Abstract

This study aims to analyze how people with visual impairments express their motivation through communicative actions in building social independence within digital spaces. Grounded in Motivation Action Theory (Heckhausen & Heckhausen, 2018), communication is understood as a goal-directed motivated action situated in social contexts. The research employs a qualitative content analysis design, examining open-access digital materials such as public podcasts, YouTube channels of disability organizations, online news portals, and inclusive digital campaigns that represent the communicative practices of visually impaired individuals. The analysis focuses on identifying motivational patterns, communicative strategies, and the meanings embedded in textual, audio, and visual content. The findings reveal four primary motivational drives behind their communicative actions: (1) strengthening public awareness, (2) demonstrating personal competence, (3) building community solidarity, and (4) expanding social and economic independence. Digital communication serves as a strategic medium for asserting identity, challenging stigma, and reinforcing social autonomy. Theoretically, this research extends the application of Motivation Action Theory within disability communication studies. Practically, it contributes to the development of more inclusive public communication strategies and media policies for people with visual impairments in Indonesia..

Abstract

This study aims to analyze the implementation of the principle of freedom of contract in Indonesian positive law and its implications for legal certainty and justice for the parties in an agreement. The main focus of this study is directed at how to balance individual autonomy (party autonomy) with legal protection for parties with weaker bargaining power, especially in the use of standard contracts. The research method used is normative juridical with a statute approach and a conceptual approach. Data were collected through a literature study of primary legal materials such as the Civil Code and relevant secondary and tertiary legal materials. The results of the study indicate that the implementation of the principle of freedom of contract as regulated in Article 1338 paragraph (1) of the Civil Code has provided legal certainty through the principle of pacta sunt servanda. However, in practice, this legal certainty is often formalistic and tends to benefit parties who are economically and informationally dominant. Substantive justice is often neglected when freedom of contract is used as an instrument of exploitation through disproportionate exoneration clauses. This study concludes that freedom of contract is not absolute, but must be limited by the principles of good faith, propriety, and public order in order to create a balance of rights and obligations that is just for all parties.

Abstract

This research aims to analyze the reconstruction of the judex facti role by the High Court in narcotics cases involving law enforcement officials. Using a normative juridical approach, this study conducts an in-depth analysis of Appellate Court Decision Number 130/PID.SUS/2023/PT DKI in the case of Inspector General Teddy Minahasa Putra. The findings reveal that the High Court failed to carry out its corrective function substantively as a judex facti. The study identifies three fundamental weaknesses: first, factual reconstruction was not supported by scientific verification and in-depth evidence analysis; second, there was non-compliance with electronic evidence standards as stipulated in Supreme Court Regulation No. 4 of 2020 and the Electronic Information and Transactions Law; third, structural bias was evident in handling this institutional case. This research recommends comprehensive reforms in the electronic evidence system through amendments to the Criminal Procedure Code (KUHAP), standardization of digital chain of custody, and strengthening the impartiality of appellate courts. The study makes a significant contribution to the development of criminal procedure law in the digital era, particularly regarding the accountability of the appellate judiciary system.
