Abstract

Law Number 41 of 2004 concerning Waqf is one of the reform products that have received the attention of many researchers. This paper examined the Waqf Law from the perspective of Pancasila, namely to answer whether the values of Pancasila have been actualized in it. This research is a juridical-normative study, by analyzing the contents of Waqf Law with the parameters of Pancasila values in the legislation. The results show that the values of Pancasila are well actualized in Waqf Law. The actualization of Pancasila values is contained in in every norm of Waqf Law.

Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis: pertama, legalitas pembentukan undang-undang secara cepat di Indonesia dan kedua, problematika praktek pembentukan undang-undang Komisi Pemberantasan Korupsi dan Mahkamah Konstitusi yang dilakukan secara cepat di Indonesia. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menyimpulkan bahwa, pertama secara normatif, pembentukan undang-undang secara cepat tidak dikenal dalam sistem legislasi di Indonesia. Ketiadaan pengaturan mekanisme pembentukan undang-undang secara cepat dalam legislasi di Indonesia mengakibatkan terdapat ketidakjelasan terhadap pembentukan suatu undang-undang apakah dikategorikan sebagai pembentukan undang-undang secara cepat ataukah tidak. Kedua, terdapat ketidaksesuaian praktek dan prosedur dalam pembentukan Undang-Undang Komisi Pemberantasan Korupsi dan Undang-Undang Mahkamah Konstitusi yang dibentuk secara cepat. Ketidaksesuaian tersebut dapat dilihat dari tahapan perencanaan, penyusunan,pembahasan dan pengesahan. Solusi yang dapat ditawarkan yakni perlu diatur mengenai mekanisme pembentukan undang-udang secara cepat agar apabila terdapat pembentukan undang-undang yang dibutuhkan dibentuk secara cepat tetap sesuai dengan prosedur yang ada.

Abstract

Since the end of 2019, the President and the House of Representatives had performed different legislative functions. Since the Law on the Commission Eradication Commission was amended, legislation had dramatically been transformed.  Several laws have been passed and amended quickly. This study discusses three legal issues. First, the conceptual limitation of fast-track legislation in Indonesia. Second, the rationale behind fast-track legislation under Joko Widodo's administration. Third, the impact of fast-track legislation under Joko Widodo's administration. In this socio-legal study, a qualitative analysis is conducted. This study has identified that (1) fast-track legislation in Indonesia can only be adopted through Perpu with all its exemptions and exceptions; (2) the transformation of law-making under Joko Widodo's administration is associated with political pragmatism, political personalization, the elimination of the opposition, and cartel parties; and (3) the transformation of law-making under Joko Widodo's administration is detrimental to the future of Indonesia's democracy. The transformation has degraded the quality of deliberation in law-making. Besides, it does not adhere to law-making procedures, resulting in elitist and conservative laws.

Abstract

The fulfillment of Child-Friendly City (CFC/KLA) policies represents both a constitutional obligation and an international commitment within the framework of children’s rights governance. Nevertheless, the implementation of KLA policies in several regions of Indonesia remains suboptimal, partly due to the lack of vertical harmonization between local regulations and national regulatory frameworks concerning Child-Friendly Cities. In this regard, local governments hold a strategic role in implementing child protection policies at the regional level. This study aims to analyze, first, the legal policy strategies adopted by the Local Governments of Yogyakarta City, Sleman Regency, and Bantul Regency to achieve KLA status; and second, the vertical harmonization of local regulations with higher regulations. This research employs normative legal research, drawing on statutory and conceptual approaches. The findings show that each local government adopts different legal policy strategies based on institutional capacities, socio-legal conditions, and regional policy priorities. The study also identifies that several local regulations have not been fully harmonized with Presidential Regulation Number 25 of 2021 concerning Child-Friendly City Policy and Minister of Women’s Empowerment and Child Protection Regulation Number 12 of 2022 concerning the Implementation of Child-Friendly Cities. The inconsistencies are reflected in differences in KLA assessment indicators, the legal form of Regional Action Plans (RAD KLA), implementation stages, and the composition of KLA Task Forces. These findings indicate fragmented local regulatory governance and the absence of a uniform harmonization model for implementing Child-Friendly City policies at the local level.
