Abstract

Abstract: This study examines the application of the double track system and the anti-SLAPP principle in Indonesian criminal law, with a focus on Decision Number 374/Pid.Sus/2024/PT SMG. The research addresses two questions: how the double track system operates in cases involving environmental defenders, and to what extent the anti-SLAPP principle influences judicial reasoning. A normative juridical approach is employed using statutory, conceptual, and case-based analysis of relevant legal instruments, doctrines, and court decisions. The findings show that the court may acknowledge the formal fulfillment of criminal elements while refraining from imposing punishment when the act is closely linked to environmental advocacy and public interest. The integration of the double-track system and the anti-SLAPP principle supports a more proportional and context-sensitive approach to criminal adjudication. The case analysis also reveals limitations, including the absence of clear procedural standards and the risk of inconsistent application across similar cases. Additionally, the protection of environmental defenders is not absolute and must be balanced with the rights of affected individuals. This study proposes a more structured integration of both principles to strengthen legal certainty, ensure proportionality, and support the protection of environmental defenders within a balanced framework of criminal justice. Studi ini meneliti penerapan sistem jalur ganda dan prinsip anti-SLAPP dalam hukum pidana Indonesia, dengan fokus pada Keputusan Nomor 374/Pid.Sus/2024/PT ​​SMG. Penelitian ini membahas dua pertanyaan: bagaimana sistem jalur ganda beroperasi dalam kasus-kasus yang melibatkan pembela lingkungan, dan sejauh mana prinsip anti-SLAPP memengaruhi penalaran yudisial. Pendekatan yuridis normatif digunakan dengan menggunakan analisis hukum, konseptual, dan berbasis kasus dari instrumen hukum, doktrin, dan keputusan pengadilan yang relevan. Temuan menunjukkan bahwa pengadilan dapat mengakui pemenuhan formal unsur-unsur pidana sambil menahan diri dari menjatuhkan hukuman ketika tindakan tersebut terkait erat dengan advokasi lingkungan dan kepentingan umum. Integrasi sistem jalur ganda dan prinsip anti-SLAPP mendukung pendekatan yang lebih proporsional dan peka konteks terhadap peradilan pidana. Analisis kasus juga mengungkapkan keterbatasan, termasuk tidak adanya standar prosedural yang jelas dan risiko penerapan yang tidak konsisten di berbagai kasus serupa. Selain itu, perlindungan pembela lingkungan tidak bersifat mutlak dan harus diseimbangkan dengan hak-hak individu yang terdampak. Studi ini mengusulkan integrasi yang lebih terstruktur dari kedua prinsip tersebut untuk memperkuat kepastian hukum, memastikan proporsionalitas, dan mendukung perlindungan para pembela lingkungan dalam kerangka peradilan pidana yang seimbang.            Keywords: Environmental Defender; Double Track System; Anti-SLAPP; Criminal Sanction; Judicial Decision.

Abstract

This study examines how institutionalized civic participation shapes governance performance and sustainability outcomes across Indonesian localities through an empirical mixed-methods design integrating survey modeling and qualitative inquiry. Quantitative findings demonstrate that participatory intensity predicts governance responsiveness, policy learning capacity, and sectoral sustainability performance, while qualitative evidence reveals that deliberative forums operate as adaptive interfaces connecting citizen knowledge with administrative decision-making. Cross-scalar coordination emerges as a central mechanism through which participation enhances procedural legitimacy, collective efficacy, and institutional trust, particularly when civil society mediation and digital engagement infrastructures expand inclusivity and accountability. Environmental initiatives illustrate how participatory practices embed sustainability norms into routine governance, producing iterative feedback loops that strengthen implementation resilience. Persistent structural constraints, including uneven institutional capacity and symbolic inclusion, moderate these gains and highlight the necessity of organizational reform. The study contributes a multi-layered analytical framework that conceptualizes participation as a governance technology capable of generating measurable sustainability dividends when supported by institutional coherence, digital competence, and civic learning, advancing theoretical and methodological debates on participatory sustainability governance.

Abstract

The rapid expansion of digital infrastructures and algorithmic information systems has intensified debates concerning the right to be forgotten (RTBF) and the protection of digital reputation. This study conducts a doctrinal-normative analysis of RTBF within Indonesian cyber law, examining its statutory basis under the Electronic Information and Transactions Law and the Personal Data Protection framework. Through systematic statutory interpretation, conceptual analysis, and limited comparative evaluation with transnational data protection standards, the research identifies significant normative fragmentation in the regulation of erasure rights. Sectoral examination of blockchain immutability, artificial intelligence–generated deepfakes, child digital exploitation, doxing, digital banking, and digital inheritance reveals structural tensions between reputational protection, transparency obligations, technological permanence, and legal certainty. The study proposes a structured balancing model grounded in legitimacy of purpose, proportionality, public interest, technological feasibility, and evidentiary integrity. By reconceptualizing digital reputation as a dignity-based and sovereignty-linked legal interest, this research advances a coherent normative framework that strengthens doctrinal clarity and supports principled adjudication of erasure claims in Indonesia’s evolving cyber governance architecture.

Abstract

Contemporary armed conflicts have generated complex patterns of forced displacement that challenge the adequacy of traditional refugee protection frameworks. This article examines the role of international human rights law in safeguarding refugees within the context of modern conflicts characterized by protracted violence, institutional fragility, and evolving displacement drivers. Using a normative legal research methodology, the study analyzes the convergence between international human rights law, refugee law, and international humanitarian law, with particular attention to enforcement mechanisms and judicial practice. The findings reveal that human rights law provides a universal and enforceable normative foundation that extends protection beyond formal refugee status, strengthens the principle of non-refoulement, and enhances accountability through judicial oversight. The article further identifies emerging challenges, including temporary protection regimes, climate-related displacement, and digital governance, which require adaptive human rights-based responses. By situating refugee protection within a rights-centered legal framework, this study underscores the continuing relevance of international human rights law as a vital instrument for protecting displaced populations amid increasingly complex and unstable global conflict environments.

Abstract

This study investigates Indonesian consumers’ intentions to purchase eco-friendly household  This study examines consumer intentions toward eco-friendly household products in Indonesia using the Theory of Planned Behaviour (TPB) as the primary analytical framework. Relying exclusively on qualitative document analysis, the research synthesizes findings from reports, policy documents, and institutional publications to explore how attitudes, subjective norms, and perceived behavioral control shape sustainable purchasing intentions. Results indicate that consumers develop positive attitudes when they perceive eco-friendly products as beneficial for the environment, energy efficient, safe, and cost-effective. Subjective norms, particularly those emerging from family and close social groups, exert strong influence within Indonesia’s collectivist cultural context. Perceived behavioral control is shaped by environmental knowledge, green trust, product availability, affordability, and the clarity of environmental information, which together determine consumers’ sense of capability to adopt sustainable products. Despite rising environmental awareness, barriers such as limited product access and price premiums continue to inhibit intention-to-behavior conversion. The study highlights the importance of expanding TPB with contextual variables such as knowledge and trust to enhance explanatory power. These insights provide implications for policymakers, manufacturers, and sustainability advocates aiming to strengthen eco-friendly household consumption in Indonesia
