Abstract

Industrial design protection requires novelty as a condition for obtaining exclusive rights. However, Indonesia’s registration system combines the first-to-file principle with passive substantive examination under Article 26 of Law Number 31 of 2000, creating loopholes for registering non-novel designs or designs in the public domain. This study analyzes the legal implications of the absence of mandatory substantive examination for the validity of the Partisi Dinding industrial design registration and examines judges’ legal considerations in Decision Number 21 K/Pdt.Sus-HKI/2025. Using normative legal research with statutory and case approaches, the findings show that passive examination creates legal uncertainty and enables bad-faith monopolization of prior art. The cassation court cancelled the defective registration, recognizing digital and cross-border prior art evidence and applying the overall aesthetic impression test, thereby strengthening judicial cancellation as a corrective mechanism.
