Abstract

This article examines the role and effectiveness of the Supreme Court (MA) in reviewing the constitutionality of regulations under laws (the right to judicial review of the substance of laws/HUM), focusing on two landmark decisions from 2024 and the Supreme Court’s overall performance data. Supreme Court Decision No. 12/P/HUM/2024, which reviewed Presidential Regulation No. 53 of 2023, and Decision No. 23/P/HUM/2024, which reviewed the age requirements for candidacy for regional head positions, are analyzed in depth from a constitutional law perspective. The study also highlights the Supreme Court’s performance in 2024, during which it received 31,000 cases (a 13.72% increase from 2023), adjudicated 30,763 cases, and achieved a timely resolution rate of 96.52%. This integrated analysis aims to evaluate the extent to which the Supreme Court has effectively carried out its function of overseeing the constitutionality of laws and regulations as a check on power within the Indonesian legal system.
