Abstract

Penelitian ini bermula dari hipotesa bahwa ketika partai-partai Islam bergururan, dan pada saat yang sama organisasi-organisasi Islam radikal banyak bermunculan, maka bisa diduga, maraknya Perda-Perda syariah di berbagai daerah di Indonesia dipicu oleh aspirasi organisasi-organisasi Islam radikal. Melalui tekanan politik yang mereka lakukan, meliputi penerapan Perda syariah di sejumlah daerah di Indonesia. Penelitian ini menjawab dua rumusan masalah, yakni; Bagaimana peran organisasi Islam dalam menginisiasi dan pembahasan perda Syariah di Sumatra Barat; Mengapa di Sumatra Barat banyak melahirkan Perda Syariah.

Abstract

This study explores the application of Ibn Miskawaih’s ethical philosophy in shaping moral education in Indonesian secondary schools, focusing on Madrasah Aliyah (MA) and General Senior High Schools (SMA). Amid increasing concerns over student deviant behaviors—such as bullying, online gambling, and indiscipline—this research examines how Ibn Miskawaih’s framework, which emphasizes the harmonization of reason (al-Nathiqah), emotion (al-Ghadabiyyah), and instinct (al-Bahimiyyah), is operationalized in contemporary educational settings. Using a qualitative case study approach, data collection involved observations, interviews, and document analysis. Findings reveal distinct approaches: MA integrates religious mentoring and structured moral education, while SMA incorporates moral values within broader character education initiatives. However, both face challenges, including inconsistent parental involvement, weak supervision, and the absence of structured moral assessment tools. This study highlights the need for stronger school-family collaboration, enhanced supervision policies, and systematic moral evaluation instruments. By bridging classical Islamic ethical thought with contemporary education, this research provides valuable insights into the role of Ibn Miskawaih’s philosophy in addressing modern moral challenges and fostering holistic character development among students.

Abstract

Abstract: The rapid development of digital payment systems has increased the demand for financial instruments that comply with Islamic law, including Sharia-compliant electronic money. DSN-MUI Fatwa No. 116/IX/2017 was issued as a normative response to this demand, but it presents several issues related to contract ambiguity, fund protection, and transparency. This study aims to evaluate the fatwa using the maqāṣid al-sharī‘ah framework developed by al-Imām al-Shāṭibī, focusing on the principles of ḥifẓ al-māl (wealth protection), al-‘adl (principle of justice), and al-maṣlaḥah (public interest). The method employed is normative-qualitative analysis through a juridical-philosophical approach, based on literature review of the fatwa document, al-Muwāfaqāt, and related fiqh and financial regulations. The results reveal that the dual-contract model (wadī‘ah and qarḍ) permitted in the fatwa potentially creates legal ambiguity and undermines user rights, especially in the absence of clear transparency and education mechanisms. Therefore, the fatwa requires operational strengthening and regulatory harmonization with financial authorities to ensure a fair, secure, and Sharia-compliant digital financial system. Abstrak: Pertumbuhan sistem pembayaran digital menuntut hadirnya instrumen keuangan yang sesuai dengan prinsip syariah, salah satunya adalah uang elektronik syariah. Fatwa DSN-MUI No. 116/IX/2017 hadir sebagai respons normatif atas perkembangan tersebut, namun mengandung sejumlah isu problematis terkait kejelasan akad, perlindungan dana pengguna, dan prinsip transparansi. Artikel ini bertujuan mengevaluasi fatwa tersebut dengan menggunakan pendekatan teori maqāṣid asy-syarī‘ah yang dikembangkan oleh al-Imām asy-Syāṭibī, dengan fokus pada prinsip ḥifẓ al-māl, keadilan (al-‘adl), dan kemaslahatan (al-maṣlaḥah). Metode yang digunakan adalah analisis normatif-kualitatif dengan pendekatan yuridis-filosofis berbasis studi pustaka terhadap dokumen fatwa, kitab al-Muwāfaqāt, serta sumber fikih dan regulasi keuangan yang relevan. Hasil penelitian menunjukkan bahwa penggunaan akad ganda (wadī‘ah dan qarḍ) dalam fatwa tersebut membuka ruang ambiguitas hukum dan potensi pelanggaran hak pengguna, terutama jika tidak disertai mekanisme edukasi dan transparansi yang memadai. Oleh karena itu, fatwa ini perlu diperkuat dengan pedoman operasional yang lebih detail serta harmonisasi regulatif dengan otoritas keuangan demi menciptakan sistem keuangan syariah digital yang adil, aman, dan maslahat.

Abstract

The development of neuromarketing as an interdisciplinary approach that integrates neuroscience, psychology, and marketing has created new opportunities for a more precise understanding of consumer behavior. However, from the perspective of Islamic business ethics, an academic problem arises regarding the boundary between legitimate innovation and manipulative practices that harm consumers. Techniques such as scarcity and dark patterns raise serious concerns because they risk undermining the principles of justice, contractual clarity, and consumer consent, which are fundamental in Islamic commercial jurisprudence. This study seeks to examine the position of neuromarketing by referring to the framework of maqāṣid al-sharī‘ah, particularly the dimensions of  ḥifẓ al-‘aql (protection of intellect), ḥifẓ al-māl (protection of wealth), and ḥifẓal-nafs (protection of self), alongside relevant fiqh principles. The research employs a library-based method with a critical analytical approach. Data were collected from contemporary neuromarketing literature, consumer ethics studies, and classical sources in Islamic jurisprudence. The analysis was carried out through a dialectical engagement between modern research findings and Islamic normative principles, resulting in an evaluative synthesis. The findings indicate that neuromarketing can be categorized as a halal by design practice when it is directed towards clarifying information, enhancing consumer literacy, and strengthening transparency. Conversely, it becomes manipulative when it exploits consumer cognitive biases. The primary contribution of this research is the formulation of the Shariah Neuromarketing Ethics Index (SNEI) as an ethical audit instrument applicable to the development of the halal marketing industry in the digital era.

Abstract

The fatwa in response to questions about Islamic law at Nahdlatul Ulama was discussed at the NU Bahsul Masail Institute. The methodology used in exploring the law was initially still using the classical fiqh paradigm. However, recently many decisions made by the institution imply a new paradigm that leads to a progressive Islamic approach. The paradigm underlying the decision is not only based on subjectivity ('ulum ad-dien) but also involves a dimension of objectivity (social sciences and humanities). This is reflected in the decision of the Bahtsul Masail ad-Diniyyah al-Maudlu'iyyah PBNU LBMNU forum at the Banjar West Java National Conference on 27 February-1 March 2019 regarding point A: State, Citizenship and State Law. NonMuslim Żimmy in the context of the nation state according to NU is referred to as muwathinīn, namely citizens of equal status. The intersubjectivity of the fatwa in the decision is a transformation of the methodology of the new legal approach at Nahdlatul Ulama in responding to current contextual problems.
