Abstract

This study examines the expansion of those entitled to the safekeeping of compensation under Article 89 paragraph (3) of PP (Government Regulation) on Land Acquisition and its effects. Land acquisition is based on the state's right to control and the government's provision of land for compensation. The district court can serve as a repository for compensation funds, allowing for their secure management and distribution. As a result of the amendment included in Article 89 paragraph (3) PP on Land Acquisition, compensation is also granted to unidentified persons, which can be understood as land parcels whose owners are unidentified. This study takes a statutory and philosophical approach to normative juridical research. Based on the findings of this study, it is clear that the amendment to PP on Land Acquisition Article 89 paragraph (3) is to include land parcels for which the rightful owners cannot be located. The planned expansion is counter to Article 33, paragraph (3) of the 1945 Constitution of the Republic of Indonesia, together with UUPA (Basic Agrarian Law) and Land Acquisition Law, which establishes the state's power to control. Furthermore, from the perspective of its development, it shows that the government cannot expand the PP on Land Acquisition provisions outside the Land Acquisition Law. Since those three values—justice, certainty, and benefit—were left out of the law's formulation, the expansion in Article 89(3) of PP on Land Acquisition did not serve the goal of lawmaking.

Abstract

Online transactions, including in the cosmetics industry, have been driven by advances in information technology. However, this convenience has been accompanied by an increase in the circulation of counterfeit skincare products in online stores, which can harm consumers financially and health-wise. The purpose of this study is to examine how Law No. 8 of 1999 on Consumer Protection (UUPK) provides legal protection for consumers against the circulation of counterfeit cosmetics in online stores. Additionally, this study also seeks to identify ambiguities and issues in its implementation. This study uses a normative legal method employing case studies and a legislative approach. Data was obtained by reviewing literature, examining legal regulations, and analyzing case documentation. The study reveals that legal protection for customers purchasing counterfeit skincare products on online stores is not yet optimal. This is attributed to insufficient oversight, lack of clear regulations regarding market responsibility, and low consumer awareness of their rights. Additionally, the complaint and dispute resolution system still does not adequately protect consumers. To provide better consumer protection in the digital age, this study recommends strengthening regulations, further oversight by relevant agencies, improving consumer education, and refining the complaint and enforcement systems.

Abstract

Indonesia has faced various problems regarding the fulfillment of targets in energy development until now. Dependence on non-renewable energy is still high, causing the adequacy of energy reserves, especially in Indonesia, to still be highly dependent on the development of exploration. The legal rule of the authority of the regency/city local government to manage energy requires consistency in its implementation as stipulated in Article 14 paragraph 1 of the Local Government Law states that the determination of the division of government affairs in the fields of forestry, marine, and energy and mineral resources is divided into two, namely the Central Government and the Provincial Regions, in this case it clearly negates the autonomy of the Regency/City Regional Government. The authority of the provincial local government in the management of renewable energy Currently, the legal rules governing the authority of the central government in energy management are contained in Article 14 paragraph (1) and paragraph (3) of the Local Government Law. The authority of the regency/city local government in the management of renewable energy, the legal rules that regulate the authority of the provincial local government in energy management are contained in Article 26 paragraph (2) of the Energy Law. The lex specialis set of provisions or norms must be at a level (hierarchy) that is the same as the lex generalis set of provisions or norms. So it is clear that the City Government has the authority, namely attribution authority that comes directly from the legislation, because it is sourced directly from Article 26 paragraph 3 of the Energy Law.

Abstract

Tujuan studi ini adalah untuk mengkaji kriteria yuridis pelanggaran yang serius dan mekanisme pembuktian unsur secara sengaja dalam Pasal 81 Undang-Undang Nomor 32 Tahun 2009 (UU PPLH) terkait kewenangan korektif Menteri. Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil studi menunjukkan bahwa terdapat kekaburan norma pada Pasal 81 yang berpotensi menimbulkan ketidakpastian hukum dan sengketa kewenangan pusat-daerah. Studi ini menemukan bahwa kriteria pelanggaran serius harus dibatasi secara limitatif pada dampak lintas batas dan kerusakan ireversibel. Selain itu, unsur kesengajaan Pemerintah Daerah tidak dapat dibuktikan dengan pendekatan pidana, melainkan harus melalui pendekatan administratif berupa pengabaian terhadap surat peringatan bertingkat. Rekonstruksi norma ini penting untuk harmonisasi penegakan hukum lingkungan di Indonesia. ABSTRACT The purpose of this study is to examine the juridical criteria of "serious violations" and the mechanism for proving the "intentional" element in Article 81 of Law Number 32 of 2009 (UU PPLH) regarding the Minister's corrective authority. This study uses a normative legal method with a statute approach and conceptual approach. The study shows that there is a vague norm in Article 81 which has the potential to cause legal uncertainty and disputes over central-regional authority. This study found that the criteria for "serious violations" must be limited to transboundary impacts and irreversible damage. In addition, the element of "intention" of the Regional Government cannot be proven by a criminal approach, but must be through an administrative approach in the form of ignoring multi-level warning letters. This reconstruction of norms is important for the harmonization of environmental law enforcement in Indonesia.

Abstract

Memorandum of Understanding (MoU) mempunyai peran yang sangat urgen dalam penyusunan kontrak bisnis. Substansi dari MoU kemudian akan dimasukkan pada kontrak yang dibuat para pihak. Tujuan penelitian ini ialah guna melihat secara lebih dalam mengenai tentang urgensi pembuatan MoU dalam penyusunan kontrak bisnis. Di samping itu penelitian ini dilaksanakan juga untuk memahami secara mendalam tentang kedudukan MoU teori dan prakteknya dalam penyusunan kontrak bisnis. Penelitian ini mempergunakan metode yuridis normatif melalui pendekatan Perpu, analisis konsep hukum, serta pendekatan fakta. Temuan studi ini memperlihatkan bahwa pembuatan MoU untuk kontrak bersekala besar dan beresiko tinggi demikian urgen dan diperlukan, guna menghindari adanya kerugian karena prospek bisnis yang belum jelas, belum adanya jaminan kepastian hukum menyangkut perijinan, serta penandatangan kontrak masih lama dan tidak bisa segera dilakukan. Selanjutnya menyangkut kedudukan MoU dalam penyusunan kontrak bisnis diperoleh hasil penelitian bahwa secara teori, MoU belum merupakan kontrak, tetapi hanya kesepakatan pendahuluan saja yang memiliki tujuan menjalani ikatan moral saja. Namun prakteknya di Masyarakat MoU banyak dibuat layak seperti struktur sebuah kontrakyang mengikat secara hukum.   Kata Kunci: Urgensi dan Kedudukan, Memorandum of Understanding, Kontrak Bisnis.     ABSTRACT   Memorandum of Understanding (MoU) has a very urgent role in the preparation of business contracts. The substance of the MoUs will later be included in the contract made by the parties. The purpose of this reseaerch is to find out in depth about the urgency of making MoUs in the preparation of business contracts. In addition, this reaearch was also conducted to find out in depth about the position of MoUs in theory and practice in the preparation of business contracts. This study uses a normative juridical method with a legislative approach, analysis of legal concepts, and a factual approach. The results show that the creation of an MoU for large-scale and high-risk contracts is urgent and necessary, in order to avoid losses due to unclear business prospects, the absence of legal certainty regarding licensing, and the fact that signing the contract takes a long time and cannot be done immediately. Furthermore, regarding the position of the MoU in the drafting of business contracts, research has shown that in theory, an MoU is not a contract, but only a preliminary agreement that aims to uphold moral obligations. However, in practice, in society, many MoUs are made to look legitimate, like the structure of a legally binding contract.   Key Words: Urgency and Position, Memorandum of Understanding, Business Contract
