Abstract

Penelitian ini mengkaji pengelolaan limbah sisa kain pada usaha konveksi rumahan UD Mode Jahit di Kecamatan Taman, Kelurahan Sepanjang, dari perspektif hukum lingkungan berdasarkan Undang-Undang Nomor 32 Tahun 2009, Undang-Undang Nomor 18 Tahun 2008, dan Peraturan Pemerintah Nomor 22 Tahun 2021. Permasalahan yang diteliti adalah pengelolaan limbah kain yang belum tertata dengan baik dan berpotensi menimbulkan dampak terhadap lingkungan permukiman. Penelitian ini menggunakan metode hukum empiris dengan pendekatan deskriptif kualitatif melalui observasi, wawancara, dan dokumentasi. Hasil penelitian menunjukkan bahwa limbah berupa potongan kain, benang, dan bahan tekstil campuran sebagian dimanfaatkan kembali atau dijual kepada pengepul, sedangkan sisanya disimpan sementara, dibuang bersama sampah rumah tangga, atau dibakar dalam jumlah kecil. Kondisi ini menunjukkan bahwa pengelolaan limbah belum dilakukan secara terencana dan berkelanjutan sesuai ketentuan peraturan perundang-undangan, sehingga diperlukan peningkatan kesadaran pelaku usaha serta penerapan sistem pengelolaan yang lebih terstruktur dan ramah lingkungan.

Abstract

This study examines the management of textile waste from a home-based garment business, UD Mode Jahit, located in Taman District, Sepanjang Village, from the perspective of environmental law based on Law Number 32 of 2009, Law Number 18 of 2008, and Government Regulation Number 22 of 2021. The problem addressed in this research is the suboptimal management of textile waste, which has the potential to cause environmental impacts in residential areas. This study employs an empirical legal research method with a descriptive qualitative approach through observation, interviews, and documentation. The results show that waste in the form of fabric scraps, threads, and mixed textile materials is partially reused or sold to collectors, while the remaining waste is temporarily stored, disposed of together with household waste, or burned in small quantities. This condition indicates that waste management has not been carried out in a planned and sustainable manner in accordance with applicable legal regulations. Therefore, increased awareness among business operators and the implementation of a more structured and environmentally friendly waste management system are required.

Abstract

This study examines the revitalization of the principle of ultimum remedium in the reform of Indonesia’s criminal justice system, which reflects a paradigm shift from a retributive approach to restorative, corrective, and rehabilitative approaches, as embodied in Law No. 1 of 2023 on the National Criminal Code. The issue examined is the deviation in the application of the ultimum remedium principle, which in practice has shifted to primum remedium, resulting in criminal law often being used as the primary means of punishment. This situation fuels overcriminalization and increases the burden on correctional institutions. This study employs a normative legal method using legislative, conceptual, and historical approaches through qualitative analysis of primary and secondary legal sources. The results of the study indicate that although the National Criminal Code has strengthened alternative sentencing and restorative justice, the application of the principle of ultimum remedium remains hindered by the legal culture of law enforcement officials, the broad scope of discretion, and inconsistencies in law enforcement practices. Revitalizing the principle of ultimum remedium is necessary so that criminal law truly serves as a last resort in resolving cases, thereby creating a penal system that is proportional, humane, and oriented toward substantive justice and the protection of human rights.
