Abstract

This study aims to analyze the legal status of Artificial Intelligence-based works within the Indonesian copyright system, identify gaps in the legal framework regarding copyright ownership of AI works under Law No. 28 of 2014 on Copyright, and formulate directions for legal reform to ensure legal certainty in the digital age. The study employs a normative legal methodology with legislative, conceptual, and comparative approaches through an analysis of legislation, legal doctrine, court decisions, and scholarly literature related to Artificial Intelligence and intellectual property rights. The research findings indicate that Indonesia’s copyright legal system remains rooted in the human authorship paradigm, which positions humans as the sole creators; consequently, works generated by generative AI have not yet received legal certainty regarding protection. This regulatory gap creates ambiguity regarding ownership attribution, economic rights, moral rights, and legal liability in the commercialization of AI-based digital works. This study underscores the need for a reconstruction of copyright law through the reformulation of the concept of the creator, the redefinition of the principle of originality, and the establishment of adaptive and transformative Artificial Intelligence regulations to maintain a balance between technological innovation, intellectual property protection, and national legal certainty.

Abstract

This study examines the legal implications of the use of the “Gudang Baru” trademark as an alleged trademark infringement and form of unfair competition against the well established “Gudang Garam” trademark within the Indonesian legal system. The research adopts a non empirical normative juridical approach based on statutory analysis, case analysis, and conceptual legal reasoning. Primary legal materials consist of international intellectual property instruments, national trademark legislation, competition law regulations, trademark registration rules, and judicial decisions relevant to the dispute. The findings indicate that the legal assessment extends beyond visual similarity and requires consideration of consumer confusion, the protection of well known trademarks, good faith registration requirements, and broader principles of market fairness. The study further demonstrates that the status of Gudang Garam as a well known trademark strengthens its entitlement to enhanced legal protection under domestic and international legal frameworks. The analysis also reveals that the use of the Gudang Baru trademark raises concerns regarding passing off, free riding, and bad faith registration that may distort fair competition. Stronger integration between trademark law and competition law is necessary to preserve legal certainty, protect commercial goodwill, and promote equitable market competition.

Abstract

This study examines the adequacy of intellectual property protection for Traditional Cultural Expressions within Indonesia through a non empirical normative legal research design. It analyzes statutory provisions, doctrinal scholarship, and international frameworks to evaluate whether existing mechanisms sufficiently safeguard communal cultural rights. The findings indicate persistent structural misalignment between communal ownership systems and conventional copyright principles, particularly regarding authorship and originality requirements. The study further identifies weaknesses in benefit sharing arrangements, fragmented cultural documentation, and limited enforcement capacity in cross border contexts. Additionally, the emergence of artificial intelligence and generative digital technologies introduces new legal uncertainties concerning reproduction and cultural appropriation. The analysis highlights that current regulatory instruments do not adequately address these multidimensional challenges. It argues for a more integrated legal approach that combines statutory reform with conceptual reorientation toward community based governance. The study concludes that a sui generis framework is essential to ensure equitable protection, cultural sustainability, and legal certainty for Traditional Cultural Expressions in the evolving digital era.

Abstract

This study examines the effectiveness of communal intellectual property protection in safeguarding regional specialty products and promoting local economic growth in Indonesia through a normative legal research approach. The analysis is based on statutory and conceptual approaches using primary legal sources, including Law Number 20 of 2016, Law Number 28 of 2014, Government Regulation Number 56 of 2022, and Ministerial Regulation Number 13 of 2017, complemented by scholarly literature on intellectual property governance and regional development. The findings indicate that Indonesia has established a relatively comprehensive legal framework for protecting geographical indications, traditional knowledge, and traditional cultural expressions. Despite this regulatory foundation, implementation remains constrained by documentation deficiencies, fragmented institutional authority, limited community participation, and uneven regional administrative capacity. The study further demonstrates that effective communal intellectual property protection contributes to product differentiation, market reputation, community empowerment, regional competitiveness, and sustainable economic development. Legal protection functions not only as a mechanism for cultural preservation but also as a strategic development instrument. Strengthening institutional coordination, improving registration systems, and expanding community based governance are essential to optimize the developmental benefits of communal intellectual property protection within Indonesia's regional economic landscape.

Abstract

This study examines the legal protection available to football broadcasting license holders against illegal streaming practices in Indonesia through a normative juridical approach. The research relies on primary legal materials consisting of Law Number 28 of 2014 on Copyright, Law Number 32 of 2002 on Broadcasting, Government Regulation Number 36 of 2018 concerning the Registration of Intellectual Property Licensing Agreements, and other relevant regulations, complemented by scholarly literature and doctrinal studies. The analysis demonstrates that football broadcasting licenses possess a legally protected position within the framework of copyright and related rights, granting license holders authority to commercially exploit broadcasting content and to seek legal remedies against unauthorized retransmission. Illegal streaming constitutes an infringement of economic rights and neighbouring rights while simultaneously violating broadcasting regulations governing the dissemination of audiovisual content. Existing protection mechanisms include preventive measures through license registration, regulatory supervision, and public legal awareness, as well as repressive measures through civil litigation, criminal prosecution, and alternative dispute resolution. The findings indicate that Indonesian law provides a relatively comprehensive normative framework, although challenges associated with digital technology, platform accountability, and enforcement effectiveness continue to affect the practical realization of legal protection. Strengthening institutional coordination and adaptive digital governance remains essential for improving future protection.

Abstract

The increasing globalization of trade has intensified trademark disputes involving well-known trademarks, particularly those arising from registrations made in bad faith. In contemporary trademark law, protection is no longer confined to similar goods or services, as the unauthorized use of well-known marks on dissimilar goods may create consumer confusion, dilute trademark reputation, and result in unfair competition. This study aims to examine the legal criteria for determining well-known trademark status and to analyze the legal construction of bad faith in trademark registration involving dissimilar goods through the Starbucks trademark dispute in Indonesia. The research employs a normative legal research method using statutory, conceptual, and case approaches. Primary, secondary, and tertiary legal materials were collected through library research and analyzed using qualitative descriptive methods. The findings reveal that the status of a well-known trademark is determined not only by formal registration but also by public recognition, promotional intensity, international reputation, duration of use, and market penetration. The study further demonstrates that trademark registration for dissimilar goods may constitute bad faith when intended to exploit the goodwill of a famous mark. Supreme Court Decision No. 836 K/Pdt.Sus-HKI/2022 confirms that the first-to-file principle cannot be applied rigidly when evidence of bad faith and the protection of a well-known trademark are at stake. The decision reflects a substantive approach that prioritizes fairness, consumer protection, and the prevention of unfair competition. These findings highlight the importance of balancing procedural certainty with substantive justice in strengthening the protection of well-known trademarks within Indonesia’s trademark law framework.

Abstract

Perkembangan sektor perbankan syariah di Indonesia menunjukkan peningkatan yang signifikan seiring dengan meningkatnya kebutuhan masyarakat terhadap sistem keuangan yang sesuai dengan prinsip syariah. Dalam konteks ini, hukum ekonomi Islam berperan penting sebagai kerangka hukum yang mengatur operasional perbankan syariah agar sesuai dengan nilai keadilan, kemaslahatan, transparansi, serta larangan riba, gharar, dan maysir. Penelitian ini bertujuan untuk menganalisis peran hukum ekonomi Islam dalam perkembangan perbankan syariah di Indonesia, termasuk tantangan dan upaya penguatannya. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan deskriptif kualitatif melalui studi kepustakaan terhadap peraturan perundang-undangan, fatwa DSN-MUI, dan sumber akademik relevan. Hasil penelitian menunjukkan bahwa hukum ekonomi Islam berperan dalam memberikan kerangka hukum operasional, menjamin kepatuhan syariah, melindungi para pihak, mendorong inovasi produk, serta meningkatkan kepercayaan masyarakat. Oleh karena itu, penguatan regulasi, literasi keuangan syariah, dan sinergi kelembagaan menjadi hal penting dalam mendukung keberlanjutan perbankan syariah.
