Abstract

This study aims to conduct a normative legal analysis of the regulation of customary offenses (delik adat) within the Indonesian Criminal Code (KUHP) and to examine its implications for the settlement of customary law cases in Sulawesi Barat. This research employs a normative legal method by analyzing primary legal materials, including statutory regulations, particularly the KUHP, and secondary legal materials such as legal doctrines, scholarly articles, and relevant literature. The data were collected through a library research approach and analyzed qualitatively using statutory and conceptual approaches. The findings reveal that the regulation of customary offenses in the KUHP reflects the recognition of living law within society. However, its application presents several challenges, including issues of legal certainty, limitations in interpretation, and the need for harmonization between customary law and national law. Furthermore, the incorporation of customary offenses provides an opportunity for more contextual and culturally responsive dispute resolution mechanisms. Nevertheless, clearer regulatory frameworks and technical guidelines are required to prevent ambiguity in legal enforcement. This study concludes that the normative regulation of customary offenses in the KUHP has the potential to strengthen a more just and culturally grounded national legal system, particularly in resolving customary law cases in Sulawesi Barat. Therefore, it is essential to ensure normative synchronization and enhance the capacity of law enforcement authorities in understanding and implementing these provisions effectively.

Abstract

Fulfilling access to population administration services for people with disabilities is an important part of the implementation of inclusive public services. Although the digitization of services continues to grow, the accessibility of digital services has not fully accommodated the needs of various types of disabilities. This study aims to analyze the fulfillment of access to population administration services for people with disabilities in West Sulawesi and formulate the concept of inclusive services through the integration of Artificial Intelligence (AI) and Web Content Accessibility Guidelines (WCAG). The research uses socio-legal methods with legislative, conceptual, and social-empirical approaches. Data were obtained through document studies, observations, and interviews with the Disdukcapil of Polewali Mandar, Mamuju, and Central Mamuju Regencies (1-2 informants each), the Ombudsman of the Republic of Indonesia Representative of West Sulawesi Province (2 informants), and people with disabilities who are members of the West Sulawesi Disability Movement (4 informants).  The results of the study show that direct services have implemented several forms of affirmative services, such as service priorities, mentoring, and direct services to the community. However, the available digital services are still general and not fully accessible for various types of disabilities. This study offers AI-WCAG as a conceptual design to support digital population administration services that are easier to perceive, operate, understand, and access according to the needs of people with disabilities. The development of this model requires collaboration between institutions and the involvement of people with disabilities in the design and evaluation of services.
