Abstract

Law Number 41 of 2004 concerning Waqf is one of the reform products that have received the attention of many researchers. This paper examined the Waqf Law from the perspective of Pancasila, namely to answer whether the values of Pancasila have been actualized in it. This research is a juridical-normative study, by analyzing the contents of Waqf Law with the parameters of Pancasila values in the legislation. The results show that the values of Pancasila are well actualized in Waqf Law. The actualization of Pancasila values is contained in in every norm of Waqf Law.

Abstract

The Taliban are currently in control of the government in Afghanistan after taking over the authority from President Ashraf Ghani. The takeover is classified as a government coup because it was not conducted under the Afghan Constitution. Departing from this issue, this normative research examines the background of the Afghan government coup d’etat and analyzes it from the Islamic Constitutional Law perspective. The result concludes that (1) the coup of the Afghan government by the Taliban was triggered by the withdrawal of US troops from Afghanistan as a follow-up to the Doha agreement made between the United States and the Taliban. After the Taliban succeeded in occupying several areas, including the capital city of Kabul, Ashraf Ghani fled from Afghanistan to the United Arab Emirates, causing the collapse of the government; and (2) from the perspective of Islamic Constitutional Law, the Afghan government coup can be viewed from (a) the obligation to comply with the constitution, and (b) post-coup benefit considerations. Abstract

Pondok pesantren hadir di tengah masyarakat tidak hanya sebagai entitas pendidikan semata namun memiliki fungsi lain sebagai pusat sosial dan siar keagamaan. Guna meningkatkan upaya pembinaan dan pengembangan masyarakat, pesantren senantiasa berupaya memperkuat eksistensinya dan mencapai kemandirian. Undang-Undang Nomor 18 Tahun 2019 tentang Pesantren (Undang-Undang Pesantren) merupakan landasan hukum yang jelas bagi pemerintah pusat dan daerah untuk memfasilitasi pengembangan pesantren. Dalam kaitan desentralisasi dan otonomi daerah, Undang-Undang Pesantren menempatkan pemerintah pusat dan daerah sebagai aktor kunci dalam mendukung penyelenggaraan fungsi pesantren. Di Kabupaten Boyolali, pesantren memiliki potensi besar untuk mencetak masyarakat yang agamis dan progresif. Penelitian ini bertujuan untuk mengkaji dua hal utama, yaitu (1) bagaimana desentralisasi urusan pemerintahan terkait fasilitasi penyelenggaraan pesantren? dan (2) bagaimana peran Pemerintah Daerah Kabupaten dalam urusan fasilitasi penyelenggaraan pesantren? Penelitian ini dimaksudkan agar dapat memberikan gambaran mengenai efektivitas kebijakan dan peran pemerintah daerah dalam mendukung keberlangsungan dan pengembangan pesantren di tingkat lokal.

Abstract

The 2024 election should be a momentum towards substantive democracy. Unfortunately the decision of the Constitutional Court in 2022 regarding ministers or ministerial-level state officials not having to resign from their positions when running for president election, is considered to be a bad start to the 2024 election. This research questions how the Constitutional Court can take a role in realizing substantive democracy in Indonesia especially in the 2024 election? The method used in this study is normative legal research using a paradigmatic approach, namely progressive and historical law enforcement, namely examining previous decisions of the Constitutional Court. The results of the study conclude that the Constitutional Court should be able to take a role in realizing substantive democracy in one way through progressive law. In its history, the Constitutional Court has issued progressive decisions that support the realization of substantive democracy. Such as, for example, in the decision that eventually gave birth to a theory about general election violations, namely structured, systematic and massive (TSM) and decisions that allow the use of ID cards or passports to vote
