Abstract

The determination of the ideal age of marriage remains a critical issue in Indonesia, where child marriage persists despite the enactment of Law No. 16 of 2019, which raised the minimum marriage age to nineteen. This article aims to formulate an integrative model that combines procedural safeguards under positive law with the substantive readiness criteria of rusyd in Islamic jurisprudence. The study employs a normative-juridical method with comparative analysis, drawing on primary sources (the Quran, classical fiqh, and statutory law) and secondary empirical data from BPS, UNICEF, and religious court decisions. The comparative framework is structured across three dimensions: (1) legal objectives (maqasid al-shariah and child protection norms), (2) substantive indicators of marital readiness (psychological, financial, and emotional maturity), and (3) procedural instruments (statutory age thresholds and judicial dispensations). The findings reveal that while positive law provides procedural certainty through age limits, its effectiveness is weakened by frequent dispensations that rarely assess readiness. Conversely, Islamic law emphasizes rusyd as a holistic benchmark but lacks enforceable procedural mechanisms. This study proposes a dual-layered model in which statutory age serves as a procedural safeguard, while readiness assessments operationalize rusyd as substantive criteria. The originality of this research lies in the proposal of a readiness assessment instrument for religious courts, designed to standardize judicial discretion in marriage dispensation cases. By integrating doctrinal analysis with socio-legal evidence, the study not only advances family law scholarship but also offers concrete policy implications. In practice, the readiness assessment can serve as a tool for judges to evaluate applicants’ intellectual, emotional, and socio-economic maturity, thereby reducing the incidence of early marriages approved through dispensations. This approach strengthens family resilience, aligns judicial practice with the objectives of maqasid al-shariah, and ensures that legal reforms are translated into measurable improvements in child protection and community well-being.

Abstract

Technological developments have changed communication patterns, with digital platforms often triggering hate speech and social conflict. The Qur'an provides ethical speech guidelines emphasizing honesty, prohibiting slander, and promoting caution in conveying information. This study examines Muhammad Hasbi Ash-Shiddieqy's exegesis of Qur'anic verses related to hate speech and formulates ethical speech principles for social media from his perspective. Using qualitative library research with thematic exegesis (tafsir mawḍū'ī) and descriptive-analytical methods, this study reconstructs Hasbi's ethical framework. The findings reveal six principles of Qur'anic communication ethics relevant to digital media: qaul balīgh (speech that penetrates the soul), qaul layyin (gentle speech), qaul maysūr (easy and pleasant speech), qaul ma'rūf (good speech), qaul tsaqīl (responsible speech), and the avoidance of qaul az-zūr (false speech). Derived from verses such as QS. An-Nisa' 4:62–63, QS. Thaha 20:43–44, QS. Al-Isra' 17:28, QS. Al-Baqarah 2:235, and QS. Al-Muzzammil 73:5, these principles offer a comprehensive ethical framework beyond merely listing prohibited acts (ghibah, namimah, fitnah). Hasbi's exegesis reconstructs these values into a systematic framework applicable to social media, creating a healthy communication space aligned with Islamic values.

Abstract

For Muslims, hadith is something very important because it contains various traditions and habits that developed during the time of the Prophet (PBUH). Indonesia is known for its various traditions and cultures in various regions where these traditions and cultures are integrated with the social life of the community. One of them is the oral tradition of Basiacuong found in the Malay community in Kampar Regency which has been applied for generations where previously it had been carried out by Kampar community leaders. This research is a field research, by tracing directly to the field of objects in the field to dig up information and obtain various data that appear in the field, by observing social phenomena that exist in the community when the tradition is carried out. The location of this research is Koto Perencaran Village, Kampar Regency, because the community in the village still maintains the oral tradition of Basiacuong and applies it in various traditional ceremonies such as marriage, circumcision, akikah, inauguration of traditional heads and so on. Data collection techniques include observation, interviews, and documentation. The results of this study conclude that the Basiacuong tradition found in the Malay community in Koto Perambahan Village, Kampar Regency is the implementation and interaction of living hadith, because the tradition contains good messages and advice, even though the tradition is carried out in traditional ceremonies.

Abstract

In the era of digital disruption, digital literacy extends beyond technical competence to encompass ethical awareness and responsible media engagement. Gen Z, having grown up in a technology-saturated environment, requires a strong foundation of values to navigate the complexities of the digital sphare. This study aims to critically analyze the role of Ḥadīth as a source of values and ethics in shaping digital literacy awareness among Gen Z, ensuring that the use of technology is not only proficient but also morally grounded and socially responsible. The study is motivated by the increasing use of social media and digital platforms that are frequently misused for the spread of misinformation (hoax), hate speech, and other forms of unethical behaviour. Ḥadīth as one of the authentic sources of Islamic teachings provides a normative framework for cultivating critical, ethical, and responsible attitudes in the digital space. This research uses a qualitative method, using  a literature review and content analysis approach. Data were collected from selected Ḥadīth texts related to communication manners, social responsibility, and ethics of information dissemination. The results demonstrate that Ḥadīth plays a significant role in building digital literacy among Gen Z. Core values such as honesty, responsibility in conveying information, and the obligation to verify the information (tabayyun) are highly relevant in addressing the challenges of the digital era. By internalizing these values grounded on Ḥadīth, Gen Z can engage with digital technology more crtitically and responsibly, thereby promoting productive and positive use of digital media.
