Abstract

Praktik penahanan ijazah oleh perusahaan terhadap karyawan masih sering ditemukan dalam dunia kerja di Indonesia. Umumnya, hal ini dilakukan sebagai bentuk pengamanan agar pekerja tidak mengundurkan diri secara sepihak atau melanggar perjanjian kerja. Meskipun dianggap lazim, praktik ini menimbulkan sejumlah persoalan hukum, baik dari sisi pidana maupun ketenagakerjaan. Dalam perspektif hukum pidana, tindakan menahan ijazah tanpa dasar yang sah dapat dikategorikan sebagai tindakan melawan hukum yang berpotensi sebagai bentuk penggelapan atau perampasan hak milik sebagaimana diatur dalam KUHP. Sementara itu, dari segi hukum ketenagakerjaan, tindakan tersebut bertentangan dengan asas perlindungan hak pekerja yang dijamin dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Artikel ini menggunakan pendekatan yuridis normatif untuk menelaah keabsahan tindakan penahanan ijazah dalam hubungan kerja. Berdasarkan telaah terhadap peraturan perundang-undangan, literatur hukum, serta yurisprudensi, disimpulkan bahwa tidak terdapat ketentuan hukum yang membenarkan praktik tersebut. Oleh karena itu, tindakan penahanan ijazah oleh perusahaan dapat dipandang sebagai pelanggaran hukum yang berpotensi dikenai sanksi pidana dan harus menjadi perhatian serius oleh aparat penegak hukum dan pengawas ketenagakerjaan.

Abstract

The principle of ultimum remedium serves as a fundamental concept in criminal law, emphasizing that criminal sanctions should be the final recourse after other legal remedies are deemed insufficient. This doctrine arises from the understanding that criminal law is inherently repressive and should only be employed when non-penal approaches fail to resolve legal issues. In Indonesia, the application of this principle in handling minor criminal offenses remains problematic. Although recent legal reforms have begun to incorporate restorative justice mechanisms, punitive approaches still dominate in practice. Many individuals committing petty crimes continue to be prosecuted through formal judicial proceedings and subjected to imprisonment, despite the relatively minor harm caused. This study explores the extent to which the ultimum remedium principle has been implemented in the enforcement of minor criminal offenses in Indonesia. It also examines the challenges hindering its effective application and offers potential policy recommendations. Using a normative juridical approach, this research analyzes statutory provisions and relevant case studies. The findings indicate that the principle has not been fully realized, primarily due to inconsistent enforcement practices among law enforcement officials and the underdevelopment of alternative dispute resolution frameworks outside the court system.

Abstract

The rapid advancement of information technology has significantly transformed modern society, particularly in the way personal data is collected, stored, and processed. While the digital era offers convenience and efficiency, it also presents substantial risks, especially concerning the misuse of personal data by irresponsible individuals, corporations, or other entities with access to sensitive information. Such misuse can take the form of identity theft, online fraud, or unauthorized exploitation of data for economic gain without the data owner's consent. These circumstances highlight the urgent need for comprehensive regulations and effective criminal law mechanisms to protect personal data. This article aims to explore the criminal law implications of personal data misuse within the Indonesian context and assess the extent to which current legal instruments address these challenges. The research adopts a normative juridical approach by analyzing Law No. 27 of 2022 on Personal Data Protection (PDP Law), the Indonesian Penal Code (KUHP), and other related legal provisions. Furthermore, the study examines recent cases to illustrate the weaknesses in cyber law enforcement. The findings reveal that although personal data protection regulations exist, significant gaps remain in implementation, inter-agency coordination, and the effectiveness of criminal sanctions.
