Abstract

The purpose of this research is to find out the procedures for making forced efforts to arrest suspected perpetrators of criminal acts, and how to overcome obstacles in the process of arresting suspected perpetrators of criminal acts. The research method used is normative research.While the approach used is the conceptual approach and the legal approach. In the context of enforcement law through forced arrest efforts, it can be done through a warrant and without an arrest warrant. And in making arrests always upholding the rights and dignity of the perpetrators are not discriminatory and always put forward the principle of presumption of innocence.Keywords: Arrest, Law Enforcement, Forced Efforts, Criminal Court. AbstrakTujuan penelitian ini adalah untuk mengetahui tata cara melakukan upaya paksa dalam penangkapan terhadap terduga pelaku tindak pidana, dan cara mengatasi hambatan dalam proses penangkapan terhadap terduga pelaku tindak pidana. Metode penelitian yang digunakan adalah penelitian normative. Sedangkan pendekatan yang digunakan adalah pendekatan konseptual dan pendekatan perundang-undangan. Dalam rangka penegakan hukum melalui upaya paksa penangkapan, dapat dilakukan melalui surat perintah dan tanpa surat perintah penangkapan. Serta dalam melakukan penangkapan penyelidik belum semuanya menjunjung tinggi hak asasi dan harkat martabat pelaku sehingga masih ditemukan tindakan diskriminatif dan perlu adanya upaya selalu mengedepankan asas praduga tak bersalah. Kata Kunci: Penangkapan, Penegakan Hukum, Peradilan Pidana, Upaya Paksa.

Abstract

During the pandemic, women workers in the informal sector, who were also the primary breadwinners, experienced a double burden, were marginalized and experienced an economic burden; even though they did not give up on the situation, they continued to try to support their families. This paper examines the description and analysis of how women workers in the informal sector work during the Covid 19 pandemic to achieve a decent living for their families and analyzes the factors that affect the income or income of women workers in the informal sector, thus reducing the decent quality of life for their families. Moreover, efforts were made to address the economic recovery of his family. This research is descriptive-explanative with a Feminist Law approach. Data analysis was carried out continuously from the beginning to the end of the study by triangulating data through testing, sorting, categorizing, evaluating, comparing, and synthesizing. The study's results, namely the existence of the Covid 19 pandemic, affected the income or income of women working in the informal sector and reduced the quality of life that was decent for their families. It was proven that all families reduced the budget for daily food and drink needs. Efforts to earn income are carried out in various ways so that they can cover their daily needs. Abstract

ABSTRACT This article aims to identify and analyze in determining the perpetrator's mistakes and the application of criminal sanctions for the perpetrators of blocking the speed of ambulances carrying Emergency Patients. The type of research used is normative juridical, with a normative and conceptual approach. Primary legal material comes from Act Number 22 of 2009 concerning Road Traffic and Transportation. Secondary legal material in the form of publications about law other than official documents. The material collection is carried out by tracing sources on the internet and in printed form, the material is inventoried and grouped based on type classification and relevance. Described, analyzed deductively and/or inductively to draw conclusions and answer legal issues in research. Obstacles to the speed of ambulances carrying emergency patients often occur in various parts of Indonesia, even though these vehicles have priority rights that must take precedence over their speed on the road, as stipulated in the law on traffic and road transport. This act could have occurred from the attitudes and behavior of the perpetrators who were inhumane, indifferent, arrogant, insensitive, and irresponsible towards others. As a result, there are priority rights of road users that are neglected, harm the interests of patients, and even risk the patient dying before reaching the intended healthcare facility. A situation like this is of course very concerning to all parties. The imposition of social sanctions in the form of clarifications and apologies to the aggrieved parties does not guarantee a deterrent effect and may set a bad precedent in law enforcement going forward. The perpetrators must be sanctioned to be held accountable for their actions based on the applicable law, as a preventive and repressive effort in the future. Abstract

Artikel ini membahas transisi perilaku pemerintahan dari yang semula berlandaskan pada kekuasaan hingga berpotensi menuju tindakan pemerasan dalam konteks kerangka hukum nasional. Melalui analisis mendalam berdasarkan data empiris, kasus-kasus nyata, serta doktrin hukum, penulis menggali bagaimana mekanisme pemerintahan yang seharusnya melindungi dan melayani masyarakat dapat tergelincir menjadi alat pemerasan yang melanggar hukum dan norma sosial. Hasil kesimpulan menunjukkan bahwa ketiadaan pengawasan yang efektif, kurangnya transparansi, serta rendahnya kesadaran hukum baik dari pihak pemerintah maupun masyarakat menjadi beberapa faktor utama yang mempengaruhi pergeseran tersebut. Artikel ini menekankan pentingnya reformasi hukum dan penguatan lembaga pengawas untuk memastikan integritas dan akuntabilitas pemerintahan dalam menjalankan tugas dan fungsinya.

Abstract

The ICC’s failure to bring international criminals to justice has become a serious issue of impunity, necessitating the activation of universal jurisdiction mechanisms. This qualitative study aims to compare the regulations on universal jurisdiction in German and Indonesian law in order to improve these regulations in Indonesia. This study employs a legal and conceptual approach, utilizing a literature review method to collect legal materials; the findings are analyzed and compared to generate innovative improvements to these jurisdictional regulations in Indonesia. The findings indicate that Indonesia should adopt several prinsiples as regulated by German law. Consequently, it is important for legislators to revise the National Criminal Code or enact specific regulations on universal jurisdiction that are more comprehensive.

Abstract

Multinational corporations are increasingly identified as key actors in complex transnational money laundering networks, yet the existing international legal regime has not been able to effectively address the criminal liability of corporate entities. This article examines the gap in international law in the context of multinational corporations' criminal liability for transnational money laundering crimes, using a normative juridical approach through a literature review of international legal instruments, corporate criminal law doctrine, and relevant theoretical perspectives. The analysis shows that international legal instruments such as the United Nations Convention against Transnational Organized Crime (UNTOC 2000), the United Nations Convention against Corruption (UNCAC 2003), and the Financial Action Task Force (FATF) recommendations are still not directly criminally binding on corporations and rely on implementation through each country's national legislation. This legal gap creates jurisdictional loopholes that are systematically exploited by multinational corporations through multi-layered, cross-jurisdictional corporate structures. This article recommends the establishment of an international legal instrument that explicitly recognizes the subjectivity of corporate criminal law at the international level and establishes a direct and binding enforcement mechanism.

Abstract

A considerable number of Indonesians are encountering challenges within their households. In 2023, 6,480 (or 79%) of the 8,234 reported KDRT cases to Komnas Perempuan and its affiliates occurred within the premises of the tangga house. As of 3.221 inside, the kerasan in the staircase of the house has attained its maximum capacity. This research aims to elucidate the origins and impacts of violence within Indonesian households, specifically focusing on the behaviors of the perpetrator and their family members, interpreting the underlying causes of the issue, and examining the perceptions shaped by the relevant perspective, along with the perpetrator's insights regarding the repercussions of the problem. The present study employs both conceptual and normative-legal sources of information. The study's findings indicate that the violence occurring within the household staircase can consist of various sources. The theoretical framework concerning social isolation, control, resources, and ecosystems is readily comprehensible due to several reasons discussed herein. The use of violence by perpetrators, whether through bare hands or other instruments, has the potential to be exacerbated by physical aggression occurring in proximity to the residence, potentially surpassing the severity of the violence within the home itself. Injury or even death may result from the occurrence of violence within the staircase house.

Abstract

As time goes on, the conditions and lifestyle of children deteriorate because, as far as they can tell, the world and society are causing problems for children. In 2021, 8.43% of children and adults reported sexual dysfunction, and by 2024, that number had risen to 8.82%. This research aims to analyze, describe, and illustrate the legal protections afforded to parents and children who become victims of sexual abuse and other forms of violence. This type of research is normative, employing conceptual frameworks and principles. The results of this study indicate that legal protection against women and children who are victims of sexual violence is regulated in the 1945 Constitution, Criminal Code, Law 39/1999, Law 35/2014, Law 11/2012, Perppu 17/2016, Law 12/2022, Law 23/2004, Law 16/2011, Law 13/2006, Law 26/2000 and in the implementation of legal protection against women and children who are victims of sexual violence there are several obstacles faced, these obstacles come from law enforcement factors that do not carry out their obligations according to existing regulations, lack of facilities for victims, factors from the victims themselves who have a fear of reporting, and lack of attention from the community.

Abstract

The power of social media lies in its ability to harness the collective intelligence of its users by actively involving them and soliciting their input from diverse groups. The use of social media for public relations purposes can have unintended consequences if not handled with care. Analysing, describing, and illustrating the negative effects of social media on minors as well as efforts to counteract these effects are the primary goals of this research. This study takes a conceptual approach to research, making it normative. First, the negative effects of social media on children include stunted development, health problems, increased risk of criminal behaviour and cyberbullying, impaired language skills, and unhealthy comparisons with others. Second, teacher educators can do their part to mitigate the negative effects of social media on youth by banning smartphone use in the classroom, parents can set limits on when and how much time their children can spend on social media, policymakers can take action through legislation and outreach, and members of the community can work together to make their neighbourhoods safer and healthier for teens.

Abstract

This article examines the factors causing children to become victims of domestic violence (DV) and the state's responsibility in protecting children's rights. The legal issue raised is the lack of legal protection for child victims of domestic violence and how law enforcement and state policies are not yet optimal in preventing and addressing these cases. The aim of this study is to identify the factors contributing to violence against children within households and evaluate the role of the state in prevention and child protection efforts. The methodology used is literature review with a normative juridical approach by analyzing relevant laws and case studies from official reports. The results show that economic factors, low parental education, and patriarchal culture are the main causes, while the state's efforts remain insufficient to comprehensively tackle this issue.
