Abstract

The digital transformation in land administration through Electronic Certificates constitutes a strategic measure by the Government of Indonesia to establish a transparent and accountable land registration system. This study aims to analyze the juridical implications of Sertipikat-el regarding the legal certainty for Home Ownership Credit customers, as well as the forms of legal protection available to customers and the banking sector against the risks of digital maladministration. The research method employed is normative juridical, utilizing statutory, conceptual, and analytical approaches. The findings indicate that Sertipikat-el bolsters legal certainty by minimizing the risk of dual certification through an integrated spatial mapping system. Legal protection for customers and the banking sector is realized through cybersecurity frameworks pursuant to the Personal Data Protection Law and the principle of state responsibility regarding digital system failures. This study concludes that while digital technology enhances the efficiency of Mortgage execution, the reinforcement of regulations concerning administrative compensation for system errors is imperative to ensure equity for KPR customers as consumers of financial services.

Abstract

Keywords: Abstract Intellectual Property Rights; Trademark Protection; Small and Micro Enterprises (SMEs)Finger Board; Intellectual Property Rights, particularly trademark rights, play an essential role for the Small and Micro Enterprise (SME) of “Mainan Papan Jari” located in Block A, Kebayoran Baru, Jakarta Selatan, which still faces the problem of limited understanding regarding the urgency of trademark protection and its registration procedures. The partner location was selected because the area serves as a center for creative SMEs that require enhanced legal literacy to strengthen their business identity. The implementation method involved legal counseling on the function and protection of trademarks, interactive discussions, and technical assistance in completing and submitting trademark registration documents to the Directorate General of Intellectual Property (DGIP). The results show that the partner experienced improved understanding of the legal and strategic benefits of trademark protection for business sustainability. Moreover, the provided assistance enabled the partner to complete the trademark registration process officially. This activity contributes to strengthening the legal protection of the business identity and enhancing the competitive value of the “Mainan Papan Jari” SME in an increasingly competitive market.

Abstract

Migrasi tenaga kerja Indonesia ke luar negeri merupakan fenomena sosio-ekonomi yang berkontribusi signifikan terhadap devisa negara, namun di sisi lain menimbulkan berbagai persoalan hukum dan sosial, terutama terkait kerentanan calon pekerja migran terhadap eksploitasi. Rendahnya literasi hukum, lemahnya pengawasan lembaga pelatihan kerja (LPK), serta praktik perekrutan non-prosedural menjadi faktor utama yang memperburuk kondisi ini. Berdasarkan Undang-Undang Nomor 18 Tahun 2017 tentang Pelindungan Pekerja Migran Indonesia, negara berkewajiban memberikan perlindungan menyeluruh, baik preventif maupun represif, terhadap seluruh warga negara yang bekerja di luar negeri. Kegiatan Pengabdian kepada Masyarakat (PkM) ini dirancang untuk memperkuat perlindungan preventif melalui strategi edukasi hukum interaktif yang ditujukan kepada calon pekerja migran (CPM). Tujuannya adalah meningkatkan pemahaman CPM terhadap hak dan kewajiban mereka sesuai regulasi, serta mendorong partisipasi aktif dalam pemanfaatan mekanisme pengaduan yang difasilitasi Badan Pelindungan Pekerja Migran Indonesia (BP2MI) dan Kementerian Ketenagakerjaan. Melalui pendekatan ini, diharapkan terjadi transformasi CPM dari subjek yang pasif dan rentan menjadi subjek hukum yang sadar, aktif, dan berdaya. Manfaat kegiatan ini tidak hanya dirasakan oleh peserta secara langsung melalui peningkatan literasi hukum, tetapi juga mendukung upaya pemerintah dalam memperkuat sistem perlindungan hukum preventif dan menekan kasus pelanggaran hak pekerja migran
