Abstract

This study examines the factors that lead female students at UIN Siber Syekh Nurjati Cirebon to postpone marriage and analyzes these decisions through the lens of Rational Choice Theory. Using a qualitative, phenomenological approach, the study involved 10 unmarried final-semester female students purposively selected from several study programs. Data were collected through in-depth interviews, participatory observation, and supporting documentation, and were analyzed using thematic analysis, with triangulation employed to enhance trustworthiness. The findings show that marriage postponement is primarily driven by educational aspirations, career orientation, economic readiness, psychosocial maturity, and family expectations. They further indicate that female students do not view delayed marriage as a rejection of marriage itself, but rather as a rational and strategic response to the competing demands of self-development, financial stability, and future family life. From the perspective of Rational Choice Theory, marriage postponement can be understood as a negotiated decision through which students weigh the costs, benefits, opportunities, and constraints associated with marriage timing. The study suggests that delayed marriage among female students reflects changing aspirations and forms of agency among educated Muslim women in contemporary Indonesia. These findings have important implications for women’s empowerment, premarital education, and student support policies within Islamic higher education institutions.

Abstract

Artikel ini membahas sistem peradilan pidana di Indonesia sering kali dihadapkan pada ketidakseimbangan antara hak negara sebagai penuntut dan hak individu sebagai tersangka, di mana akses terhadap keadilan dapat terganggu tanpa representasi hukum yang memadai. Peran advokat sebagai pembela hukum menjadi krusial dalam menjamin prinsip praduga tak bersalah, hak atas bantuan hukum, dan proses peradilan yang adil sebagaimana diamanatkan dalam Undang-Undang Nomor 16 Tahun 2004 tentang Kejaksaan Republik Indonesia, Kitab Undang-Undang Hukum Acara Pidana (KUHAP), serta Konvensi Hak Asasi Manusia Internasional. Penelitian ini bertujuan untuk menganalisis peran advokat dalam melindungi hak tersangka, mengidentifikasi tantangan seperti keterbatasan sumber daya, konflik kepentingan, dan pengaruh eksternal, serta merumuskan rekomendasi untuk penguatan etika dan kompetensi advokat.

Abstract

Tramadol is a prescription opioid analgesic with legitimate medical uses but a significant potential for misuse, dependence, intoxication, and harmful interactions when consumed without medical supervision. This study analyzes the risk factors, health and psychosocial impacts, and legal framework governing tramadol misuse among adolescents in Indonesia. It employs normative legal research combined with a literature-review approach using statutory, conceptual, and socio-legal perspectives. Primary legal materials include Law Number 17 of 2023 on Health, the Indonesian Food and Drug Authority regulations on frequently misused medicines, and relevant pharmaceutical-control provisions. Secondary materials consist of scholarly books and journal articles on adolescent deviance, family counseling, peer influence, psychological consequences, and tramadol misuse. The materials are qualitatively analyzed through classification, comparison, and legal interpretation. The findings show that adolescent tramadol misuse is driven by peer pressure, easy access, curiosity, family conflict, stress, weak supervision, and the normalization of drug use within deviant subcultures. Its effects may include dependence, mood changes, impaired judgment, aggression, school disengagement, social isolation, and serious physical risks. Legally, tramadol is not automatically classified as a narcotic under the Narcotics Law; it is regulated as a prescription medicine and as a frequently misused medicine requiring strict pharmaceutical control. Therefore, users cannot simply be charged under narcotics provisions solely because they possess or consume tramadol. Criminal liability primarily concerns unlawful production, distribution, sale, or circulation of pharmaceutical products, while adolescents who misuse tramadol require health-oriented, child-protection, counseling, family, and restorative interventions. Effective policy must combine supply control, pharmacy supervision, online-market enforcement, school-based prevention, family counseling, and accessible treatment services.

Abstract

Fenomena pengagungan terhadap individu atau kelompok yang dianggap memiliki komitmen beragama tinggi, seperti ustadz, kiai, atau tokoh agama, masih sangat kuat dalam kehidupan bermasyarakat. Namun, realitas sosial di era modern menunjukkan adanya berbagai kasus penyimpangan yang dilakukan oleh sebagian tokoh agama, mulai dari penyalahgunaan otoritas, manipulasi ajaran agama, hingga keterlibatan dalam tindak kriminal. Kondisi ini menimbulkan pertanyaan kritis mengenai sejauh mana komitmen beragama benar-benar berimplikasi pada perilaku kepatuhan, khususnya dalam ranah keluarga. Permasalahan ini menjadi semakin relevan ketika dikaitkan dengan pasangan suami istri dari generasi Z, yang hidup dalam dinamika sosial dan budaya yang berbeda dengan generasi sebelumnya. Penelitian ini bertujuan untuk mengeksplorasi tingkat komitmen beragama pada pasangan suami istri generasi Z, mengeksplorasi tingkat kepatuhan mereka dalam menjalankan hak dan kewajiban perkawinan, serta menganalisis secara statistik hubungan antara komitmen beragama dan kepatuhan terhadap hak dan kewajiban suami istri menurut hukum keluarga Islam. Metode yang digunakan adalah desain deskriptif kuantitatif dengan pendekatan sosio-legal, yaitu pendekatan yang mengintegrasikan analisis normatif hukum keluarga Islam dengan realitas sosial yang terjadi di masyarakat. Data dianalisis menggunakan uji korelasi untuk melihat hubungan antara variabel komitmen beragama dan kepatuhan terhadap hak dan kewajiban suami istri. Hasil penelitian menunjukkan bahwa koefisien korelasi antara komitmen beragama dan kepatuhan terhadap hak dan kewajiban suami istri sebesar -0.088 dengan nilai signifikansi (p-value) sebesar 0.329. Temuan ini menunjukkan bahwa hubungan antara kedua variabel bersifat negatif sangat lemah dan tidak signifikan secara statistik. Dengan demikian, hipotesis yang menyatakan adanya hubungan antara komitmen beragama dan kepatuhan dalam menjalankan hak dan kewajiban suami istri tidak terbukti. Hal ini mengindikasikan bahwa pada pasangan generasi Z, komitmen beragama tidak secara otomatis berbanding lurus dengan kepatuhan dalam menjalankan peran dan tanggung jawab perkawinan, dan kedua aspek tersebut cenderung berjalan secara independen.
