Abstract

The implementation of Act No. 13 of 2003 on Manpower is intriguing to discuss since companies often violate and are apathetic in the right to act for employees' religious beliefs. The limited facilities of worship in the workplace also represents the commitment engagement of the company towards promulgated regulations which is still not implemented.The purpose of this study is to provide the more specified description and understanding towards the religiosity and implementation of Act No. 13 of 2003 on Manpower concerning The Rights to Perform Religious Obligations for Laborers. This study, which focuses on the religiosity of this worker class, took two different places, namely in Bekasi Regency and Subang Regency.This study uses qualitative methods which enables to reveal the actual circumstances. More specifically, qualitative research can be identified by the aim of research that seeks to understand the manifestation that does not require quantification--or because this manifestation is unable to be accurately measured. In relation to the method, the data collecting techniques are as follows: (1) nonparticipant observation and (2) in-depth interviews. While the data analysis starts from (1) data reduction, (2) data presentation, and (3) drawing conclusions.By this study, the authors concluded: (1) companies that have become research object in Bekasi and Subang District have provided worship facilities and infrastructure as regulated in Act N. 13 of 2003 on Manpower in the Respect to Perform Religious Obligations. On the other hand, the workers still look forward some improvements on quality and quantity of worship facilities to emerge conveniences in performing worship; and (2) in general, the religiosity among working class is found at an average level.  In other words, the workers truly believe in God (Allah) with common knowledge about faith. They also perform religious practices as the evidence of the faith itself and as proof of obedience to God. Besides carrying out the orders of religion (worship), the workers also put some expectations on the reward as the way to accomplish the glory on Earth and afterlife. However, the workers realize that the worship carried out would not come to a subjective perspective (their dialogue with supernatural powers, Allah). The workers also attempt to make religion as the basis of all actions as they consider the consequences of the life on Earth for the afterlife.

Abstract

AbstractImplementation of Law No. 13 of 2003 on manpower is interesting to do because the company has violated and does not provide freedom for employees to exercise their religious beliefs. The limitation of worship facilities in the workplace is one of the forms of how the company has no commitment to implementation of the by that have been laid down. The research on freedom of worship of the workers has chosen a place, namely in Bekasi Regency. The purpose of this research is to provide a deep description and understanding of freedom in the conduct of the worship of workers under the Law No. 13 of 2003 on employment in freedom of exercise of religious obligations for the workers in Bekasi regency. This research uses a Quali-tatif method and gives birth to the Keismpulan namely (1) companies that become a site of research in Bekasi has provided the facilities and infrastructure of worship as stipulated Act No. 13 of 2003 on employment in freedom of exercise of religious obligations. Nevertheless, on the other hand, the workers still expect the improvement of the quality and quantity of worship facilities so that it can run the worship more comfortably; and (2) in general, consciousness worships the workers at levels or levels. That is to say, they have faith in God with minimal knowledge of faith. They also carry out religious practices as evidence of the faith itself and as evidence of obedience to God.AbstrakImplementasi Undang-Undang Nomor 13 Tahun 2003 tentang Kete­naga­kerjaan menjadi menarik dilakukan karena kerapkali perusahaan melanggar dan tidak memberikan kebebasan untuk para pegawai dalam menjalankan keyakinan agamanya. Keterba­ta­san sarana ibadah di tempat kerja pun merupakan salah satu bentuk bagaimana perusahaan tidak memiliki komitmen terhadap imple­mentasi atauran yang telah diundang­kan. Penelitian menge­nai kebebasan beribadah kaum pekerja ini memilih tempat, yaitu di Kabupaten Bekasi. Tujuan penelitian ini untuk memberikan deskripsi dan pemahaman secara mendalam mengenai Kebebasan Dalam Menjalankan Beribadah Pekerja Dihubung­kan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan Dalam Kebebasan Menjalankan Kewajiban Beragama Bagi para kaum pekerja di Kabupaten Bekasi. Penelitan ini menggunakan metode kuali­tatif dan melahirkan keismpulan yakni (1) perusahaan-perusahaan yang menjadi tempat penelitan di Kabupaten Bekasi sudah menye­diakan sarana dan prasarana ibadah sebagaimana diatur Undang-Undang Nomor 13 tahun 2003 tentang Ketenaga­kerja­an dalam Kebe­ba­san Men­jalan­kan Kewajiban Beragama. Namun demikian, di sisi lain, para buruh masih mengharapkan per­baikan kualitas dan kuantitas sara­na ibadah sehingga dapat menjalankan ibadah lebih nyaman; dan (2) secara umum, kesa­da­ran beribadah para pekerja berada pada tingkat atau level biasa. Artinya, bahwa benar mereka beriman kepada Allah dengan penge­­tahuan keimanan yang minimal. Mereka juga melak­sana­kan praktik agama sebagai bukti dari keimanan itu sendiri dan sebagai bukti ketaatan kepada Allah.

Abstract

This study aims to identify and understand how Consumer Protection Regulations can protect consumers from misinformation regarding the price of goods. The author uses a normative approach to analyze legal issues based on existing laws and literature. The results of the study show that until now consumers have not been fully protected in several mini markets. There is still a lot of wrong information from business people regarding the price of goods that can make consumers pay more than they should. Therefore, it is important for business people in good faith to provide accurate information to avoid consumer losses caused by misleading information, in accordance with Law no. 8 of 1999 concerning Consumer Protection.AbstrakPenelitian ini bertujuan untuk mengidentifikasi dan memahami bagaimana Peraturan Perlindungan Konsumen dapat melindungi konsumen dari informasi yang salah terkait harga barang. Penulis menggunakan metode pendekatan normatif untuk menganalisis masalah hukum berdasarkan hukum dan literatur yang ada. Hasil penelitian menunjukkan bahwa hingga saat ini konsumen belum sepenuhnya dilindungi di beberapa Mini market. Masih banyak informasi yang salah dari pelaku bisnis terkait harga barang yang dapat membuat konsumen membayar lebih dari yang seharusnya. Oleh karena itu, penting bagi pelaku bisnis beritikad baik untuk memberikan informasi yang akurat untuk menghindari kerugian konsumen yang disebabkan oleh informasi yang menyesatkan, sesuai dengan Undang-Undang No. 8 Tahun 1999 tentang Perlindungan Konsumen.

Abstract

Indonesia sebagai Negara yang menganut konsep hukum normatif, dengan memiliki Undang-Undang terkait penstabilan ekonomi, yaitu terdapat pada UU No.5 Tahun 1999 yang secara tegas mengatur terkait persaingan usaha tidak sehat. Penelitian ini bertujuan untuk menganalisis bentuk usaha Goggle di Indonesia, dengan meneliti aspek normatif terkait persaingan usaha tidak sehat, dengan meneliti bentuk-bentuk usaha goggle tersebut terdapat beberapa indikasi dominasi pasar yang dilakukan oleh Goggle di Indonesia, seperti pada halnya adanya sistem aplikasi bawaan yang dipasang pada sistem android, kemudian sistem iklan yang mengganggu juga dimonopoli oleh pihak Goggle, maka dengan indikasi awal ini, diharapkan menjadi perhatian yang cukup serius untuk melakukan pengawasan pada Goggle.

Abstract

This study aims to analyze the management of databases at State Islamic Higher Education Institutions (PTKIN) in supporting the accreditation of study programs. The research adopts a descriptive qualitative approach, employing data collection methods such as interviews, observations, and documentation. Data were obtained from several PTKIN institutions in the Java region, including UIN Syarif Hidayatullah Jakarta, UIN Sultan Maulana Hasanuddin, and IAIN Pekalongan. The findings reveal that database management plays a crucial role in enhancing the accreditation scores of study programs by providing valid and relevant data. Strategic policies, such as strengthening human resources, implementing independent academic information systems, and conducting accreditation simulations by Quality Assurance Institutions, have proven effective in preparing study programs for assessment by the National Accreditation Board for Higher Education (BAN-PT). The study also highlights challenges, such as limited human resources and inconsistencies in reporting data, which can be addressed through technological innovations and continuous training. This research underscores the importance of integrated database management in supporting the quality of higher education at PTKIN.

Abstract

Perkembangan pesat platform digital, khususnya YouTube, telah melahirkan konten kreator sebagai aktor penting dalam ekonomi kreatif berbasis digital. Namun, kemudahan reproduksi dan distribusi konten di ruang siber juga memunculkan berbagai bentuk pelanggaran hak cipta yang berdampak langsung terhadap hak ekonomi kreator. Penelitian ini bertujuan untuk menganalisis implementasi Pasal 95–105 Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta dalam memberikan perlindungan terhadap hak ekonomi konten kreator digital di platform YouTube. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan kepustakaan melalui analisis peraturan perundang-undangan, literatur hukum, dan sumber akademik terkait. Hasil penelitian menunjukkan bahwa meskipun kerangka hukum nasional telah mengatur mekanisme penyelesaian sengketa, ganti rugi, dan penegakan hukum terhadap pelanggaran hak cipta, implementasinya di ruang digital masih menghadapi berbagai kendala, seperti keterbatasan yurisdiksi lintas negara, anonimitas pelaku, serta ketergantungan pada kebijakan internal platform seperti Content ID. Selain itu, terdapat kesenjangan antara mekanisme hukum nasional dengan sistem otomatis platform yang berpotensi menimbulkan ketidakpastian hukum bagi kreator. Upaya perlindungan hak cipta perlu dilakukan melalui kombinasi strategi preventif dan represif, baik melalui instrumen hukum seperti gugatan perdata dan alternatif penyelesaian sengketa, maupun melalui pemanfaatan teknologi digital seperti sistem deteksi konten dan fitur takedown. Penelitian ini merekomendasikan perlunya harmonisasi antara regulasi nasional dan kebijakan platform digital, penguatan mekanisme penegakan hukum lintas yurisdiksi, serta peningkatan literasi hukum bagi konten kreator guna mewujudkan perlindungan hak ekonomi yang efektif dan berkelanjutan di era digital.

Abstract

The rapid expansion of digital technology has transformed the circulation of literary works, particularly electronic books, while simultaneously intensifying copyright infringement through unauthorized digital reproduction and distribution across online platforms, electronic marketplaces, and decentralized cyber networks. This study examines the legal construction, enforcement mechanisms, and structural obstacles concerning the circulation of pirated digital books under Law Number 28 of 2014 concerning Copyright within Indonesia’s contemporary digital ecosystem. Employing normative-juridical legal research, the study applies statutory, conceptual, and doctrinal approaches through qualitative analysis of legislation, legal doctrines, scholarly literature, and relevant regulatory frameworks governing copyright and electronic systems. The analysis demonstrates that Indonesian copyright law formally provides comprehensive protection for digital books through civil, criminal, and administrative enforcement mechanisms, yet operational effectiveness remains constrained by complaint-based criminal procedures, fragmented intermediary liability standards, technological enforcement limitations, and the normalization of digital piracy within online culture. The study further argues that effective copyright protection in cyberspace requires an integrated cyber-regulatory framework emphasizing preventive governance, intermediary accountability, technological supervision, and strengthened legal consciousness to ensure sustainable protection of intellectual property rights within digitally mediated environments.

Abstract

Legal protection of trademarks constitutes an essential aspect of the Intellectual Property Rights (IPR) regime, aimed at ensuring legal certainty, protecting business actors, and preventing unfair competition. However, in practice, product counterfeiting using trademarks without authorization either identical or substantially similar remains prevalent, causing significant losses to trademark owners and consumers. This study aims to analyze the legal regulation of trademarks in Indonesia, the forms of legal protection against trademark counterfeiting, and the effectiveness of its law enforcement. The research employs a normative juridical method with statutory and conceptual approaches. The results indicate that trademark regulation in Indonesia is comprehensively governed under Law Number 20 of 2016 concerning Trademarks and Geographical Indications, which provides both preventive and repressive legal protection. Preventive protection is implemented through the trademark registration system, while repressive protection is carried out through civil, criminal, and administrative sanctions. Nevertheless, the effectiveness of law enforcement still faces several challenges, including low public legal awareness, weak supervision, and technological developments that facilitate the distribution of counterfeit goods. Therefore, it is necessary to optimize law enforcement and enhance legal awareness to achieve effective trademark protection in Indonesia.

Abstract

The rapid development of digital technology has transformed the distribution and consumption of cinematographic works through online streaming services, while simultaneously increasing the prevalence of illegal movie streaming activities. This study aims to examine the legal protection of cinematographic copyrights, identify the forms and driving factors of illegal movie streaming, and analyze the challenges of copyright law enforcement in Indonesia. The research employed a normative legal method using statutory and conceptual approaches through an extensive library-based review of legal instruments, academic literature, and relevant scholarly studies. The findings indicate that cinematographic works are protected under Indonesian Copyright Law through moral rights, economic rights, and related rights granted to creators and rights holders. Copyright infringements occur in various forms, including unauthorized streaming, illegal hosting, hyperlink distribution, camcording, re-encoding, and the circumvention of digital protection measures. Law enforcement efforts remain constrained by technological developments, cross-border jurisdictional issues, institutional coordination challenges, and limited public awareness of copyright protection. Strengthening copyright governance therefore requires an integrated approach involving regulatory reform, technological safeguards, interagency cooperation, and public education to enhance legal compliance in the digital era.
