Abstract

Abstract: This study examines the application of the double track system and the anti-SLAPP principle in Indonesian criminal law, with a focus on Decision Number 374/Pid.Sus/2024/PT SMG. The research addresses two questions: how the double track system operates in cases involving environmental defenders, and to what extent the anti-SLAPP principle influences judicial reasoning. A normative juridical approach is employed using statutory, conceptual, and case-based analysis of relevant legal instruments, doctrines, and court decisions. The findings show that the court may acknowledge the formal fulfillment of criminal elements while refraining from imposing punishment when the act is closely linked to environmental advocacy and public interest. The integration of the double-track system and the anti-SLAPP principle supports a more proportional and context-sensitive approach to criminal adjudication. The case analysis also reveals limitations, including the absence of clear procedural standards and the risk of inconsistent application across similar cases. Additionally, the protection of environmental defenders is not absolute and must be balanced with the rights of affected individuals. This study proposes a more structured integration of both principles to strengthen legal certainty, ensure proportionality, and support the protection of environmental defenders within a balanced framework of criminal justice. Studi ini meneliti penerapan sistem jalur ganda dan prinsip anti-SLAPP dalam hukum pidana Indonesia, dengan fokus pada Keputusan Nomor 374/Pid.Sus/2024/PT ​​SMG. Penelitian ini membahas dua pertanyaan: bagaimana sistem jalur ganda beroperasi dalam kasus-kasus yang melibatkan pembela lingkungan, dan sejauh mana prinsip anti-SLAPP memengaruhi penalaran yudisial. Pendekatan yuridis normatif digunakan dengan menggunakan analisis hukum, konseptual, dan berbasis kasus dari instrumen hukum, doktrin, dan keputusan pengadilan yang relevan. Temuan menunjukkan bahwa pengadilan dapat mengakui pemenuhan formal unsur-unsur pidana sambil menahan diri dari menjatuhkan hukuman ketika tindakan tersebut terkait erat dengan advokasi lingkungan dan kepentingan umum. Integrasi sistem jalur ganda dan prinsip anti-SLAPP mendukung pendekatan yang lebih proporsional dan peka konteks terhadap peradilan pidana. Analisis kasus juga mengungkapkan keterbatasan, termasuk tidak adanya standar prosedural yang jelas dan risiko penerapan yang tidak konsisten di berbagai kasus serupa. Selain itu, perlindungan pembela lingkungan tidak bersifat mutlak dan harus diseimbangkan dengan hak-hak individu yang terdampak. Studi ini mengusulkan integrasi yang lebih terstruktur dari kedua prinsip tersebut untuk memperkuat kepastian hukum, memastikan proporsionalitas, dan mendukung perlindungan para pembela lingkungan dalam kerangka peradilan pidana yang seimbang.            Keywords: Environmental Defender; Double Track System; Anti-SLAPP; Criminal Sanction; Judicial Decision.

Abstract

The expansion of digital communication infrastructures has transformed democratic participation, positioning youth as central actors in emerging forms of networked civic engagement while simultaneously subjecting their participation to institutional framing and governance narratives. Despite growing scholarly attention to digital citizenship and online activism, limited research has examined how global civic engagement reports construct and legitimize youth participation through narrative structures that shape policy expectations and democratic imaginaries. This study employs a non-empirical qualitative design based on interpretive document analysis and narrative policy analysis, examining transnational civic engagement reports published between 2015 and 2025. Through multi-stage coding that combines narrative structuring, thematic interpretation, and cross-document comparison, the study identifies recurring storylines that position youth as innovators, governance partners, and symbols of democratic renewal, while also revealing narratives of fragility, risk, and institutional control. The findings indicate that global reports function not only as descriptive accounts but also as discursive mechanisms that define the normative boundaries of legitimate participation and influence how digital democracy is conceptualized and operationalized. The study concludes that understanding youth participation in digital democracy requires attention to narrative framing processes that shape democratic meaning, policy priorities, and future institutional expectations, thereby highlighting the analytical importance of narrative approaches in contemporary democracy research.

Abstract

This study investigates the interplay of stylistic patterns, code-switching, and metaphorical pragmatics in shaping cultural identity in contemporary Indonesian poetry, adopting a qualitative empirical approach through the analysis of twenty poems published between 2020 and 2025. Utilizing purposive sampling, the corpus encompasses works from both emerging and established poets, reflecting diverse regional, social, and generational perspectives. Data collection combined textual compilation with contextual metadata, while analysis employed a coding schema integrating stylistic, morphological, and pragmatic features, validated through expert review and inter-coder reliability. Findings reveal that code-switching and code-mixing are strategically deployed to negotiate hybrid identities, signaling local heritage, cosmopolitan sensibilities, and generational positioning, whereas metaphorical devices serve pragmatic functions that embed ethical, social, and historical meanings. Morphological innovations and phonostylistic features enhance semantic density and aesthetic impact, highlighting the deliberate orchestration of linguistic resources. The study demonstrates that contemporary Indonesian poetry functions as a semiotically rich site for cultural expression, providing theoretical and methodological insights into the analysis of hybrid linguistic strategies and the dynamic construction of cultural identity in literary texts.

Abstract

The increasing competitiveness of global tourism markets has intensified the strategic importance of understanding the behavioral mechanisms that encourage tourists to revisit destinations, particularly in emerging tourism contexts characterized by uneven service standards and dynamic visitor expectations. This study investigates the interrelationships between service quality, tourist satisfaction, and revisit intention, aiming to clarify their causal structure within emerging destinations. Employing an empirical, quantitative research design, data were collected from domestic and international tourists who had visited selected emerging destinations within the previous twelve months. Using a structured questionnaire and purposive sampling, the study analyzed responses through structural equation modeling to test both direct and mediated effects among the key constructs. The results demonstrate that service quality significantly influences tourist satisfaction, while tourist satisfaction exerts a strong and positive effect on revisit intention. Furthermore, tourist satisfaction partially mediates the relationship between service quality and revisit intention, with the indirect effect exceeding the direct effect. These findings indicate that revisit intention is primarily shaped through tourists’ post-consumption evaluative processes rather than service performance alone. The study contributes theoretically by refining the service quality–satisfaction–loyalty framework in emerging destination settings and offers practical insights for destination managers seeking sustainable competitiveness through satisfaction-oriented service strategies.

Abstract

This study synthesizes interdisciplinary scholarship to explain how urbanization and structural transformation reconfigure local communities in Southeast Asia through multi-scalar institutional, spatial, and sustainability dynamics. The analysis demonstrates that economic restructuring, migration, and mega-urban expansion operate as interdependent processes that reshape governance arrangements, inequality patterns, and community agency. Institutional mediation emerges as a critical mechanism translating macro transformation into differentiated social outcomes, while community practices actively renegotiate access to resources and representation. Sustainability transitions further embed ecological constraints within urban development, positioning resilience as a co-produced achievement of governance innovation and collective adaptation. By integrating structural, socio-spatial, and institutional perspectives, the study advances a unified framework that conceptualizes communities as active nodes within evolving urban systems. This framework clarifies how inequality, environmental risk, and governance fragmentation interact across scales, generating adaptive pathways rather than linear outcomes. The findings contribute to urban theory by foregrounding community agency in structural change and offer analytically grounded insights for policy approaches that align economic transformation, social inclusion, and ecological resilience in rapidly urbanizing regions.

Abstract

This study examined the effects of structured collaborative learning on student engagement and learning outcomes in secondary education using an empirical quasi-experimental design with a non-equivalent control group. Participants were purposively recruited from one school and allocated at the class level to either an experimental group receiving cooperative learning with defined roles, peer-regulation prompts, and task interdependence, or a comparison group receiving teacher-directed instruction. Data were collected through standardized pre-test and post-test achievement measures, structured classroom observations, and a multidimensional engagement questionnaire assessing behavioral, emotional, and cognitive engagement. ANCOVA results indicated that the experimental group achieved significantly higher adjusted post-test scores after controlling for baseline differences. Engagement analyses showed greater gains across all engagement dimensions in the experimental condition, with the strongest improvement in cognitive engagement. Regression-based modeling revealed that cognitive engagement was the most powerful predictor of post-test achievement, followed by behavioral engagement, while emotional engagement showed a weaker direct association under statistical control. The findings demonstrate that structured collaboration enhances learning by strengthening metacognitive regulation and sustained cognitive investment.

Abstract

This article examines how contemporary geopolitical rivalry reshapes the international legal order through normative reinterpretation, selective enforcement, and pluralized economic governance. Employing a non-empirical normative–theoretical methodology, the study integrates doctrinal analysis with structural and critical-constructivist interpretation to assess how great power competition recalibrates foundational legal principles. The analysis demonstrates that sovereignty and recognition doctrines under the United Nations Charter are not eroded but recontextualized within competing geopolitical narratives. Collective security mechanisms exhibit patterns of selective enforcement and discretionary activation, generating legitimacy tensions while preserving institutional continuity. In the economic and technological domains, expansive national security exceptions and regulatory bifurcation illustrate how strategic rivalry restructures treaty interpretation without formally displacing multilateral frameworks. The findings indicate that contemporary power politics embeds rivalry within the operational semantics of international law, producing adaptive constitutional pluralism rather than normative disintegration. International legality emerges as a dynamic equilibrium in which institutional resilience coexists with differentiated application shaped by strategic alignment.

Abstract

This study evaluates the evolution of investment governance and its implications for financial market integrity through a structured policy analysis of International Monetary Fund (IMF) and Bank for International Settlements (BIS) reports issued between 2015 and 2025. Employing a mixed qualitative–quantitative content analysis, the research constructs comparative governance indicators capturing prudential orientation, digital finance regulation, artificial intelligence integration, and sustainability risk supervision. The findings reveal a structural shift in global regulatory discourse from stability-centered post-crisis consolidation toward an integrated framework that incorporates crypto-asset oversight, algorithmic supervision, and climate-related financial risk management. While the IMF prioritizes macro-financial surveillance and systemic resilience, the BIS advances granular supervisory standards and technical implementation mechanisms. The results indicate increasing convergence in strategic objectives alongside differentiated institutional pathways. Financial market integrity emerges as a multidimensional governance outcome shaped by transparency regimes, risk quantification tools, and cross-border coordination. The study contributes a novel comparative index-based evaluation framework and advances theoretical understanding of how global economic governance adapts to technological disruption and sustainability transition pressure.

Abstract

This study examines the structural impact of digital operational resilience within the banking sector on macroeconomic financial system stability utilizing a quantitative, non experimental research design. Applying Generalized Method of Moments estimation to a longitudinal dataset of systemically important commercial banks across emerging and developed economies, the inquiry evaluates how technical engineering practices, infrastructure redundancy, and technology risk disclosure quality insulate the financial architecture from systemic shocks. The empirical results indicate that highly integrated digital platforms and decentralized software topologies significantly reduce institutional insolvency risk, thereby preserving aggregate market liquidity during acute technical stress events. However, rapid financial digitalization introduces complex risk transmission channels and systemic spillovers that can bypass traditional capital adequacy buffers if left unregulated. The findings underscore the critical role of macroprudential policy tools, central bank electronic currencies, and digital sovereignty regulations in governing cross border digital transactions. This research expands classical financial stability theory by establishing a comprehensive empirical framework that links micro level institutional robustness to macro level financial system equilibrium.

Abstract

This article examines legal certainty within Indonesia’s peer-to-peer (P2P) lending regulatory framework through a doctrinal normative approach employing statutory, conceptual, and comparative analysis. The study evaluates the coherence of legislation governing financial supervision, electronic transactions, consumer protection, Sharia finance, data protection, and sustainable finance policy, alongside relevant OJK regulations and judicial decisions. The findings indicate that although Indonesia has established a comprehensive regulatory architecture, legal certainty remains challenged by normative fragmentation, dual governance structures between conventional and Sharia models, overlapping enforcement mandates, and procedural inconsistencies in dispute resolution. The regulatory sandbox mechanism and sustainability integration further complicate predictability where evaluative benchmarks and sanction gradations lack precise articulation. Comparative reflection on Islamic fintech governance and enforcement coordination highlights the importance of institutional synergy and codified supervisory alignment. The research concludes that strengthening cross-referencing norms, clarifying organizer liability standards, harmonizing jurisdictional competencies, and embedding enforceable sustainability and data protection obligations are necessary to enhance doctrinal coherence. Legal certainty emerges not merely from regulatory proliferation but from systematic hierarchical integration capable of reconciling innovation with constitutional rule-of-law principles in the digital financial sector
