Abstract

This study discusses the implementation of the Minister of Energy and Mineral Resources Regulation No. 21 of 2017 Article 3 Paragraph (1) concerning the Management of Drill Mud and Drill Cutting Waste in Geothermal Drilling by the Mandailing Natal Regency Environmental Service. This research was motivated by complaints from residents of the village of Sibanggor Tonga, Puncak Sorik Marapi District, Mandailing Natal Regency about the waste flowing into the residents' agricultural land which resulted in the residents' rice plants not developing as usual, causing implementation that was not in accordance with existing regulations.  This type of research is afield researchusing a qualitative descriptive analysis method. The method of collecting data for this research is by means of interviews and documentation in accordance with the provisions contained in the Regulation of the Minister of Energy and Mineral Resources Number 21 of 2017.  The results of the study state that the implementation of the Minister of Energy and Mineral Resources Regulation Number 21 of 2017 Article 3 Paragraph (1) concerning the Management of Drill Mud and Drill Cutting Waste in Geothermal Drilling by the Mandailing Natal Regency Environmental Service has been implemented, this can be seen from the form of implementation that has been implemented by The Environment Agency is to carry out direct supervision of the location of the flow of waste, give warnings to geothermal energy companies if they have violated the provisions in the regulations and impose sanctions on the agency or company if they have violated applicable regulations or are not in accordance with the company's way of working.

Abstract

Based on the above background, the purpose of this study is to determine the implementation of the Padangsidimpuan City Regional Regulation Number 41 of 2003 Article 9 concerning the Prohibition of Selling on Public Roads. This research is motivated because there are lots of traders who sell who occupy places that have been determined by the Regional Government, but there are also traders who sell not in the right place or traders who sell in places that can disturb the community or other road users such as in sidewalk.The type of research used by the researcher is a qualitative research that is normative and empirical. the data used are primary and secondary data, data collection methods by observation, interviews and documents. The data collected were analyzed using editing, verification and analysis methods.Based on the results of the research above, it is obtained that the implementation of Regional Regulation Number 41 of 2003 Article 9 concerning the Prohibition of Selling on Public Road Agencies in Padangsidimpuan City has been running but not yet ideal. The Civil Service Police Unit has carried out raids, given warnings, provided sanctions in accordance with Article 9, but in the process of socializing and supervising street vendors who are still selling on Jalan Thamrin, it is not yet fully ideal, this can be seen by the number of street vendors selling on the street. Padangsidimpuan City Public Road Agency. And as for the obstacles/obstacles in this implementation: the lack of socialization of the Civil Service Police Unit to street vendors in the Public Road Agency, the lack of mindset of the street vendors in Padangsidimpuan City, and the lack of communication between the community and the Government. Judging from Fiqh Siyasah, that is actually the content of Regional Regulation Number 41 of 2003 Article 9 concerning the Prohibition of Selling in the Padangsidimpuan City Public Road Agency. Made for the benefit of the people, especially the public transport parties who do not feel the congestion anymore, pedestrians get comfort and space to walk comfortably

Abstract

The problem in this research is the implementation of the Regulation of the Minister of Public Works of the Republic of Indonesia Number 03/PRT/M/2013 Article 35 concerning Selection of Final Disposal Sites in Padangsidimpuan City. The type of research used is field research with a qualitative approach. The primary data source in this research is Padangsidimpuan City Environment and Community Service employees. Meanwhile, secondary data are books and scientific journals that are considered relevant to this research. Data collection techniques use observation, interviews and documentation with qualitative descriptive data analysis techniques. The results of this research show that the implementation carried out by the Environmental Service is first, waste sorting which is carried out manually by scavengers. Second, waste processing still uses the Open Dumping system, namely just throwing away waste without any processing. Third, supervision of final disposal sites, namely creating guard posts and people responsible for controlling piles of rubbish at final disposal sites. Then the supporting factor for the Padangsidimpuan City final disposal site is that long before regulations regarding final disposal sites were formed, the final disposal site in Simatohir village already existed. The surrounding environment at the Padangsidimpuan City landfill is also still surrounded by residents' gardens, where air pollution caused by burning smoke from the landfill can be controlled, as can the lechate from the landfill. Then the inhibiting factors for moving the Padangsidimpuan City landfill from Simatohir village to Batang Bahal require large funds, air pollution, and the absence of socialization from the government.

Abstract

The problem in this research is related to the Constitutional Court Decision Number 91/PUU-XVIII/2020 on the Review of Law Number 11 of 2020 concerning Job Creation. This type of research is library research through a normative juridical approach. The data sources used are primary and secondary legal materials. Primary legal materials consist of the Constitutional Court Decision Number 91/PUU-XVIII/2020, Law Number 24 of 2003, Law Number 12 of 2011). While secondary legal material includes official documents consisting of scientific articles, books, journals. Data collection techniques in this study were case study and documentation methods. Furthermore, the data analysis technique used in this study is qualitative analysis that is collecting secondary and primary legal materials on the Constitutional Court's decision related to the problem being studied. The results of this study state that the review of Law Number 11 of 2020 concerning Job Creation refers to the provisions of Law Number 12 of 2011 concerning Formation of Legislation. In the process of its formation it did not apply the principles of forming good laws, including not applying the principle of transparency. So that it does not provide space for participation for the public to participate in discussing the law. The consideration of the Constitutional Court judges in composing the decision is the consideration of justice through Conditional Unconstitutional. Then the legal consequences of the formation of the Job Creation Law included cutting severance pay, termination of employment, no maternity leave and miscarriages for women workers.

Abstract

This research was conducted to find out how the legal punishment for non-Muslims is applied in the Aceh Sharia Court based on the judge's decision. This research takes the form of field research with an empirical juridical approach. The informants used to obtain information regarding caning laws for non-Muslims were judges, everyone at the Aceh Sharia Court by conducting interviews using the purposive sampling method, documentation in the form of judge's decisions, judge's notes. In implementing Islamic law in Aceh, many obstacles were encountered, including sociological obstacles, firkah obstacles, juridical obstacles, community consolidation obstacles, formulation obstacles and political obstacles. So far, the implementation of Islamic sharia law enforcement in Aceh has always been improved. Based on findings in the field, non-Muslims who are found guilty constitutionally have the right to choose state institutions or sharia institutions to obtain justice. By choosing to go to the sharia court, the guilty person must make a letter of compliance so that caning can be applied as a sanction for the wrongdoing.

Abstract

Penelitian ini bertujuan untuk menganalisis peran lembaga Ombudsman dalam meningkatkan pengawasan terhadap kesadaran pengguna pelayanan publik, untuk menganalisis penerapan sanksi hukum lembaga Ombudsmn terhadap lembaga pelayanan publik yang melakukan maladministrasi dan untuk menganalisis kedudukan lembaga ombudsman dalam siyasah syariah. Adapun jenis penelitian ini adalah studi pustaka, pendekatan penelitian ini menggunakan pendekatan normatif yuridis dan pendekatan perundang-undangan, analisis data yang digunakan adalah metode pendekatan kualitatif bersifat non numerik. Hasil penelitian ini menjelaskan bahwa peran ombudsman telah efektif sebab apabila melihat dari fungsi ombudsman sebagai sebuah lembaga pengawasan telah searah dengan yang diinstruksikan oleh peraturan perundang-undangan. Lembaga ombudsman ketika mengatasi sebuah kasus pelanggaran mengenai maladministrasi tidak memihak kepada siapapun dan benar-benar mempertimbangkan pendapat dari pihak pelapor dan terlapor. Ombudsman dalam perkara keefektifan ketika melaksanakan tugasnya dinilai telah sesuai dan akurat sebab dalam mengambil sikap terhadap berbagai ragam laporan tentang perkara maladministrasi langsung diproses serta dituntaskan dengan peraturan perundang-undangan. Ombudsman dimana proses penerapan sanksinya telah berjalan dengan baik yang dimulai dari melakukan pemeriksaan hingga pemberian tindakan korektif terhadap pelaku maladministrasi. Ombudsman mengenai kedudukan dan kewenangannya sebagai lembaga pengawasan mengambil prinsip dari lembaga pengawasan dalam Islam untuk mencapai perbuatan baik dan mencegah yang mungkar sesuai dengan yang dijalankan oleh wilayat al-Muzalim dan wilayat al-Hisbah dalam ketatanegaraan Islam.

Abstract

 Sometimes, individuals encounter financial difficulties in covering all their needs. In this regard, Islam advises its followers to extend a helping hand to those in need, manifested through acts such as grants and loans. Pawn agreements present an alternative solution for communities; however, the ironic reality is that pawn practices found in society often involve usury, which is prohibited by Islamic law. In the realm of Islamic commercial jurisprudence (Fiqh muamalah), a pawn agreement is referred to as "rahn." Rahn involves pledging an item as collateral for a debt transaction. Due to its nature as a "tabaru'" contract, it prohibits any benefit to be gained by the pledger (murtahin). Nevertheless, the murtahin is allowed to collect maintenance fees from the pledger if the pawned item requires maintenance. The significance of pawning in Islam lies in its social function, aiming to assist fellow members of the community. The phenomenon of pawning agricultural land in Padangsidimpuan City, both in terms of conditions and pillars, is not yet valid from a utilization perspective as it still involves usury. Person terkadang bertemu kesusahan finansial untuk menutupi seluruh keperluanya, untuk itu agama Islam sudah memberitahukan agar penganutnya selalu mengulurkan tangan kepada yang membutuhkan, wujudnya dapat berupa hibah dan utang. Perjanjian gadai adalah alternatif solusi bagi masyarakat, ironisnya praktik gadai yang dijumpai dalam masyarakat masih mengandung riba yang diharamkan oleh hukum Islam. Dalam Fiqh muamalah perjanjian gadai disebut rahn. Rahn adalah menggadaikan suatu barang sebagai jaminan atas transaksi utang. Disebabkan sifatnya adalah akad tabaru’, maka dilarang ada manfaat yang diambil oleh murtahin. Murtahin boleh memungut biaya perawatan dari rahin jika benda gadai membutuhkan perawatan. Urgensi gadai dalam Islam adalah hubungan sosial guna membantu sesamanya. Fenomena gadai lahan sawah di Kota Padangsidimpuan dari sisi syarat dan rukun secara total belum sah dari sisi pemanfaatan masih mengandung riba.
