Abstract

Protecting children is difficult to do without official registration of the child's birth, because the parents got married without having an official marriage record in the regulations of the Republic of Indonesia, in the sense that it has not been recorded at the KUA. However, the marriage is valid according to religious views because it has fulfilled the pillars and conditions of marriage in accordance with the guidance of the Shari'ah. The formulation of the problem that will be answered in this study is how the protection of children before Proofing of marriage is reviewed through positive law in the decision of the syar'iyah court, Case Number 40/Pdt.P/2021/MS.Bna, and what is the method of finding the judge's law regarding the granting of requests for ratification of the child's lineage from couples who don’t have Proof of marriage, while the aim is to analyze the protection of children before Proofing of marriage if viewed according to positive law and analyze the judge's legal methods in granting the ratification of the lineage of children from couples who don’t have Proof of marriage. This study uses qualitative methods with a normative juridical approach. The data collection method was carried out using the library research method, data analysis was carried out in a normative descriptive way. This study concludes that every child has the right to protection and obtains his rights, one of which is identity and citizenship status. A child's identity must be given from birth, which is stated in the birth certificate (vide Article 5, Article 7, paragraph (1) and Article 27 paragraph (1) and (2) of Law Number 23 of 2002 concerning Child Protection. Discovery method There are three judges' laws; referring to the Islamic legal doctrine contained in the book Al Fiqhu Al Islami Wa Adillatuhu, referring to the provisions of Article 55 Paragraph (3) of Law Number 1 of 1974 concerning marriage juncto Article 103 Paragraph (3) Compilation of Islamic Law in Indonesia and in Article 47 of Law Number 23 of 2006 concerning Population Administration.

Abstract

Such rapid development of science and technology lately resulted in such rapid changes in the social life of the human culture, one of which is medical field. But although there has been no progress there may be some problems that have not been solved by human beings, such as the discovery of drugs or a potent bidder to cure deadly diseases such AS AIDS, cancer, and other malignant diseases. These deadly diseases are a reason for someone to end his life from having to endure a long time ill one of them by asking for family assistance to end his life, which in medicine is called euthanasia. This research aims to determine how the position of passive euthanasia and birthright position for applicants of euthanasia passive according to Islamic law when viewed in terms of maqāṣid al-Syarī'ah. This research is done by collecting the library materials in the form of books, encyclopedia, and scientific works related to this discussion. The results of this study gave the answer that stopping the treatment, or releasing the organ and respiratory aids from the sick or euthanasia passive the law may but only in the case of the sick suffer the death of the brainstem. Because while using these tools is contrary to sharia teachings among them, postponing the management of dead and its funeral without emergency reasons, postponing the division of inheritance and resigning the time of his wife. Therefore, the birthright position for the heir or the family that asks or plea for passive euthanasia is not hindered by the heir. Because the passive euthanasia in this case is not classified as an act of murder.

Abstract

Government Regulation Number 54 of 2007 concerning the Implementation of Child Adoption explains that the age of prospective adoptive parents is at least 30 (thirty) years old and the highest is 55 (fifty five) years. In the Determination of the Banda Aceh Syar'iyah Court Number 120/Pdt.P/2019 it is stated that a single parent who wants to adopt a child is 59 years old, which according to applicable legal provisions does not meet the requirements or has passed the age limit in the requirements for child adoption. In this case, the Banda Aceh Syar'iyah Court rejected the Petitioner's application, then the Petitioner submitted an application to the cassation level, so that the Supreme Court's decision Number 777 K/Ag/2019 was granted. This study aims to explain the legal considerations by the judges of the Supreme Court in granting Decision Number 777 K/Ag/2019 concerning Child Adoption, to explain the juridical review of Decision Number 777 K/Ag/2019 regarding the cancellation of the first-degree determination. The research method that the author uses is a qualitative descriptive analysis, which consists of primary data materials and secondary data. The results of the study explained that the Supreme Court granted the appeal by using clear legal arguments that were against the legislation. The panel of judges of the Supreme Court granted the request by looking at the advantages and benefits for the adopted child who is the nephew of the single parent. Thus, there was jurisprudence used by judges for the case of Decision Number 777 K/Ag/2019 which is a source of material law. The Supreme Court has issued its decision with legal considerations, the rule of law may be set aside. Juridically, the decision of the Supreme Court is in accordance with the rules in force in Indonesia. With this decision, it can be used as jurisprudence for further judges to handle the same case.

Abstract

Hukum kewarisan dalam Islam tentang pengangkatan anak tidak membawa pengaruh apapun terhadap status kewarisan anak tersebut karena tidak ada hubungan nasab antara keduanya. Namun dalam prakteknya, ditemukan penetapan di Mahkamah Syar’iyah Banda Aceh Nomor 0084/Pdt.P/2016/MS.Bna yang menetapkan anak angkat sebagai salah seorang ahli waris. Kajian ini ingin melihat bagaimana proses penetapan terhadap anak angkat sebagai ahli waris di Mahkamah Syar’iyah Banda Aceh, apa yang menjadi pertimbangan Hakim dalam menetapkan anak angkat sebagai ahli waris, dan bagaimana tinjauan hukum fiqih mawaris terhadap penetapan anak angkat sebagai ahli waris di Mahkamah Syar’iyah Banda Aceh. Untuk menjawab permasalahan tersebut dilakukan sebuah kajian melalui pendekatan yuridis empiris dan menggunakan metode pengumpulan data lapangan yang dipadukan dengan metode pengumpulan data kepustakaan melalui teknik wawancara dan dokumentasi. Hasilnya adalah proses penetapan anak angkat sebagai ahli waris dalam penetapan Nomor 0084/Pdt.P/2016/MS.Bna di Mahkamah Syar’iyah Banda Aceh diselesaikan dalam beberapa tahapan, yakni diawali dengan pendaftaran dan registrasi perkara, pembacaan surat permohonan oleh hakim, para pemohon memberikan keterangan di persidangan berkaitan dengan dalil-dalil permohonan, tahapan pembuktian, tahapan permusyawaratan majelis hakim, dan pembacaan penetapan. Adapun pertimbangan Hakim Mahkamah Syar’iyah Banda Aceh dalam menetapkan anak angkat sebagai ahli waris didasarkan kepada Pasal 171 huruf (c) Kompilasi Hukum Islam dan pemeriksaan silsilah keluarga para pemohon untuk menentukan hubungan status kewarisan para pemohon terhadap termohon yang membuktikan bahwa anak angkat tersebut sebenarnya merupakan anak dari saudari perempuan pewaris yang telah meninggal dunia lebih dahulu. Dalam tinjauan fikih mawaris penetapan anak angkat sebagai ahli waris di Mahkamah Syar’iyah Banda Aceh dipandang tidak melanggar ketentuan hukum kewarisan Islam dan digolongkan dalam kasus kalalah.

Abstract

The phenomenon of Early marriage remains a critical social issue in Blangkejeren District, Gayo Lues Regency, with significant implications for the fulfilment of children’s rights within the family. Despite the existence of a comprehensive legal framework, particularly Law Number 35 of 2014 on Child Protection, its implementation at the family level among early-married couples remains ineffective. This study examines the fulfilment of children’s rights in families practising early marriage and identifies the legal and socio-familial factors hindering its realisation. Employing a juridical-empirical approach with a qualitative descriptive design, the research integrates normative legal analysis with empirical data collected through in-depth interviews with early-married families, community leaders, and relevant institutions. The findings reveal a clear gap between legal norms and social practice, as children’s rights related to caregiving, education, and health are inadequately fulfilled. These conditions are driven by parents’ economic and psychological unpreparedness, limited legal awareness, and weak institutional support. The study highlights the need to strengthen child protection law implementation through structured premarital education, young family empowerment, and enhanced institutional oversight.

Abstract

The increasing participation of women as migrant workers has created complex socio-legal consequences within family structures, particularly concerning the fulfillment of children's rights. While economic remittances from female migrant workers contribute to improving household welfare, the prolonged physical absence of mothers raises critical concerns regarding parenting, emotional attachment, and moral development of children. Existing studies largely focus on the economic benefits of labor migration, while limited attention has been given to the holistic fulfillment of children's rights from an Islamic legal perspective. This study aims to examine the fulfillment of children's rights in families of female migrant workers in Bukit Tusam District, Southeast Aceh Regency, and to analyze the issue through the framework of Islamic law. The research employs an empirical qualitative approach through field research, with data collected via in-depth interviews, observation, and documentation involving female migrant worker families, substitute caregivers, and community stakeholders. The findings indicate that children's economic and formal educational rights are relatively fulfilled through remittances and continued access to schooling. However, the rights related to parental care, emotional support, and moral-religious guidance are often inadequately addressed due to the absence of maternal caregiving. From the perspective of Islamic law, the fulfillment of children's rights requires a holistic approach grounded in the principles of maqāṣid al-sharīʿah, particularly the protection of lineage, intellect, and welfare. This study contributes to the discourse on Islamic family law by emphasizing the need for integrative policies and community-based support systems to ensure the comprehensive protection of children's rights in migrant worker families.

Abstract

This research is motivated by the practice of altering the lineage of adopted children on the Family Card (Kartu Keluarga) in Marihat Butar Village without a court decree. This practice creates a problem in the form of a discrepancy between administrative facts and the provisions of positive law and Islamic law, which has not been extensively analyzed integratively from both legal perspectives. The objective of the research is to analyze the juridical consequences of this non-procedural lineage alteration, specifically its impact on population administration status and the civil rights of the child from the perspective of Islamic law. The method used is qualitative with a normative legal theory approach, collecting primary data through in-depth interviews with 5 adoptive couples, which were then analyzed descriptively-analytically. Results and discussion indicate that this practice creates legal dualism. In Islamic law, it results in the severance of legitimate lineage, inheritance rights, and mahram relations with the biological parents. Meanwhile, in positive law, this action creates inconsistency between population documents and biological facts, potentially causing issues regarding the child's civil legal status and public services. The implication of these findings reveals the urgency for socialization and strict law enforcement regarding legitimate child adoption procedures. There is also a need to integrate population administration databases with court rulings to prevent similar deviations in the future. [Penelitian ini dilatarbelakangi oleh praktik pengubahan nasab anak angkat dalam Kartu Keluarga (KK) di Desa Marihat Butar tanpa melalui penetapan pengadilan. Praktik ini menciptakan masalah berupa kesenjangan antara fakta administratif dengan ketentuan hukum positif dan hukum Islam, yang belum banyak dianalisis secara integratif dari kedua perspektif hukum tersebut. Tujuan penelitian adalah menganalisis konsekuensi yuridis dari pengubahan nasab secara tidak prosedural tersebut, khususnya dampaknya terhadap status administrasi kependudukan dan hak-hak keperdataan anak dalam perspektif hukum Islam. Metode yang digunakan adalah kualitatif dengan pendekatan teori hukum normatif, mengumpulkan data primer melalui wawancara mendalam terhadap 5 pasangan orang tua angkat, yang kemudian dianalisis secara deskriptif-analitis. Hasil dan pembahasan menunjukkan bahwa praktik ini menimbulkan dualisme hukum. Dalam hukum Islam, praktik ini mengakibatkan terputusnya hubungan nasab sah, hak waris, dan hubungan mahram dengan orang tua kandung. Sementara dalam hukum positif, tindakan ini menciptakan inkonsistensi antara dokumen kependudukan dan fakta biologis, berpotensi menimbulkan masalah dalam status keperdataan anak dan pelayanan publik. Implikasi dari temuan ini mengungkap urgensi sosialisasi dan penegakan hukum yang tegas mengenai prosedur pengangkatan anak yang sah. Diperlukan juga integrasi database administrasi kependudukan dengan putusan pengadilan agar dapat mencegah penyimpangan serupa di masa depan.]

Abstract

Divorce due to husband neglect is a family problem that has a significant impact on the protection of children's rights, especially in the determination of custody (hadhanah). This condition requires legal considerations that put the best interests of children as the top priority. This research focuses on the Decision of the Banda Aceh Syar'iyah Court Number 310/Pdt.G/2023/MS. Bna to examine the extent of the judge's consideration in determining child custody in the case of husband neglect. The purpose of this study is to analyze the basis of the judges' deliberations and assess them from the perspective of Islamic law. This study uses a qualitative method with a normative juridical approach. Data was obtained through a literature study that included analysis of court decisions, laws and regulations, and relevant fiqh literature. The data was analyzed descriptive-analytically to identify the suitability between judges' considerations, positive legal norms, and Islamic legal principles in determining child custody. The results of the study showed that the panel of judges determined the right of hadhanah to the mother with the consideration that the husband was proven to have committed neglect, did not provide maintenance, and did not meet the moral feasibility in raising children. This consideration is in line with the provisions of Article 105 of the Compilation of Islamic Law and the principle of the welfare of children in Islamic law. Thus, the ruling reflects the harmonization between positive law and Islamic law in ensuring the best protection for children after divorce. Therefore, this study recommends that courts consistently prioritize the principle of the best interests of the child and strengthen benefit-based considerations in every custody decision in family neglect cases.
