Abstract

Perkembangan teknologi digital menimbulkan berbagai permasalahan dalam penegakan hukum di Indonesia, seperti meningkatnya kejahatan siber, keterbatasan regulasi yang adaptif, serta rendahnya kesiapan aparat penegak hukum dalam menghadapi pelanggaran hukum berbasis digital. Penelitian ini bertujuan untuk menganalisis dinamika hukum serta tantangan dan peluang penegakan hukum di era digital. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang- undangan, konseptual, dan analitis melalui kajian terhadap regulasi dan literatur hukum yang relevan. Hasil penelitian menunjukkan bahwa meskipun penegakan hukum di era digital menghadapi berbagai tantangan, digitalisasi sistem peradilan dan pemanfaatan teknologi informasi memberikan peluang strategis untuk meningkatkan efisiensi, transparansi, dan akuntabilitas. Sehingga diperlukan pembaruan regulasi dan peningkatan kapasitas aparat penegak hukum agar penegakan hukum di era digital dapat berjalan secara efektif dan berkeadilan.

Abstract

The debate on judicial activism and judicial restraint represents a crucial issue in constitutional interpretation practices in Indonesia, particularly regarding the role of judges in balancing constitutional supremacy and democratic principles. This study aims to analyze the limits of judicial legitimacy in constitutional interpretation by examining the tendency toward activism and restraint in constitutional court decisions. This research employs a normative juridical method using statutory and case approaches, focusing on decisions of the Constitutional Court. The findings indicate that judicial activism is necessary in certain circumstances to fill legal gaps and protect constitutional rights, but it risks exceeding legitimate boundaries without strong reasoning and prudential principles. Conversely, judicial restraint helps maintain legal stability but may hinder legal development if applied rigidly. Therefore, a balance between these approaches is essential, grounded in the constitution, the rule of law, and principles of justice. This study concludes that the limits of judicial legitimacy lie in maintaining independence while ensuring accountability in constitutional interpretation.

Abstract

Debates regarding the position and role of the Constitutional Court within the Indonesian constitutional system have become a crucial issue, particularly in the effort to realize a democratic rule of law state. As the guardian of the constitution, the Constitutional Court holds strategic authority in upholding constitutional supremacy while ensuring that democratic principles are properly maintained. This study aims to analyze the position of the Constitutional Court within the Indonesian legal system and its contribution to the realization of a democratic rule of law state. The research employs a normative juridical method with statutory and conceptual approaches, supported by an analysis of Constitutional Court decisions. The results indicate that the Constitutional Court plays a central role in maintaining the constitutionality of laws, protecting the constitutional rights of citizens and controlling the exercise of power to prevent deviations from democratic principles. However, in practice, the Constitutional Court also faces various challenges, including the potential expansion of authority through constitutional interpretation and political dynamics that may affect its independence. Therefore, strengthening the position of the Constitutional Court is necessary through clarifying the limits of its authority, enhancing the integrity of constitutional judges and ensuring consistency in placing the constitution as the primary basis for all decisions. This study affirms that the Constitutional Court is a fundamental pillar in realizing a democratic rule of law state in Indonesia.
