukil wakil wali nikah, to reveal the KUA excuses why they forbid the practice taukil wakil wali nikah and to know juridical position and implication of taukil wakil wali nikah.The research is a study case research with inductive analysis by applying  juridical and normative literature approach method, that is by studying in depth fiqih and ushul fiqih scribes and corpus, and rules and laws which are related to the case discussed. The source of  primer data which is gained and used is from library and personal literature collection. The data collection technique is by studying in depth the literature, documents, rules and laws and the experts’ opinions and thoughts. The collected data will be used as the thought basis theoritically, and then the data technique is written in logical and systematic essay.In the research conclusion reveals why the subdistrict Pangenan people’s excuses apply taukil wakil wali nikah are the disability factor in doing ijab (offer) and  the custom factor of the people always mandate the consent (the agreement) in a marriage. KUA subdistrict Pangenan excuse in preventing and forbidding taukil wakil wali nikah is because it is inappropriate for Standard Operating Procedure (SOP) in KUA, KUA is as the policy maker in the difference of opinion about  taukil wakil wali nikah and KHI, KMA and PMA do not regulate Taukil wakil wali  nikah. Taukil wakil wali nikah is not written explicitly in rules as the base of marriage in KUA and the juridical implication is that if the consent (the agreement/Ijab qobul) has not occured yet, the authority belongs to the real Wali (Muwakkil) and if the consent has occured, it is needed to repeat the consent (tajdîdu al-nikâh).

Abstract

Indonesia sebagai negara berpenduduk mayoritas muslim memiliki potensi zakat yang sangat besar. Sebab itulah pemerintah mengeluarkan regulasi tentang pengelolaan zakat yakni UU No. 38 Tahun 1999 direvisi dengan UU No. 23 Tahun 2011. Terbitnya UU tersebut diikuti dengan pembentukan Badan Amil Zakat Nasional (BAZNAS) yang berfungsi mengelola dana zakat dari tingkat pusat sampai tingkat daerah. Penelitian ini mengkaji konsep BAZNAS menurut regulasi tentang pengelolaan zakat di Indonesia, realisasi atas regulasi tentang pengelolaan zakat pada BAZNAS kabupaten Ciamis, dan menganalisis kesesuaian antara regulasi tentang pengelolaan zakat dengan realisasinya pada BAZNAS kabupaten Ciamis. Metode penelitian yang digunakan adalah metode kualitatif dengan teknik pengumpulan data berupa wawancara dan observasi.Kata Kunci: Regulasi Pengelolaan Zakat, BAZNAS.
