Abstract

The circulation of alcoholic beverages in Bandung has reached alarming levels, with the RSUD Kota Bandung recording 152 alcohol poisoning cases in 2024 and Polrestabes data showing 67% of fatal traffic accidents involving teenagers occurred under the influence of alcohol. Local Regulation No. 10 of 2024, particularly Article 6 Paragraph (5), was enacted as a normative response, mandating identity verification for consumers aged at least 21 years. This study aims to analyze the implementation, operational barriers, and policy evaluation of the age verification requirement through the perspective of Siyasah Dusturiyah. The researcher applied a juridical-empirical approach using descriptive-analytical methods to examine how the law functions within social reality. Data were collected through in-depth interviews with authoritative sources and participatory observation. The research findings reveal that the identity card verification mechanism functions effectively only in formal businesses with structured management, while small retailers tend to disregard the obligation for economic gain. Disproportionate supervisory capacity and the proliferation of online transactions constitute the main structural barriers weakening regulatory enforcement. A Siyasah Dusturiyah review regards this regulation as a legitimate manifestation of the government's authority to protect rationality (hifz al-'aql) and progeny (hifz al-nasl), yet calls for strengthened cross-sectoral collaboration and digital oversight to ensure public welfare objectives are optimally achieved.   Peredaran minuman beralkohol di Kota Bandung telah mencapai tingkat mengkhawatirkan: RSUD Kota Bandung mencatat 152 kasus keracunan alkohol sepanjang 2024, sementara data Polrestabes Bandung menunjukkan 67% kecelakaan lalu lintas fatal yang melibatkan remaja terjadi di bawah pengaruh alkohol. Kondisi ini menuntut penguatan regulasi yang diwujudkan melalui Perda Kota Bandung Nomor 10 Tahun 2024, khususnya Pasal 6 Ayat (5) tentang kewajiban verifikasi usia minimal 21 tahun. Penelitian ini bertujuan menganalisis implementasi, hambatan operasional, dan evaluasi kebijakan verifikasi usia tersebut melalui perspektif Siyasah Dusturiyah. Peneliti menerapkan pendekatan yuridis-empiris dengan metode deskriptif-analitis guna menelaah bekerjanya hukum dalam realitas sosial. Data dikumpulkan melalui wawancara mendalam dengan narasumber otoritas dan observasi partisipatif. Hasil penelitian menunjukkan bahwa mekanisme verifikasi usia berjalan efektif hanya pada usaha formal yang memiliki manajemen terstruktur dan kekhawatiran terhadap sanksi, sementara pedagang eceran cenderung mengabaikan kewajiban tersebut. Kapasitas pengawasan yang tidak proporsional dengan luas wilayah serta maraknya transaksi daring menjadi hambatan struktural yang melemahkan efektivitas penegakan regulasi. Tinjauan Siyasah Dusturiyah memandang regulasi ini sebagai manifestasi sah kewenangan pemerintah dalam melindungi akal (hifz al-'aql) dan keturunan (hifz al-nasl), namun menuntut penguatan kolaborasi lintas sektor dan pengawasan digital agar tujuan kemaslahatan publik tercapai secara optimal.

Abstract

This study analyzes the implementation of Regional Regulation of Pandeglang Regency Number 4 of 2008 concerning Environmental Cleanliness, Beauty, and Order (K3) at Teluk Labuan Beach during 2024–2025. The research is motivated by pressing environmental conditions, as data from SIPSN 2024 records an annual waste generation of 191,868.84 tons in Pandeglang Regency, with only about 34 percent properly managed. In addition, the 2024 Waste Management Performance Index (IKPS) places the regency at a low score of 44.7, particularly due to minimal human resource capacity and budget allocation. Teluk Labuan Beach, previously labeled among the dirtiest beaches in Indonesia by the Pandawara Group in 2023, continues to face recurring waste accumulation despite repeated clean-up initiatives. This study applies a descriptive qualitative method through in-depth interviews with key stakeholders, including the Environmental Agency, sub-district authorities, village officials, and local communities, supported by documentation and field observations. The analysis employs theories of legal effectiveness, policy implementation, and the perspective of siyasah dusturiyah. The findings identify several major challenges, including limited operational resources, low public awareness, weak enforcement of sanctions, and the natural topography of the bay that facilitates waste buildup. From the perspective of siyasah dusturiyah, the regulation’s implementation has not fully embodied the principles of public welfare and justice, indicating the need for stronger institutional commitment and comprehensive policy reinforcement.
