Abstract

Medical dispute resolution efforts are the implementation of legal protection for medical personnel. A medical worker who is affected by a medical dispute can enter into the realm of civil (court), criminal (police), professional ethics (MKEK), professional discipline (MKDKI) together. Whereas in carrying out the activities of the medical profession, a doctor has the right to personal protection, honor, dignity, and is entitled to a sense of security and protection from the threat of fear to do or not do something which is a human right guaranteed by the Constitution. By using the normative juridical method of this paper, legal protection for medical personnel in the resolution of medical disputes is seen from the current legal certainty. Medical crimes and the protection of medical personnel have been regulated in the Criminal Code, Law No. 29 of 2004 on Medical Practice, Law No. 36 of 2009 on Health and Law No. 44 of 2009 on Hospitals. Settlement of medical criminal disputes can be through litigation and non-litigation, but there is an empty space in the legal protection of medical criminal disputes because there are no laws and regulations that regulate it even though it has been carried out, namely by penal mediation.

Abstract

Abstrak: Penerbitan SIM bagi penderita epilepsi merupakan bagian dari wewenang kepolisian dalam rangka menjamin keamanan, kelancaran dan ketertiban dalam berlalu lintas. Penderita epilepsi yang memiliki resiko kecelakaan lalu lintas akibat serangan kejang mendadak saat mengemudi merupakan sebuah permasalahan yang membutuhkan perhatian khusus dari berbagai pihak. Penelitian ini menggunakan pendekatan normatif dengan spesifikasi penelitian deskriptif analitis. Sumber data didapatkan dari bahan hukum primer yang bersifat mengikat. Metode analisis data yang digunakan adalah metode analitis kualitatif. Hasil dari penelitian ini menunjukkan bahwa UU No 22 Tahun 2009 dan Perpol No 5 Tahun 2021 merupakan landasan hukum penerbitan SIM yang berlaku saat ini. Namun, kedua peraturan hukum ini tidak secara khusus mengatur proses penerbitan SIM pada penderita epilepsi. Hal ini menimbulkan keraguan apakah isi hukum ini sudah cukup dan dapat diimplementasikan dalam praktiknya sehari-hari.Kata kunci: epilepsi, surat izin mengemudi, pembatasan mengemudi, regulasi hukum Abstract: The issuance of a driver's license for individuals with epilepsy is part of the police authority to ensure safety, smooth traffic flow, and order on the roads. Epilepsy patients at risk of sudden seizures while driving pose a specific concern that requires attention. This research employs a normative approach with descriptive-analytical research specifications. Data sources are derived from legally binding primary legal materials. The data analysis method used is qualitative analytical. The findings indicate that Law No. 22 of 2009 and Regulation No. 5 of 2021 serve as the current legal basis for driver's license issuance. However, these legal regulations do not specifically address the driver's license issuance process for individuals with epilepsy. This raises doubts about whether the legal content is sufficient and can be implemented in daily practice.Keywords: epilepsy, driver's license, driving restrictions, legal regulations.
