Abstract

The purpose of this study was to determine the implementation of the Palm Oil Plantation Management Cooperation Agreement at PT Tepian Gayor Langkat classified into default, Legal Efforts of the Parties to the act of default in the palm oil plantation management cooperation agreement at PT Tepian Gayor Langkat and Legal Consequences of Default in the Implementation of the Palm Oil Plantation Management Cooperation Agreement at PT Tepian Gayor Langkat. This research uses a normative juridical approach which is literature and field research. The results showed that the implementation of cooperation in managing oil palm plantations at PT Tepian Gayor Langkat showed that the Civil Code had accommodated well, but ended in default. Efforts were made on the act of default by giving a reprimand, a written warning, or a subpoena, making criminal law efforts by making a complaint to the North Sumatra Regional Police, and filing a lawsuit to the Medan District Court. Legal Consequences of Default in the Implementation of the Cooperation Agreement for the Management of Oil Palm Plantations at PT Tepian Gayor Langkat, namely the cancellation of the cooperation agreement and providing compensation of Rp. 200,000.00 (Two Hundred Million Rupiah).

Abstract

This study aims to analyze the implementation of the oil palm plantation management cooperation agreement at PT. The edge of Gayor Langkat, identifies the default that occurred, and evaluates legal remedies and legal consequences arising from the violation. This study uses a normative juridical approach with qualitative descriptive analysis based on literature studies and interviews. The data was analyzed to identify defaults, legal remedies, and consequences in the agreement of PT. The banks of Gayor Langkat. The results of the study show that the implementation of the cooperation agreement between PT. The banks of Gayor Langkat and Darmawan Armiadi were declared in default due to violations of Articles 3, 4, and 8 related to written approvals, financial statements, and profit sharing. The Second Party failed to fulfill its obligations, causing the First Party to lose Rp. 138,726,000. After legal remedies such as reprimands, summonses, and lawsuits, the court ruled on default, canceled the agreement, and sentenced the Second Party to pay damages of Rp200,000,000. This case emphasizes the importance of a strong agreement, strict supervision, and compliance to prevent losses and ensure fairness.

Abstract

The protection of Traditional Cultural Expressions (TREs) within the framework of the modern Intellectual Property Rights system faces significant challenges, primarily due to the dominance of individualistic principles and formal mechanisms based on registration and specifically copyright ownership registration. The first-to-declare system, which initially emphasized recognition of the party who first announced a work or creation, has in practice shifted towards a system that prioritizes formal registration by the first party at the Directorate General of Intellectual Property (DJKI). This article examines the application of the concepts of originality and prior art within the framework of the first-to-declare system, and analyzes their relevance in preventing unilateral claims on TREs by unauthorized parties through the registration mechanism at the DJKI. This research uses a normative juridical approach with an analysis of laws and regulations, international documents, and related case studies. The research results indicate that systemic reforms are needed, including the recognition of collective rights, the development of a TRE database, and the strengthening of the sui generis regime, as preventive measures against TRE misappropriation on the global stage.

Abstract

Globalization has created an interconnected and interdependent world, brought various conveniences while simultaneously raised new challenges in human rights issues. One prominent negative impact is the rise of Transnational Organized Crime (TOC), including human smuggling, which is increasingly facilitated by technological developments and market openness. This practice resembles a free market, where actors compete to attract customers without formal mechanisms for resolving disputes or enforcing contracts, giving rise to trust issues that are often addressed through reputational investment. This study aims to examine the gaps in Indonesia's national law in responding to this phenomenon and assess its relevance to international standards, particularly the Palermo Protocol. Using normative methods through literature review and a comparative approach, this study highlights the relationship between globalization, human smuggling, and the existing legal framework. The findings indicate that although the UN, through the UNODC and the Conference of Parties (COP), has initiated TOC prevention mechanisms, their implementation remains weak without strong normative ties. In conclusion, harmonization of Indonesian law with international standards is needed to strengthen human rights protection and the effectiveness of law enforcement against human smuggling.

Abstract

Latar belakang: Konflik antar ahli waris kerap terjadi ketika salah satu pihak menguasai harta peninggalan secara sepihak, mengabaikan hak pihak lain, dan memicu permasalahan hukum. Perkara No. 35/Pdt.G/2023/PN.Mdn di Pengadilan Negeri Medan menjadi contoh nyata, di mana tanah Hak Guna Bangunan seluas 801 m² dikuasai tanpa persetujuan seluruh ahli waris. Metode penelitian: Penelitian ini menggunakan pendekatan yuridis normatif dengan metode studi kasus, menelaah putusan pengadilan, peraturan perundang-undangan, dan literatur hukum untuk mengidentifikasi pemenuhan unsur perbuatan melawan hukum berdasarkan Pasal 1365 KUHPerdata. Hasil penelitian: Tindakan tergugat terbukti melanggar hak ahli waris lain, menimbulkan kerugian berupa penurunan nilai properti akibat tidak terawat, serta memiliki hubungan kausal dengan kerugian tersebut. Majelis hakim memutus tergugat melakukan perbuatan melawan hukum dan menghukum untuk mengosongkan objek sengketa serta membayar ganti rugi. Kesimpulan: Temuan ini menegaskan penerapan Pasal 1365 KUHPerdata dalam konteks waris, memperluas pemahaman konsep onrechtmatige daad pada hubungan kekeluargaan, dan memberikan preseden bagi penyelesaian sengketa serupa. Kepastian hukum dan dokumen waris yang sah menjadi kunci pencegahan konflik di masa depan.

Abstract

This study aims to analyze the role of novelty and prior art in the first to file system to protect traditional knowledge from invalid patent claims. Traditional knowledge is part of a valuable cultural heritage. Protecting it means maintaining and preserving the cultural identity of a community. In reality, most of the traditional wealth that was once owned by the people of the archipelago has been lost or moved to other countries. The study uses normative legal methods. Data collection was carried out through literature studies, observations, and document analysis. The results of the study show that in the First to File system, patent rights are granted to the first party to file a patent application, not the first party to create an invention. In the context of protecting against invalid patent claims on traditional knowledge, it is important for communities or countries to document their traditional knowledge as prior art. With adequate documentation, it can be shown that the knowledge existed before any patent claims were filed by other parties. So that it can protect traditional knowledge from invalid patent claims. Overall, the concept of novelty and prior art in the first to file system functions as a mechanism to ensure that traditional knowledge that has existed for a long time cannot be patented by unauthorized parties.

Abstract

Communal Intellectual Property (CIP) embodies the collective cultural identity that has been passed down through generations within local communities. Nevertheless, limited legal awareness among entrepreneurs and local producers often hinders the optimal protection and utilization of CIP’s cultural and economic value. This community engagement initiative seeks to improve public understanding of the legal aspects surrounding CIP protection, focusing on the Geographical Indication (GI) framework as a legal tool for safeguarding regional products. The program took place at the Grand Mercure Hotel in Medan, in partnership with the Regional Office of the Ministry of Law and Human Rights of North Sumatra, and was broadcast widely through Radio Move Online to ensure broader public outreach. Employing a participatory approach, the program included legal dissemination sessions, educational workshops, and interactive discussions that brought together MSME actors, academics, and local government representatives. The materials addressed the legal foundation of Geographical Indications as stipulated in Law No. 20 of 2016 concerning Trademarks and Geographical Indications, procedural steps for registration, and the economic and reputational advantages for local communities. The outcomes indicated that participants developed a stronger comprehension of the interconnection between CIP and GI, alongside heightened legal consciousness in protecting local products through formal mechanisms. In conclusion, the program successfully enhanced community legal capacity and promoted broader awareness of Communal Intellectual Property protection across North Sumatra.
