Abstract

This study examines criminal liability for minors involved in fatal traffic accidents, analyzes the sanctions and legal application imposed on child offenders, and identifies obstacles and solutions in resolving such cases. The research employs a normative juridical method with a descriptive-analytical approach, relying on library research through secondary data, including primary, secondary, and tertiary legal materials. Qualitative data analysis is applied by interpreting statutory regulations and relevant legal doctrines to address the research problems. The findings indicate that criminal liability for children who cause death in traffic accidents is determined based on age, in accordance with the Juvenile Criminal Justice System under Law No. 11 of 2012. Sanctions are imposed with consideration of the child’s age, particularly for those over 14 years old. In the case occurring in Tapanuli Tengah, the matter was resolved amicably through restorative settlement between the families involved.

Abstract

Traffic violations committed by juveniles are a legal problem that continues to occur frequently and tends to increase, including in the jurisdiction of the Labuhanbatu Police. This condition not only impacts the safety of road users but also poses challenges in law enforcement, considering that juveniles are legal subjects who are categorized as children and have the right to legal protection. Therefore, law enforcement against traffic violations by juveniles needs to be implemented effectively, proportionally, and oriented towards developmental aspects. The research questions in this study are: 1. How is law enforcement regulated against traffic violations in the Labuhanbatu Police Traffic Unit? 2. How is law enforcement against traffic violations committed by juveniles in the Labuhanbatu Police Traffic Unit? 3. How effective is the Labuhanbatu Police Traffic Unit's response to juvenile traffic violations? The type of research used is normative legal research with a normative juridical approach. This research examines positive legal norms governing road traffic and transportation, specifically Law Number 22 of 2009 concerning Road Traffic and Transportation, as well as other laws and regulations related to law enforcement and child protection. This research is descriptive and analytical in nature, describing applicable legal provisions and analyzing their application systematically, logically, and consistently in traffic law enforcement practices against juveniles.

Abstract

The growth of the automotive industry, particularly motorcycles in Indonesia, has driven an increase in sales and purchase transactions, where spare parts warranties are one of the important factors in consumer decision-making. However, uncertainties often arise regarding warranty implementation, leading to conflicts between sellers and buyers. This study aims to analyze the implementation of consumer protection related to spare parts warranties in motorcycle sales and purchase transactions at CV. Graha Honda Martubung, as well as identify inhibiting factors and applicable solutions. The research method used is empirical juridical with a descriptive analytical approach. Data was collected through library research and field research, including interviews with company representatives, consumers, and relevant legal experts. The results show that the implementation of spare parts warranties at CV. Graha Honda Martubung is largely in accordance with regulations, but there are several obstacles such as insufficient socialization to consumers regarding warranty terms, claim procedures that are still considered complicated, and limited stock of certain spare parts. Based on the analysis results, this study provides recommendations including increased socialization, simplification of claim procedures, and better stock management to improve services and consumer protection.
