Abstract

The rapid current of globalization raises many problems in almost all aspects of human life, covering the political, social, cultural, economic, scientific and technological fields, so that fundamental changes in people's habits arise predominantly. Following the issuance of Law Number 11 Year 2008 on Electronic Information and Transactions (ITE) that was amended to Law Number 19 Year 2016 regarding the Amendment of Law Number 11 Year 2008 regarding Information and Electronic Transactions, many polemics and cases that lead to the pros and cons of the articles in the ITE Law took place. This study examines the classification of an offense of criminal act of contempt committed through electronic information media of and reveals the legal standing for such kind a criminal act. This study was conducted using normative method through analysis of legal interpretation and descriptive analysis. Apparently, the results confirm that the element of "contempt and/or defamation" contemplated in Article 27 paragraph (3) of ITE Law refers to Article 310 of the Criminal Code. Criminal acts of contempt committed through electronic information media are offense complaints that should be reported to the authorities by persons who feel that their honor or reputation is insulted or those who are empowered to obtain judicial justice from law.

Abstract

The international human rights framework requires cooperation and compliance from member states. Despite various mechanisms offering human rights protection, challenges persist in ensuring compliance and responding to human rights violations worldwide. In this research phase, a systematic literature review was conducted, employing an approach that referenced various sources available in various research databases. The research findings indicate that in analyzing the compliance of member states with international human rights court decisions, it can be concluded that the implementation of decisions involves a complex process and entails various factors. The mechanisms for implementing decisions at the national level require the involvement of legal institutions, civil society participation, collaboration with relevant parties, and education for law enforcement agencies

Abstract

A number of government policies to accelerate the use of electric vehicles are outlined in a number of statutory provisions. The legal umbrella for the use of electric vehicles was first outlined in Presidential Regulation Number 55 of 2019 concerning the Acceleration of the Battery-Based Electric Motorized Vehicle Program. Based on the background above, researchers are very interested in studying: 1) How are electric vehicles currently regulated in Indonesia? and 2) What is the ideal arrangement for electric vehicles to strengthen sustainable energy security in Indonesia? The type of research used in this research is normative legal research. The legal material analysis technique applied in this research involves describing what is the problem, explaining the problem (explanation), examining the problem (evaluation) and providing arguments from the results of the evaluation. The regulation of electric vehicles in Indonesia is currently regulated in Presidential Decree No. 55 of 2019, which is the initial regulation that became the legal umbrella for Indonesian electric vehicles, then derivatives such as PP No. 73 of 2019 which regulates the imposition of Sales Tax on Luxury Goods (PPnBM). Regulation of electric vehicles is ideal in strengthening sustainable energy security in Indonesia by advancing and regulating the biofuel industry, lithium battery industry and electric vehicles. In the future, the government can target public transportation vehicles to switch to using electric power with batteries.

Abstract

The justice that has been taking place in the criminal justice system in Indonesia is retributive justice, while what is expected is restorative justice, namely a process where all parties involved in a particular criminal act work together to solve the problem, how to deal with the consequences in the future, not yet regulated by strict norms that prevent criminal cases from having to be resolved outside of court using restorative justice. Based on the background above, researchers are very interested in studying: 1) How is the development of restorative justice in the Indonesian legal system? and 2) What are the principles of restorative justice in resolving criminal cases in Indonesia? The type of research used in this research is normative legal research. The development of restorative justice in the Indonesian legal system is based on the lack of satisfaction from the existing criminal justice system process, where it is felt that it does not meet the needs of the community, because in a criminal justice system process the parties in conflict are not involved but only involve between perpetrators and the state. Victims and the community are not involved in conflict resolution, in contrast to the principle of restorative justice where victims and the community are also involved in conflict resolution. The principle of restorative justice in resolving criminal cases in Indonesia is not something relatively new in Indonesia because it is a dispute resolution model which is one type of alternative punishment in the criminal law system in line with the aim of criminal sanctions according to the concept of customary law, namely restoring cosmic balance, balance between The world was born with the supernatural world, to bring a sense of peace between fellow citizens or between members of society and their community.

Abstract

Secara eksplisit, KUHAP tidak mengatur alat bukti elektronik, namun dalam ketentuan dalam Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik (selanjutnya disebut UU ITE). Berkaitan pergeseran paradigma pembuktian dalam KUHAP dengan pembuktian dengan sistem elektronik, salah satunya mengenai alat bukti saksi melalui teleconference. Penelitian ini mempergunakan metode penelitian hukum normatif. Peran teknologi informasi sangat vital dalam penegakan hukum dan keadilan, namun ada beberapa faktor yang menghambat pemanfaatan teknologi informasi secara sepenuhnya dalam penanganan perkara di peradilan, mulai dari ketersediaan perangkat teknologi, kesiapan sumber daya manusia hingga pengaturan hukum acara yang masih menentukan penanganan perkara secara manual. Untuk mengejar ketertinggalan hukum acara pidana dalam mengikuti perkembangan teknologi khususnya penggunaan alat bukti elektronik sebagai upaya perluasan dari yang sudah ada pada KUHAP maka dikeluarkanlah Undang-Undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi Dan Transaksi Elektronik (selanjutnya disebut UU ITE). Jika memperhatikan PERMA Nomor 8 Tahun 2022 ini juga tidak mengharuskan persidangan dilaksanakan secara elektronik, tetapi sebatas memberi landasan hukum dan pedoman kapan persidangan dapat dilaksanakan secara elektronik beserta tata caranya. Secara singkat implementasi ketentuan Pasal 2 PERMA Nomor 8 Tahun 2022 adalah semua peserta sidang wajib terlihat di layar dengan terang dan jelas dan dengan suara yang jernih.

Abstract

The notary is frequently a party to a dispute that occurs between the parties to the deed.  For the parties, the notary drafts an official deed.   Because of this requirement, the notary must have legal protection in the form of the right of renunciation.   Law Number 30 of 2004 about the Notary Position (UUJN) and Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Notary Position (UUJN-P) (norm vacuum) do not, however, restrict the right of renunciation for notaries.  This study employed normative legal research as its methodology.  The findings of this dissertation research serve as the philosophical foundation for allowing a notary to decline to perform his duties in relation to notarial deed making as a public official, namely offering protection and assurances for the attainment of legal certainty.  Adding guidelines for the legal protection of notaries in the UUJN is one way to standardize the notary's power of refusal in the course of law enforcement over notarial deeds pertaining to legal matters. Researchers provide a proposal with the formulation of norms that are made into additional paragraph (5) in Article 66 of the UUJN. According to the established norms, notaries who follow the law and ethical codes are protected from both civil and criminal prosecution while carrying out their official duties.

Abstract

Penelitian ini mengkaji tentang bagaimana optimalisasi penanggulangan Cybercrime di Indonesia melalui penguatan penegakan hukum POLRI. Penelitian ini merupakan penelitian deskriptif di mana peneliti melakukan deskripsi terhadap informasi, data, serta fakta yang dihimpun dari studi pustaka seperti hasil penelitian, jurnal, dan buku yang relevan dengan topik penelitian. Penelitian ini memaparkan bahwasanya Perkembangan teknologi memegang peranan yang sangat kuat dalam memengaruhi perkembangan pelaku kejahatan. Sebelumnya, para penjahat mengimplementasikan cara-cara dengan menggunakan alat yang konvensional, akan tetapi sekarang, kejahatan dapat dilaksanakan menggunakan cara modern melalui internet yang disebut dengan cybercrime. Pemerintah telah membuat regulasi khusus terhadap cyber law yang diwujudkan menjadi Undang-Undang Nomor 19 Tahun 2016 tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik. Indonesia sangatlah membutuhkan penguatan hukum siber dalam rangka  memperjuangkan ketahanan negara. Keberadaan hukum tersebut selain dapat memberikan perlindungan terhadap masyarakat sipil juga dapat memberikan perlindungan kepada negara dari ancaman kejahatan yang bisa terjadi pada dunia maya. Sebab itulah pemerintah menciptakan alat yang dapat digunakan untuk meningkatkan keyakinan dunia internasional mengenai keberadaan peraturan yang secara tegas meregulasi pertahanan siber sebagai usaha bela negara dalam rangka menciptakan keamanan global. Oleh karena itu, diperlukan Kerjasama berbagai pihak khususnya pemerintah, Polri dan masyarakat untuk memerangi kejahatan digital ini.

Abstract

Indonesia has faced various problems regarding the fulfillment of targets in energy development until now. Dependence on non-renewable energy is still high, causing the adequacy of energy reserves, especially in Indonesia, to still be highly dependent on the development of exploration. The legal rule of the authority of the regency/city local government to manage energy requires consistency in its implementation as stipulated in Article 14 paragraph 1 of the Local Government Law states that the determination of the division of government affairs in the fields of forestry, marine, and energy and mineral resources is divided into two, namely the Central Government and the Provincial Regions, in this case it clearly negates the autonomy of the Regency/City Regional Government. The authority of the provincial local government in the management of renewable energy Currently, the legal rules governing the authority of the central government in energy management are contained in Article 14 paragraph (1) and paragraph (3) of the Local Government Law. The authority of the regency/city local government in the management of renewable energy, the legal rules that regulate the authority of the provincial local government in energy management are contained in Article 26 paragraph (2) of the Energy Law. The lex specialis set of provisions or norms must be at a level (hierarchy) that is the same as the lex generalis set of provisions or norms. So it is clear that the City Government has the authority, namely attribution authority that comes directly from the legislation, because it is sourced directly from Article 26 paragraph 3 of the Energy Law.
