Abstract

Public-Private Partnerships (PPPs) have become an increasingly popular model for financing and developing infrastructure in many developing countries, including Indonesia. Given the significant infrastructure gaps in the country, particularly in transportation, energy, and urban development, PPPs offer a promising solution for mobilizing private investment and expertise while maintaining public accountability. This study investigates the role of PPPs in Indonesia’s infrastructure development, analyzing their effectiveness, challenges, and prospects for future growth. The research aims to assess how PPPs are implemented, their impact on project efficiency, and their contribution to Indonesia’s economic development. A qualitative research approach is used, employing case studies, interviews with key stakeholders, and a review of relevant policy documents. The findings reveal that while PPPs have contributed to accelerated infrastructure development, challenges such as regulatory inconsistencies, financial risks, and lack of transparency continue to hinder their success. However, with proper governance structures, risk-sharing mechanisms, and improved public-private collaboration, PPPs hold substantial potential for future infrastructure projects in Indonesia. The study concludes that PPPs, when effectively implemented, can significantly support sustainable development and economic growth in Indonesia.

Abstract

Maq??id al-Shar??ah has re-emerged as a central framework for evaluating the ethical and legal dimensions of Islamic economic transactions amid increasing complexity in global financial systems. Contemporary practices often emphasize procedural compliance, creating a gap between formal legality and substantive justice. This study aims to reassess legal rationality by examining how maq??id can function as a foundational framework for guiding economic transactions beyond rule-based validation. A qualitative normative–juridical research design is employed through systematic analysis of 88 legal and regulatory documents, including classical jurisprudential texts, fatwas, and institutional guidelines across multiple jurisdictions. Analytical matrices and thematic coding are used to identify patterns of maq??id application, institutional integration, and interpretive variation. The findings reveal that maq??id is unevenly operationalized, with stronger integration in policy-oriented frameworks and centralized governance systems, while doctrinal and case-based applications remain selective and inconsistent. Institutional embedding of maq??id enhances coherence and ethical alignment, whereas fragmented application reinforces formalistic tendencies. The study concludes that reconfiguring legal rationality requires transforming maq??id from a conceptual ideal into an operational governance tool capable of aligning legal form with ethical substance in contemporary Islamic finance.

Abstract

Increasing uncertainty in the global financial environment has intensified the need for effective crisis management frameworks capable of strengthening institutional resilience and ensuring sustainable organizational performance. Sharia banking institutions face unique challenges during crises because operational decisions must comply not only with regulatory requirements but also with Islamic legal and ethical principles. Existing crisis management models are predominantly derived from conventional management theories and often provide limited guidance regarding the integration of Islamic jurisprudential principles into crisis preparedness, response, and recovery processes. This study aims to develop and validate a crisis management model for Sharia banking institutions based on Islamic jurisprudence. A mixed-methods research design was employed using an exploratory sequential approach. Qualitative data were obtained through expert interviews and analysis of Islamic jurisprudential sources, while quantitative data were collected from 320 professionals working in Islamic banking institutions. Structural Equation Modeling was utilized to evaluate the proposed framework. Findings reveal that Sharia compliance governance significantly enhances crisis preparedness, ethical decision-making, stakeholder protection, organizational resilience, and recovery capacity. Ethical decision-making emerged as a critical mediating factor linking jurisprudential principles to resilience outcomes. Results further indicate that concepts such as maslahah, darurah, amanah, and harm prevention provide practical guidance for crisis management within Islamic banking contexts. The study concludes that Islamic jurisprudence offers a comprehensive foundation for developing resilient, ethical, and stakeholder-oriented crisis management systems capable of strengthening governance quality and long-term institutional sustainability in Sharia banking.
