Abstract

Indonesia’s soft bicameral system places the Regional Representative Council in a functionally weak position compared to the House of Representatives, limiting territorial representation. This normative-legal study analyzes legislation, constitutional doctrine, and comparative bicameral systems to reconstruct the DPD’s powers without altering the presidential principle. Historically, the DPD emerged from a political compromise between decentralization demands and efforts to preserve DPR supremacy. Constitutionally, restrictions in Article 22D of the 1945 Constitution create a subordinated status at odds with territorial representation. Recommended reconstruction includes strengthening sectoral legislative rights, substantive oversight over central policies affecting regions, and binding consultative rights on fiscal policy and regional autonomy. These measures are expected to enhance the DPD’s political legitimacy, promote distributive justice among regions, and improve the constitutional system’s adaptability to complex center–region relations under broad autonomy. The study concludes that, without constitutional empowerment and internal institutional reform, Indonesia’s bicameralism will remain asymmetric and symbolic; therefore limited constitutional amendment and internal reform are necessary for the DPD to act as a genuine co-legislator on regional sectoral matters.

Abstract

The management of the Bantar Gebang Final Disposal Site (TPA) faces structural challenges related to capacity limitations, environmental pollution, and the fulfillment of the community’s right to a good and healthy environment. This study analyzes the application of environmental law enforcement principles as regulated in Law Number 32 of 2009, focusing on the principles of precaution, pollution prevention, the polluter pays principle, sustainability, and community participation in landfill management practices. The research findings indicate that although technical approaches such as sanitary landfills and the development of waste-to-energy (PLTSa) facilities have been implemented, gaps in implementation persist due to the high volume of waste, weak supervision, and the dominance of an end-of-pipe disposal approach without adequate upstream waste reduction strategies. Legal instruments such as Environmental Impact Assessments (AMDAL), environmental permitting, and administrative sanctions tend to be reactive in nature and have not fully ensured the imposition of restoration costs on polluters. Furthermore, community participation remains limited due to the lack of dialogue mechanisms and management accountability. This study recommends strengthening law enforcement through stricter supervision, enhancing public participation mechanisms, developing a collaborative governance model across regions between DKI Jakarta and the City of Bekasi, and integrating upstream waste reduction programs with social protection for waste pickers.

Abstract

The expansion of the video game industry in Indonesia has intensified modding as a form of digital creativity while also exposing uncertainty over the legal boundaries of copyright protection for game characters. This article examines the legal status of video game characters, the qualification of unauthorized modding under Indonesian copyright law, and the regulatory reconstruction required to address the resulting grey areas. The study employs normative legal research using statutory, conceptual, comparative, and case approaches. Its principal legal materials include Law Number 28 of 2014 on Copyright, digital-law instruments, derivative-work doctrine, end-user licence agreements, technological protection measures, and scholarship on modding practices. The analysis finds that modding involving adaptation, transformation, public distribution, commercialization, or circumvention of technological protection measures may engage the exclusive rights of copyright holders, while private, non-commercial and non-distributive modifications remain less clearly regulated. The article develops a three-tier regulatory framework combining risk-based legal classification, institutionalized community licensing, and proportionate platform accountability. This framework is intended to protect legitimate copyright interests without eliminating socially valuable forms of participatory digital creativity.
